- Today, the Supreme Court ordered the release of Prabir Purkayastha, the editor-in-chief of news website NewsClick, and declared that his arrest under the draconian UAPA was “invalid in the eyes of law”. Purkayastha, who has been in jail for over six months now, was accused of using Chinese funding to promote “anti-national propaganda” through the digital media. Faye speaks to senior Supreme Court advocate Sanjay Hegde about the case.

This has become a pattern partly because those responsible for wrongful arrests are not held accountable. There is no compensation for the loss of time, health and opportunities. If there was a fine for such arrests, there would be probably fewer people behind bars without a good reason.
yes , the process is the panishment. SC should come heavy on the agencies so that this is not repeated.
Coming "heavily" on the agencies orally is not going to be of any consequence.
The arrest of people on flimsy grounds and false evidence is not something new...

All these examples only assert the fact that we are a banana republic... The PMLA, UAPA etc arrested and jailed if declared innocent.. The arresting authorities and judges should be send to non bailable retension.

If it is illegal then who is responsible and what punishment is justified against him/them ?
The News click Founder and the senior journalist should be paid a heavy compensation, and the culprits should be punished for the injustice done.
What is Magistrate court doing? these trial courts and Magistrate courts have become just a formality. Every issue needs SC to resolve it or grant justice. These judges when found not delivering justice to this level of granularity, the SC has to take action. Send them back to training or some action. Here there is no question of interpretation of law wherein the judges may differ, here its a procedural lapse and the Magistrate has not observed it!!!!!
Who is that Magistrate, at least Bar council need to take action against him.
When the Hon SC directed his release, why didn't they simultaneously slap heavy penalties on all concerned with this illegality? That would have at least stopped this sort of witch-hunting by the govt.
SC is also part of fooling game of common Indian....you arrest and keep them behind bars and we will release them once a lesson in taught to him...SC and Government have been fooling common Indian since decades but more frequently in the last 10 years

In each of such judgement of exoneration, the judgement,if there is any, should mention at what stage error occurred in wrongly arresting the individual so that future course of action can follow. Otherwise such cases will go on recurring.

This once again demonstrates abuse of power considering due process is not followed. Would the persons behind his arrest subject themselves to similar adhoc procedures involving imprisonment? When the crooked rule, such grave offences by the State will be common. The crooked should never be given power if human well being is to be secure.

The standard and quality of Magistrates in the lower courts is abysmally low. Its been for a long time that the need for raising the standard of the bar was required to conduct exam in line with the UPSC , but that's been pending for long. Judiciary exam should be held in line with medical, engineering and other disciplines on All lndia basis. NLU'S were established to raise the standard of our judiciary, but unfortunately students passing out from the top NLU'S opt for other avenues. The void of good advocates is therefore fulfilled by a large no of private law colleges approved by the BCI producing third grade lawyers for whom the accused person don't get access to quality lawyers.
Where else would a supreme court advocate share his knowledge 🤌 i love these legal/professional discussions

Sometime seems our supreme Court some judges are the only source of justice for indians.
Imagine the appreciations of ordinary citizen who has no connection etc while dealing with police and powerful people. They simply choose to be silent. Among 200 nations, India is way behind in giving its citizens a good system to live.
There are number of people who are in jail for years like this. No one talks about it because there is no one talking about them. When they finally get released it is after 10-20 years. They are just happy to be out and sit with their head down. That is the reality of minorities in our country.
Its time for the PEOPLE Of India;1.4 Billion should now STAND UP and fight..

It's Sanjiv Bhatt and I agree there should be a fair representation for him as he's in jail for carrying out his duty. It's a which hunt which is keeping him in jail. I want him to be set free. Why can't the SC take cognisance? They're his only recourse

Does there exist anything, under the sun, perhaps in, the whole of existence and beyond, farther, further,..which has somehow been able to've escaped the jurisdiction of stupidity, inefficiency, incompetence,.. (the) purview of, "commodification".
Also, just to add, people across the wildest possible range of occupations, professions,..should be able look, see, view,..things beyond, the prism of salary, fee,..rise to a higher motivation, drive,..and act, or, have acted, in accordance with it, the same/identical,..
My question is, how come politicians can do what ever they want. Why cant its possible to stop them, even after we have reached the 75 years of Independence.why not any of our institutions (supreme Court) can bring strict laws even if it tamper the integrity of the country. Is it not shame.
