  • Today, the Supreme Court ordered the release of Prabir Purkayastha, the editor-in-chief of news website NewsClick, and declared that his arrest under the draconian UAPA was “invalid in the eyes of law”. Purkayastha, who has been in jail for over six months now, was accused of using Chinese funding to promote “anti-national propaganda” through the digital media. Faye speaks to senior Supreme Court advocate Sanjay Hegde about the case.

    How will dr. Purukasyastha be compensated for illegal detention. Those responsible for this act should be made to serve double time in prison, so that they don’t repeat this on other citizens. THEY MUST BE PUNISHED. THEY MUST BE PUNISHED . THEY MUST BE PUNISHED.

    This has become a pattern partly because those responsible for wrongful arrests are not held accountable. There is no compensation for the loss of time, health and opportunities. If there was a fine for such arrests, there would be probably fewer people behind bars without a good reason.

    All these examples only assert the fact that we are a banana republic... The PMLA, UAPA etc arrested and jailed if declared innocent.. The arresting authorities and judges should be send to non bailable retension.

    What is Magistrate court doing? these trial courts and Magistrate courts have become just a formality. Every issue needs SC to resolve it or grant justice. These judges when found not delivering justice to this level of granularity, the SC has to take action. Send them back to training or some action. Here there is no question of interpretation of law wherein the judges may differ, here its a procedural lapse and the Magistrate has not observed it!!!!!

    In each of such judgement of exoneration, the judgement,if there is any, should mention at what stage error occurred in wrongly arresting the individual so that future course of action can follow. Otherwise such cases will go on recurring.

    This once again demonstrates abuse of power considering due process is not followed. Would the persons behind his arrest subject themselves to similar adhoc procedures involving imprisonment?     The standard and quality of Magistrates in the lower courts is abysmally low. Its been for a long time that the need for raising the standard of the bar was required to conduct exam in line with the UPSC , but that's been pending for long. Judiciary exam should be held in line with medical, engineering and other disciplines on All lndia basis. NLU'S were established to raise the standard of our judiciary, but unfortunately students passing out from the top NLU'S opt for other avenues. The void of good advocates is therefore fulfilled by a large no of private law colleges approved by the BCI producing third grade lawyers for whom the accused person don't get access to quality lawyers.

      There are number of people who are in jail for years like this. No one talks about it because there is no one talking about them. When they finally get released it is after 10-20 years. They are just happy to be out and sit with their head down. That is the reality of minorities in our country.

      It's Sanjiv Bhatt and I agree there should be a fair representation for him as he's in jail for carrying out his duty. It's a which hunt which is keeping him in jail. I want him to be set free. Why can't the SC take cognisance? They're his only recourse
