      Not true. If you're trespassing and refuse to leave security use citizen's arrest and can detain you using reasonable force till the Police arrive. Seeing as the idiots filmed themselves on the roof the Police would do nothing about it anyway.

    3 Types of trespass
    Civil- can’t be arrested
    Aggravated- could be arrested
    Criminal- can be arrested
    You were only breaking civil trespass. To be honest security will be annoyed as they could lose their contract, or whatever, as they have failed the land owner. Let them call the police. They can’t do much.

      You could argue that opening and entering the lift shaft could be classed as criminal or aggravated trespass at the time though as they have no proof they didn't tamper with the lifts internally
      Obviously they didn't but the security doesn't know that

    Security guards think they are the police. I HATE it when people think trespassing is illegal in this country. It's people like this who waste police time.

      It’s even worse in the US. Unfortunately, here, trespassing on private property *is* illegal. I’ll never forget the time I was stopped by security guards in a car park for taking pictures of the sunset from the roof. It was January of 2017. The guards pulled my mother over as we were driving out, took her license and registration, and threatened to call the police before finally letting us go. Thankfully, that’s the worst I’ve had to go through. The only other problems I’ve had as a photographer are paranoid morons freaking out and threatening to call the cops because they think I photographed them.

      I have been doing urbex and climbing things for over 10 years and have also explored and gone out to places with ben (beno)
      I know all the laws and all the rules that we urbexers can and cant do and what security can and cant do and they had legal right to detain them.
      Using force is not allowed but they can detain while waiting for police.

    I sometimes do long shifts as security in an office block; if I knew that people were inside who shouldn't be there, if I knew that they're not a threat then I'd just show them to the exit and only take further action when that request is refused

    A similar thing happened to me once in a multi storey car park in Bristol (which is where I'm from btw) except that they didn't assault me luckily. Basically what happened was I was riding in the lifts and then when I was on the top floor, 2 security guys came out of the lift and told me that I was on private property. So then I just told them I was just riding the lifts but they still told me to leave. They even asked me what my name was but obviously I didn't tell them. So then I started walking down the stairs but then the security wankers just followed me. I started running down the stairs telling them to fuck off and leave me alone. But eventually I managed to get away. I haven't seen or come across them since.

    Ok, I am studying law because I want to be a lawyer. Beno has done nothing wrong (By Law). This is because Trespass is not a criminal offense in England. The Security guys are not Police Officers so they do not have a right to detain you. If the Security Guard detains you, then you are being held against your Will (I.e, Kidnapping). The REAL Police may press charges on the Guard for Kidnapping while Beno is safe and not breaking any rules.
    The Guard only has a right to get u out the building. The assault that took place could also be charged by Police to the Guards. Since a Guard Role needs a DBS, those people will not have one (if charged). DBS Is a Clean Criminal Record

    All supervisor security guards, have licence to control, deter, and prevent crime (ONLY). Door supervisors, can arrest for following: A breach of the peace, these sections are under (Common Law). Indictable Offences, these sections are under (Criminal Law). There was one filming, but there weren't any unusual behaviour to make them look like terrorists, or breach of peace apart from trespassing. There for, legally DS on site should had continued to treat this as a civil matter, referring like l did above to this as a balance of probabilities from what l can see on CCTV l carefully made decision to approach them and now that l caught them l can see that they weren't acting unusuall, just messing about and they weren't hiding their identity etc covering they faces, or nothing on asking about arrangement of security while continuing to be filming. This correct step of motion, should have been carried out from start based on right risk assessment in a civil matter and are as follows:
    When you find yourselves in a situation like this, under company or organisation then policy of procedures ate to be as followed.
    (REACT)
    ... [In Numeric]...
    Request person to leave
    Explain the reason for request
    Appeal for the person to leave
    Confirm person is refusing
    Take action (evict).
    These are legal measures, that if had been followed may have saved these two DS men on site hell of a lot of time from handling the complaints. I am SIA, and l would had treated this matter not under suspicion of terrorist activity or unusual behaviour but just under tresspassing because boy complied and lowered his camera down and there weren't nothing more to be observant about but under a last resort to evict if l had to dependable if these young group were compliant with me using (REACT) then l would had informed site manager also made a description of day, date and time and how many there were and appearance in backroom of office so that we know of them trespassing again but only if l had to use reasonable force to evict them off site as keeping reports that aren't necessarily needed for tresspassers like these lads is a waste of time but maintaining relationships with these lads can actually discourage them to come back.
    Keep up you videos, clearly you weren't in any criminal wrong here mate just a civil lol. I should know, if only you had me and my colleague then we just do what l mentioned above that is our jobs but without hassling you unlike these two lost idiots that should be looked in to and complained about. Not all us decent DS is bad in the SIA, just most of the clueless, and narcissistics ones lol.

    These poor excuses for security guards are afraid that you will see restricted areas, while they proceed to take you on a complete tour of their complex, sadly while assaulting you. They have no right what they did. In Canada at least, if you are found to be trespassing, then a building owner can request that you leave. If you refuse, they can call the police, if you obey, they can't detain you unlawfully, and they can be arrested for assault and illegal detainment. I wish you all the best, and don't let these low-lifes discourage you.

    See where this problem arises the most, people have their rights either regardless of their situation, you have rights to tell people to back off if they are assaulting, abusing, illegall actions on you. Meaning you will have a high reason of having them detained or arrested for it. This of course WILL DEPEND on your country’s law (regardless you still have a half chance depending in your country law).

      Because the Police would do nothing except arrest those trespassing. Security can detain you if you either refuse to leave, or put yourself in a situation where you could injure yourself. Filming on the roor of a tall building would certainly be covered by that.

      You have zero chance of that. Firstly UK security guards can detain you if you refuse to leave a property. Secondly if you're on the roof of a tall building they can definitely detain you because you've put your own life at risk.

      We did phone the police afterwards and they refused to come. I have reported security to SIA licencing. As for suing them, I don't think it is worth bothering with. I currently have a much more important case which I am taking legal action on. I have not released anything publicly about it yet as I do not want to compromise the case until it is over. I have gathered all of the evidence I require and I am now at the stage of sending the notice of taking legal action. I am slightly stuck at his point as there are a few things I am not sure about with writing this letter. Have you actually sued someone someone already and have experience of writing this letter?

    Do you get permission to surf lifts? Because I am wondering because it looks like you surf lifts without permission.
    You Could get into serious trouble for riding on top of a lift if you get caught.
    Although I have always loved Lifts. I would never ride on top of a Lift Car because there are too many dangers. I only ride and film the lifts from inside.

      What I am saying is if someone i.e Security/Premises Management saw you surfing a lift. They could report it and then your lift keys would be confiscated and could be seen as a criminal offence.

      i dontknow where you live, but germans law on this is WAY more strict than it is in the Uk but there is no way they could confiscate your keys, that is theft. As long as you have not stolen the keys and they are freely available online they can not confiscate them.

      Edmund Fisher, can you give me more details of this. This doesn't seem legal. They can't ban for an entire county. What is the anti social behaviour they are claiming you did.

      Beno using cabinet (not even car top or surfing) inspection and looking in the shaft, it was a glass shaft without a glass lift and I couldn't resist having a look.
      The anti social behaviour they say I did was putting myself and others in danger, mind you this was out of business hours and there was nobody else around. They also tried to blame me for vandalism and graffiti that happened, even though it wasn't on CCTV and I wasn't there on the day. My solicitor said I can't be charged as there is no evidence, and being on top of a lift isn't criminal damage or trespass even if I put myself in danger.
      I'll put a link to the image of the protection notice in my next reply, but youtube might delete it.

      This is not legal on a number of grounds. Appeal this immediately.
      This is wrong on so many grounds. I would even go as far as saying this goes against the magna carta

      Yeah I'm gonna appeal on Monday, I hate the whole idea of community protection notices. If something is illegal then the police should interview the person with a solicitor present and involve CPS, and if it's not illegal then they should mind their own business.
