  • PACE UK: Police Powers

    Section 1 of PACE UK, also known as the Police and Criminal Evidence Act 1984, outlines the general principles and provisions that govern the powers and procedures of the police in England and Wales when dealing with suspects, arrests, detention, and related matters. PACE is a crucial legislation that ensures fairness, protection of human rights, and the proper administration of justice within the criminal justice system.
    This section of PACE sets out the fundamental guidelines that must be adhered to by law enforcement officers during the investigation and handling of criminal cases. It aims to strike a balance between the powers of the police and the rights of individuals, providing a legal framework that safeguards against abuse of authority and protects the rights of suspects.
    The key provisions covered in Section 1 include the definition and scope of police powers, the general grounds for arrest, and the procedures for exercising these powers. It also establishes the rights and entitlements of individuals when in police custody, such as the right to be informed of the reasons for their arrest and the right to legal representation.
    Additionally, this section emphasizes the importance of obtaining evidence in a lawful and transparent manner, with guidelines on the use of search warrants, seizure of property, and the conduct of interviews. It outlines the safeguards against unlawful searches and ensures that evidence obtained improperly is excluded from proceedings.
    Section 1 of PACE UK reflects the principles of due process and safeguards against arbitrary detention and abuse of power. It provides a comprehensive framework that promotes accountability, fairness, and respect for the rights of individuals involved in criminal investigations. Compliance with these provisions is vital to maintaining public trust and confidence in the criminal justice system while upholding the principles of justice and the rule of law.

      It was obvious that Sec1 was the first thing that came into his head.
      According to his logic, according to him anyone in 'close proximity' to a police station should be questioned about whatever they are doing, and will be expected to provide a reason for whatever they are doing, and probably a name and DOB for some unknown reason. Don't go anywhere near them, you could be up to something. I thought police were a PUBLIC SERVICE, not the Gestapo.

    An absolute abuse of power - this as an illegal detainment!
    Under section 1 of PACE, a police constable may stop, detain, and search any person or vehicle in a public place, as long as the officer has ‘reasonable grounds’ for suspecting that they will find stolen or prohibited articles - such as drugs, a weapon, stolen property, prohibited fireworks, or something that could be used to commit a crime.
    An officer’s reasonable grounds for suspicion should be based on a two-stage test:
    The officer must have formed a genuine suspicion in their own mind that they will find the object
    The suspicion that the object will be found must be reasonable
    The fact he never even asked you if you were carrying any of the above, and obviously there was no genuine suspicion of such as a search never took place.

    I understand that only a grade C in a GCSE is sufficient to join the police (basically being able to spell your name), but surely cops should be taught the very basics of their job in training school, and to detain Reggie under section 1 of PACE is absolutely ridiculous☹.

    • @01matthewc
      @01matthewc Před rokem +1

      GCSE's have very little to do with the appaling state of the UK police these days. A lot of police officers are graduates, in other words, academically, they can pass exams, but they have no common sense, no life experience and are in no way street wise. Although degrees are useful for some jobs and professions, life has taught me that in most jobs and situations, there's no beating the university of life, and I'd include being in the police force in that.

    • @user-io1dc4eb9q
      @user-io1dc4eb9q Před rokem +3

      @@01matthewc I’m unsure why anyone with a ‘decent’ degree (as opposed to what I describe as hobby degrees) would waste their good degree joining the police. I take your point that common sense is lacking in many cases, but if the criteria is just a grade C GCSE to join, then many people would perhaps struggle to grasp the basics of what they are taught in training school?

      @@01matthewc I think that you might be missing a point...their is a mindset of those who want power over others, usually they are right-winger authoritarians, who regard themselves as deserving of the right to control others. they love heirarchy, lick the boots of those above them and kick those they see as below them. this sort of person feels good in the uniform (disguise) and soon nurture within themselves an "us v them" mentality, hence the "thin blue line" gang. they ruin the police for all those who joined becuase they genuinely wanted to help society.

      When a bully is confronted and embarassed in front of his peers, does the bully
      (1) Apologise having appreciated the error of his ways and its detrimental effects on the bullied person
      or
      (2) Now hate every one and everything even more, and vows to get even with the rest of the human race, to whom he is inferior, next time remembering to target a more vulnerable victim.
      And later
      (3) Going on to rape and kidnap and murder and lie and rape again, while his fellow bullies from primary school approvingly nickname him "the rapist" on their whatsapp groups.
