    Florida just signed a new law the day after i uploaded this video.
    Today we look at 20 states where squatters can steal your land or home right out from under you.
    That is right we are looking at how squatters can use the law to legally claim your property.
    Joe Rogan was talking about this on his Podcast and I found it really scary and interesting at the same time. It seems insane that people can just waltz into your home or real estate and take it over.

      I'm actually looking at this as a possibility for me given my current hardships, but I won't be taking land from people who own it. There are actually plots out there that have been completely abandoned and are under no one's ownership. That's how I will use the system. I've been driven into extreme poverty and homelessness thanks to the mismanagement of the country's economy.

      It just sounds silly honestly. If someone was to forcefully remove them instead of filing a complaint then it could be handled but if you go to police and say someone is living in your house then I guess you can't remove them?

      Sadly, even in TX, renters who are not paying rent can easily stay for 2.5 months before they can legally (without some help from the 'influencers') be kicked out. It used to be no more than a month before the pandemic.

The house next door to me was often vacant as the owner lived out of state and she wouldn't rent to anyone unless she came down to meet them, which was tough for her to do. The house was always in good repair; it was a neighborhood of charming older homes on large lots, and due to the size of the lots it was desirable. These homes rarely came up for sale but the wanna-be buyers were like vultures and knew the home was vacant. Long story short: over a period of 15 years she haad 2 squatters. One was a county code officer (this was a county pocket at the time). That guy was the shadiest. he falsified documents, all kinds of crazy stuff. There were no violations on the property; it wasn't in disrepair. It took her 4 months to get him out and prove she had neither sold nor rented to him. I'm sure this happened often with seasonally vacant homes. So crazy. This was in the late 90s.

      I was gonna say, it was terrible landlords that expanded renter's rights to the point of being detrimental. However, landlords didn't cause "squatters' rights" to be a thing. This is residual from the days of taking a horse and buggy across the plains and staking claims to land. It then morphed, due to periods when people were abandoning property and the states saw a benefit to allowing others to take over that land. That way, there would be someone responsible for the tax bill. You're not wrong. Greedy politicians are behind this.

      I used to live in a rural county in California with a similar sheriff. He told us, “Our response time can be up to 45 minutes where you are. You do what you need to do to protect yourself and your family.” He gave conceal carry permits to as many of us as he could with no apologies.

      Not if no body cares. Probably be best to ask though. Those laws really do exist for a reason. I believe that it may be because one is presumed innocent, until proven guilty. And that is actually no bodies business except the true holder of the Deed, and the persons presence on the property.

    I think this explains what's wrong with our country. Criminals have more rights than law-abiding citizens. In fact, if you obey the law, more often than not, you will be the one victimized. The worst part of this is that there is no way to fix this. Revise the laws? That would require the politicians, who for the most part have benefitted from the current system to take a step back and actually think about the people they claim to represent. Not going to happen in this world.

    I had a situation in Texas and was worried about someone using abverse possession to take my land. I talked to a land lawyer. He told me that shit doesn't happen in Texas. This person was using my land for over 15 years and had it fenced off. I was told to move the fence by both the lawyer and the county attorney. We did and now have our property back.

    My squatters (POS) broke in 3 times and removed my NO TRESPASSING sign. The 3rd time the police said Its a civil matter WTF.After court they stole anything that wasnt bolted down.I did get a money judgement but Ill never see it.This was Flint Michigan.TRESPASSING IS ILLEGAL OR NOT .Change the squatter law.

    I know a church in Ohio that is dealing with this problem. Neighbors put fences several feet past the property line. They claim it"s theirs by possession and were "paying taxes" on it. The Church's lawyer told them that Church owned property isn't taxed and their houses hadn't even been there for the 21 yr requirement. He informed the offenders that, if the church has to take them to court, they will sue to recover legal cost and get it. Florida just passed one of the first anti-squatter law.

      One of the reasons this is a problem in California is that there have been activists and advocacy groups teaching people how to sue their landlords for large amounts of money.
      Some years back there was a new politician (middle-aged female Asian) who was running for office in one of the big California cities and she made this problem public.
      Entitled people believing that it's their right to victimize others whom they perceive as wealthy and undeserving has been one of the causes for high rents and homelessness in California. Tjis dynamic also feeds into high deposits so there's a big entry threshold of first month's rent sometimes last month's rent and deposit for damages. It can be a reason why some people a feel compelled to buy overpriced properties just to ensure their own shelter --- ending up in pure speculation on price appreciation.
      Given the high resale value of many properties some of these owners are not wealthy and have enormous mortgages you have to roll the dice and find tenants they believed to be qualified and honorable.
      It's true that tenants sometimes stay on for failed to pay their last month's rent for fear of landlord holding on to deposits unjustly -- especially if they have createf damaged or unwilling to clean up after themselves and return the property to the condition in which they rented it.
      There are agitators who want to turn the normal landlord tenant tensions into a class war issue. Tenants tell themselves that they are paying for the landlord to buy the property, even when much of their rent is going to high property taxes and mortgage interest, with only a slight sliver going toward paying off the principal especially on a newer 30-year mortgage.
      Of course it is the wealthier better- positioned owners, who can afford to pull their property off of the market until they need to use it or to speculate on pure price appreciation.
      There's also the issue that if they continue to rent and sometimes just offer the property for rent they will be subject to anomalies in the law which means that the IRS in characterizing the property as rental imposes depreciation rules rules which may or may not create a current tax break but which ultimately results in high taxes upon sale when the government moves to recoup the potential tax break whether or not any real savings were realized.
      This is just one of the many ways that federal and state tax codes accepted accounting principles contribute to unaffordable housing, exclusionary neighborhoods, and in cases of urban areas tipping into a downward spiral the actual creation of slums, when for example landlords cannot write off as expenses massive Capital Improvements in a property's infrastructure such as roofing, plumbing, rlecttic and heating/ air conditioning equipment.

      Look up the huge chinese 3 tower complex with graffiti in SF (I didn't know they had other graffiti towers too - what a city). I think they estimate 1200 homeless living in them. It was a big project that went belly up but the glass was in so it is sheltered.

    This is a good video, but it misses the point. The problem isn’t the adverse possession laws. The problem is that people are moving into homes in the middle of estate processes, or while people are away, then fabricating leases, and creating a false landlord tenant relationship in order to move the eviction case to a civil process, which can take months or years, instead of a criminal or civil trespassing process…..which is immediate. The adverse possession laws protect peoples boundary disputes…..for example a neighbor may have his property surveyed and then claim your shed is on his property. You can claim you installed the shed, or garage or pool, whatever more than 20 years ago and the land under that structure is yours.

    This is EXACTLY why you want friendly relations with your neighbors if you can be that fortunate. If you have neighbors you can trust (rare I know), you can have them keep an eye on your property and even give them permission to call the police should someone who is not supposed to be there shows up. My mother knows all the neighbors within 6 houses of any direction from her house. Most of them are in their 50s and up and would gladly call the cops if someone messed with any of their properties.

    As a good landlord I hate these people. My family worked blue collar jobs to buy these houses decades ago, it's a separate job to keep these old houses up to code. You're not entitled to my property, you're not allowed to sub let. California is getting worse on this. Modern squatters abuse these obsolete laws and how they were intended. They are a left over from Europe when people died young, went to war and silly men in metal hats arbitrarily change everyones property lines. I have no problem with people staking claims on abandoned property owned by nothing. Like corporations are people apparently according to the 14th and 15th amendments. We got a lot of empty houses owned by corporations that don't even exist anymore. Go petition the county for a claim.

    It seems like the easiest way to stop this would be to keep people from getting a foothold in the first place. I think if I had a property I would have a security system monitored security system. So as soon as somebody gets into the property the police can be notified and they can be charged. This way they have no time to even be in the property

      IT does not work that way. Police does not give a shit about people from who they get pay check. We are dealing with this with a squatter now and wednesday is court hearing. 6 months unpaid rent and he put a case on us also to deal with. NJ is useless and police useless. All they say is , its a civil issue and go to shariffs court. Shariff court gave another 3 months for court hearing. So learning very hard way. Police does not want to even bother when we complained as he is recording and harassing us if we go and ask rent or leave. Security systems .,...no match. These habitual thieves and mafia gangs are so good to destroy security systems to get in. Police have become basically useless now with this no police movement by woke democrats. We live in upscale neighborhood . Imagine, if its in not so good neighborhoods. Politicians only interested to make money and better life for themselves and dont give a shit about nation and people who voted them to give them such a powerful position and life. Highly selfish politicians and irresponsible police also.

    New York and Georgia have introduced legislation to get rid of squatters rights. I have contacted each of my local and state political leaders to find out how to get this bill introduced.     There was a scam in Nevada, where people would sell parcels to foreign tourists, and neglect to tell them about taxes. Then when the new owner would not pay the taxes, and the county auctioned the parcel for taxes due, the original selller would buy the property, and sell it to a new tourist.

    It’s not as easy as you think in California. We had squatters at the trailer park. Just pulled up their rig and thought they could stay. We have a waiting list. The park manager called the police and the cop said he couldn’t do nothing about it. She called the police again, and got the sergeant on it. He walked up to the squatters and said if you’re not gone within an hour, I’m arresting you for trespassing and impounding your vehicle for a month. They were gone within the hour.

      Depending on where you live, there are folks who will live in houses that are on the market if the owner does not live there. They get paid to live in the house and make sure nothing happens to the property. Once the house is closed and keys exchanged, they move on.

    I wonder when NC changed from 30 years to 20 years. I was on the jury for a case where a number of different parties were trying to claim a piece of land owned by the State of NC by adverse possession. At the time, you had to live on the property and make improvements. One of the parties had put their hogs on the property and put up a few sheets of metal roofing to fence in an area. They claimed that was "improvements." Another party was logging part of the property. A third party claimed they had a deed for the property. The property was a large tract of pocosin land that was taken by the government for back taxes in the late 1700s. That third party had gotten a quitclaim deed from an heir of the original property owner and then deeded it to their son. The state attorney showed two problems with their claim. First, since the state had taken the property, the heir never really owned an interest. Second, the deed to the son was dated before the deed from the heir. You should have seen his jaw drop when the attorney sprang that on him. After six days of trial, the judge dismissed us and said there was nothing for us to try, as none of the defendants had shown proof of adverse possession that complied with state law.

    The squatter issue isn't so much about what you're talking about. Yes, it's possible to take a piece of land through adverse possession. But it takes a very long time, as you point out and you must openly be using the land. You can't come by periodically and hide out. Can this happen? Yes, but it's not super common. What does happen a lot lately and what is in the news lately is people who pretend to be a tenant by simply moving into a property and staying for 30 days. As long as they have some proof they have been there 30 days, the police can't kick people out. You have to go to court for an eviction which could take months if not years.

It's about having a parent die and going to settle the estate on the old family home, only to find it occupied. It's about going on vacation and coming home 2 or 3 weeks later to find the locks changed.

      Adverse possession commonly occurs with boundary issues between neighbors, particularly when one neighbor's fence encroaches over the other neighbor's property, and if it's done for the statutory period covering adverse possession, that encroaching neighbor obtains ownership over their neighbor's property. Squatting in the context of recent news reports has to do with establishing tenancy, not necessarily ownership of the real property. In many states and municipalities, the window to establish tenancy is too short, like New York City, where a squatter only needs 30 days to become a legal tenant, thus establishing a landlord-tenant relationship between the owner of the property and the squatter.

    Governor DeSantis in Florida just signed a new law taking effect July 1, 2024 where squatters will lose all of their rights and will be arrested. If they are found in someone's home they don't belong in and if they do any damage $1000 or more it will be a felony.

      Gotta think critically on the concept overall, but first you have to realize you don't truly "own" much of what you're told you own or how to go about "owning" property. If you have to pay annuities on it or have it foreclosed upon or repossessed you don't own it. Actual ownership by objective definition entails "paid in full" status aka no further payments toward the property necessary to external entities...you may have to pay to maintain it and repair malfunctioning aspects but you couldn't ever have it taken away by a government or bank or even a third-party loan entity. By definition you are annually extorted under threat of loosing something you've been misled to believe you "own". The closest you can get to truly objective ownership requires an allodial title. Any other angle commonly believed to officiate lawful ownership are actually nothing more than a prop to sell the illusion.

    Credit goes to the Democrats and Republicans of the Florida legislature who unanimously passed this bill. They simply gave it to the governor to sign. He pretty much had no choice because if he had not signed it, it was going to go into effect anyway because it was veto proof. So give them credit for working together for once Democrats and Republicans.

    Those laws should have been created to apply when previous occupants are involved. I agree with many on here, try to steal my house in this way and I will likely need to buy a few yards of concrete for a new patio.

      Concrete can be broken up. Plant protected species of flowers and such on top. Those can't be touched.

    Guess who takes your forgotten property if the squatters don’t…
    The state government… known as “escheatment”.
    They can take your stocks if you don’t check your portfolio regularly in some states.

    Adverse possession can easily defeated by granting permission for a period. This resets the clock since their occupancy is not adverse if you grant permission. This gives you time to set up eviction.

    I went through an adverse possession case on NYS. My neighbor had built his shed n other stuff on my land years we moved in. Long story short, it is extremely hard to take someone property through AD.
    Really u would need to talk with an attorney that specializes in these cases in ur state.
