Former Cop Busts Fake Cop for Police Impersonation

  • ‪@Copwatchtv‬ obtained body camera footage of a recent police interaction of San Juan County Deputies pulling over a man accused of impersonating a police officer.
    A former cop was driving down the highway when the suspect flashed "red and blues" and seemed to try to attempt a traffic stop. The former cop called 911 and reported the strange behavior.
    Soon deputies pulled the suspect over and he was evasive on his answers on if he had red and blue lights in his car. He eventually gave them up to the deputies and was criminally summonsed to appear on impersonating a police officer.
    The featured content is NOT intended to be violent nor glorify violence in any way. We are sharing this footage STRICTLY for the purposes of news reporting and education.

      Crazy thing but having red and blue lights on a your car is Not impersonating a police officer. Because a Vehicle can not personate a police officer, it's actually a vehicle code lighting Violation in every state.
      Impersonating police officer is
      ( A person) who falsely pretends to be a peace officer and performs an (act) in that pretended capacity commits impersonating a peace officer/telling someone he is a police officer.
      So even if he is using the to lights to move cars out the way but never actually pulled them over the most he will get is a ticket for unauthorized use of red in blue lights aka a vehicle code Violation.
      I did a ride alone about 4 years ago with my local police department and during the ride along there was a guy that had red and blue lights on his windshield. He was at a park and ride. The officer I was riding with pulled behind him and went to go talk to him after about a hour or so of all the officers talking about chargers they were reading the laws on Impersonating a police officer.
      Red and blue lights was not on the list
      It has to be a Combination of things Combined for it to be considered police impersonating.
      They had send him off with a fix it ticket which is crazy asf.

    He doesn't flash the red and blue because he wants people to move. He does it because he craves the authority over people on the road. How many times have you witnessed a guy driving recklessly on the road and think to yourself, "Man, I wish a cop were watching this." He solved that statement by putting fear in other drivers by way of flashing red and blue lights. That feeling of dread you get when you see them behind you. He sees himself as one of the good guys, a vigilante, who's there to slow other drivers down, or basically assert his will on people when the cops aren't around to. A strong case of Dunning-Kruger effect, where he believes he is on par (or perhaps more qualified depending on his level of narcissism) with the training, laws and knowledge that you must have to be a police officer. This video just proves that he's anything but a good guy. He's a self-preserving liar and anything he says going forward can't be trusted.

    I used to impersonate a police officer for a while, I'd have a badge and a radio and stop folks and question them, made up charges to confront people with and issue directives, but I stopped doing it when I turned 8 years old and decided I wanted to be an astronaut instead.

      It is 100% a FELONY. The Officer attempted to get the guy to fess up, but without proof, he couldn’t arrest him. It would be tough to hold up in court. It’s the officer’s discretion to just let it go.

      @@FridayBeers12there really wasn’t anything going, I wasn’t illegally making calls. It was hands free. It’s a 2006 and it was archaic but hands free. I wasn’t speeding I had my cruise set 2mph over and just putting along with everyone else. I said I was making calls and after this guy passed me several times I got annoyed and sped off. If they wanted to give me a ticket I wouldn’t care but a misdemeanor out of the officers presence can’t be cited. He flashed red and blues, I pulled over and he sped off… my gut told me he wasn’t a cop. I called. The video you see is the 3rd or 4th officer so I wasn’t trying to be professional and factual it was pretty casual by that point.

    My husband and I had this happen to us about a month ago. Some idiot with Texas plates and lights tried to pull us over in our town. Unbeknownst to him, my husband is a retired cop and called 911. He followed us then got spooked so we followed him back until he pulled into a bank parking lot and the real cops arrested him and impounded his car. He just recently bonded out but he was in there for about a month. 🌸 moral of the story don’t try to be a fake cop in a small town in Colorado with Texas plates 😂

Cops obtain witness statements, and those are perfectly acceptable to establish probable cause that a crime was committed. If the prosecutor were to decide to pursue charges, the former cop could testify as a witness, and that's not hearsay. People who think cops need some kind of definitive "proof" to make an arrest or file charges just don't understand the law.

    For everyone confused. This happened in San Juan County New Mexico. The idiot impersonator lives in Texas. If he did this in Texas he would be in jail, as its a 3rd degree felony here. New mexico lawmakers have basically neutered their cops in recent years. They pretty much have to be on a federal task force to get anything done there.

      So the cop put NINE 9mm bullets in the guy's back at point blank range.
      Then when the guy crumpled to the floor, two cops ran up and

      Because courts in most states have ruled repeatedly in police impersonator criminal cases that someone has to actually falsely identify themselves as being a LEO in order to commit police impersonation. You could have a Erica police badge on and a blue windbreaker that says police on the back but if you do not actually tell someone you are an officer or attempt any action an officer would make, ( like ordering someone to pull over, or threaten to arrest someone ) then it actually isn't actual impersonation. If you remember Jeremy Dewitte he dressed up like an actual cop and had motorcycles and vehicles that looked just like police patrol units yet the only reason he was charged with impersonation was because he was on his own go pro telling drivers to pull over. You can actually dress up like a cop and it's protected under the 1st amendment. The same thing happened with stolen valor and The Supreme Court overturn d the law that made it a crime for people that never served in the military to wear uniforms or medals they never earned as The Supreme Court ruled that violates the free speech 1st amendment of people. The Stolen Valor law was changed so that now it's only illegal to lie about military service or medals earned if you are trying to personally or financially benefit yourself By lying about having served. He definitely will get convicted of unauthorized use of emergency vehicle lights however. And I'm not defending the idiot. He should get charged for police impersonation. Unfortunately the Supreme court ruled that under freedom of speech people can make themselves appear to be whatever or whomever they want as long as they don't commit certain specific actions.

      I was wondering this myself. I have a pretty thorough understanding of the 4th Amendment for someone who is not a lawyer. They clearly had RAS to detain the guy, but do they have probable cause for a warrant or arrest based only on witness information? I'm really not sure how this would go if the guy simply involved his Fifth.

    From what I've seen, driving something that looks like a police vehicle is a real pain in the neck.
    Years ago, the local city retired a police car and turned it over to the fire department. It still looked like a police car after the decals were removed. One of the firefighters told me about having to drive it to a training school one day. People would see it as a police car and would slow down and clog the interstate around him. They really hated driving that thing.

    Had it if actually been for speeding and clearing traffic, it’s laughable down the road. But putting a brush guard and going that far tells me this guy would absolutely use this in an opportunistic way to serve him in many other ways. He’s a freak

      This was the third officer to come talk to me. This wasn’t the initial contact. This is literally video of me and the third officer shooting the breeze while the dust is settling. It’s all you are seeing but this is definitely not all the video. You know that I shared my name, DOB, SSN and department I worked for and all of that. You know there is more. Yes, I said dude a lot. I laughed watching it. Yes I talked about where I was going what I was doing and I even said “like” more times than I care to admit. Haha but this is much further into their investigation than the initial contacts. I’m sorry I wasn’t impressing anyone. I was on vacation.

      @@BlueLineChop I agree. If the video had showed the first and initial contact you would have been happier with me. You saw how many officers were there. This was the third or fourth contact. I was super casual at that point. He had asked lots of other questions. Can you see how it may have unfolded? Can you see the huge holes in video?

    I wish people like this would stop & think about the risk they are taking with their children’s safety. It’s mind boggling to me that people could be selfish & break laws, intentionally, with their children present. I hope their children grow up to be better people than their parents.
