  • The attorney client is st up so that you can say anything to your lawyer and that lawyer must keep you secret no matter what it is. But there are limits as this is explained in the video.

    I was a court appointed attorney to a client that was from the same notorious gang my brother is in, and my bro was recently released, I was "video" recorded during a meeting as an attorney in a California State prison, that resulted in a RICO indictment ...

      For the attorney-client privilege to exist, it must be in a private setting. If you go to your attorney's office and you bring along a friend to sit with you while you talk to your lawyer, the privilege does not exist in that situation. In a prison setting, the privilege should exist if you are talking to your lawyer in a private room set aside for attorney/client meetings. Talking to your lawyer on the prison phone for example where anyone can listen in is not a privileged communication. Also, the attorney client privilege does exist if a client and his lawyer are planning to commit a crime.

      @@bradmacnamara No it is not lawful for a prison to video record, in any manner, an attorney-client meeting. Prisons usually have rooms set aside for attorneys to meet with their clients and the prison staff cannot record them.

      @@THEFEDORALAWYER yeah there was a room to use for the meeting between me and my client,,, they installed a video recorder. They are using said video against me to bolster thier RICO Indictment, claiming I was making suspicious movements. Maybe I was moving suspicious... I am a C3-C4 quadriplegic, I can barely move at all,,,, I can move my shoulders and head, my arms and hands are seized, I use a custom $70k electric wheelchair when I'm not In bed.....
      Truth be told, I am not an attorney, I apologize for not being honest,,, I am just trying to wrap my head around what could happen, I am so afraid to lose my partner to prison,, or to a gang hit ( as they already came to kevins house), threatening to stab him, keep his mouth shut! Same visit this prison gang also beat up Sean, Kevin's older brother. Sean spent 18 years in CDCR, his last eight years were in Pelican Bay, I don't think Sean is AB, But I'm certain those were his aspirations. Kevin was a state-appointed attorney. He was assigned to a represent this scary life sentencd murderer. That has the same gang affiliations, as his brother that has been recently released from the Bay. Sean is currently in Orange county jail, CA, he broke his father's foot- (Gary Macnamara, a Retired LAPD lieutenant , punched, hit, robbed, Kevin. Kevin has absolutely zero capacity to defend himself, to run or even call 911,,,,,
      This case is still ongoing, Refered to as the "2019 Aryan Brotherhood Rico Indictment"
      Kevin Macnamara the indicted state appointed attorney and immobile quadriplegic, he was hit with the crime-fraud exception- RICO-, smuggling meth into a prison. Which is very much a physical impossibly for him. I'm sorry I went on for so long, this case is so complex, I don't understand anything,, I am a mechanical engineer, my mind does not efficiently compute this legal jargon. Once again I apologize, for writing a Reader's Digest, I'm just so scared I'm gonna lose my Kev-Roc... 😰

    How does this work when a lawyer also can’t suborn perjury? If you admit to them that you did, in fact, commit the crime how are they able to present to the jury that you did not or may not have?

      The state always has the burden of proving a person committed a crime. So the defense attorney must find a way to thwart the state's case without putting the defendant on the stand. A defendant never has to testify and the jury cannot take that into consideration for any reason. So a defense attorney must attack the state's case by other means.

    Do attorney/client privileges also extend to electronic correspondence i.e. emails, text messages?

      Very good question. Yes, if you send a text or email to your lawyer, it is considered privileged. Just don't cc'd anyone on the email or text. It has to be only to your lawyer.

    Hi, I want to ask if Detective have the right to film or take a picture of a person inside apartment hall and film or take picture directly at the person who is in their apartment room?

      I need more details as to why cop was there. And what do you mean by apartment room? Are you just renting a room in an apartment that is rented by someone else? The hallway of an apartment complex is common area so probably not an issue if cop takes photos or does filming in that area. But not inside your apartment without a warrant. How did cop come to be inside your apartment? You can always tell him leave. Also, you can file a complaint with the internal affairs division of whatever agency the cop works in.

      @@pyrradraconem4322 If you are renting from someone, the place you are renting is yours. Cops don't have right to come into your apartment and take photos without your permission or a warrant. A landlord cannot let cops into your rented apartment.

      @@THEFEDORALAWYER And further question, is it possible for detective who is in the apartment hallway ( they still outside the person's apartment since the person don't let them go in, but the person open the door) to take picture or film video at the person inside the room when the person is not let them go inside the room.
