    We prepare an application, it is submitted in the USA to the United States
    citizenship and Immigration service (USCIS),
    And then once USCIS has completed its review, the case goes to the US State department’s
    National Visa Center (NVC) in New Hampshire.
    And finally NVC couriers the case overseas to the US Embassy in Manila for the
    in-person interview and approval of the Fiance visa.
    Then your Fiancee uses the visa to travel to and enter the USA
    Now let's get into the details:
    FIrst we submit a thick package of application forms and supporting documents and evidence.
    This is the "front loaded petition" that VisaCoach is famous for.

    When quality goes in, a positive result comes out.
    The petition package is mailed to USCIS.
    Fiance Visa applications go to Dallas Texas.
    After initial sorting then the applications are assigned and forwarded to one of six USCIS service centers that are scattered throughout the USA.
    At the destination USCIS service center your case is reviewed and processed.
    USCIS takes many months to complete their review.
    Normally, USCIS should complete their review in under 5 months, but recently however, under Covid they have been taking around twice as long.
    Hopefully this will improve. Recently I just had two cases emerge from USCIS in a super fast, three few months. I don’t know if that is a trend for 2022 (I hope so) or an anomaly. It’s too soon to really tell.
    If I get good news later, I will post a short "In a minute" video to update processing times. For the time being expect it to be slow.
    Slow or fast, US immigration is like a one lane highway. The sooner you enter
    and get in line the sooner you exit, and the cases that enter after you, will only get to
    Their destination after you do. So the sooner you apply, the sooner this will be behind you.
    The review at USCIS includes an FBI background check. This is usually only on the US Citizen’s background, however it will also include your Filipino fiance if she or he had ever lived in the USA for a while.
    When USCIS is satisfied with your application, they "approve", at least as far as they are concerned, then hand your case over to the NVC, based in New Hampshire.
    Normally NVC holds Fiancee visa applications only briefly. They quickly touch the application just enough to confirm that the Case should be sent to Manila, assign a new case number that starts with “MNL”, pack it into a DHL mailbag and ship it off to the Philippines.
    At least that is the way it normally works. The Philippines shut down and shut down hard back in March 2020. Since then the shut downs and quarantines have continued, and most businesses and services were closed for extended periods, some still have not reopened, some only partially reopened.
    The US Embassy in Manila followed the local quarantines as well. And while closed, or only partially opened, cases kept piling up.
    Today there are about a year’s worth of cases, which were approved at USCIS, assigned to Manila for processing, and are still waiting for their interviews.
    These cases are mostly still at NVC waiting for the US Embassy in Manila to say they are ready to interview more cases. When that happens, months worth of the oldest cases are doled out and sent to Manila for processing.
    The good news, is that since you are now allowed to travel to the Philippines as a tourist, this is
    what the consulate was waiting for. If quarantines are relaxed enough that ....

    I feel enlightened to this video. I was always having a crushes to American man such as singers and actors since puberty starts. I don't know why like I am much more attracted with them than most of my known male friends here. I was pursuing Student Visa because, i always want to see the beauty of USA and of course a huge advancement in applying jobs here. Who knows maybe America is the country that kept calling my soul all this time.

I have a question, when we pay you the $995, does it cover all the way to the end when my fiancé finally becomes a US citizen (meaning this can take a couple of years like explained).       The fee of $995 I charge for Fiance Visa Full Support, is through to issuance of the visa. The next steps of Adjustment of Status, Removal of Conditions and finally Naturalization are not included in the Fiance Visa fee, but when you hire me for the additional steps charged additionally.       Sorry, but I don't know what you are talking about. Nothing has changed to make things "easier". The process is still complicated and needs to be done right. The only things I see to change, is to announce that USCIS is currently taking 15 months to do their part, not the 5 months a year ago, and the US embassy Manila has stated that they no longer have a covid related backlog. Other than those two facts, I wouldn't change a thing.

      If you plan to submit your application soon upon return to the USA, we should start working together in June or July at the latest.     Do you have a list of things that would be helpful during the courtship which would make the application better? Examples that come to mind: spending time in the Philippines, going to other countries together on vacation, getting residency in the Philippines, getting married in the Philippines first, etc.?

      Contact a family law attorney to begin your annulment proceedings. ONLY after you are unmarried, can you apply for US immigration as a single woman. Abandoned does not mean single only means you are currently married to a bad person.

      To what purpose? To try to game US immigration? To stay in USA? A tourist visa is
      for sightseeing. What she wants is to remain permanently in the USA, lawfully with her American partner. They way to do that is via annulment, then fiancee or spouse visa.

      Historically the fiance visa is about 6 months faster than the spouse visa. Currently, USCIS has been extra slow in processing K1's, so the speed advantage is gone. Currently, both fiance and spouse visas are taking about a year and a half.

      Both paths are equally complicated. And while normally a K1 is about 6 months faster, due to current slow downs at USCIS specifically on K1 cases, now both are experiencing the same average processing times submission to visa of around a year and a half

    Good morning Mr. Whal, just wondering. In my I-797 notice of action letter they misspelled my fiancée middle name. Would it matter if it gets corrected or not? I submitted a typographical error form to USCIS and they replied back saying since it’s been approved it is on NVC. I’m just curious if like stated before if it matters if corrected or not.     Please overlook my weird username. I have commented on these videos before but it has been a while. I have a friend who is currently involved in the k1 visa process so I am attempting to get some information for him if possible. To be brief, his Filipina fiancee had her k1 visa interview back in April 7th earlier this year. She did pass the interview but they requested that she get an updated nbi and police clearance. She did get both items and then turned them in with her passport. Again this was back in early April. He has been checking the status of her visa and like many others, it currently is saying refused on the ceac website but he knows what that means. He was under the impression that she would be issued her visa within 3 weeks at the most but that isn't the case. It has been a month now. Once again I am trying to find some answers for him because he deserves happiness along with his fiancée. But I am trying to find out what is taking the consulate so long to process this stuff. Are they really that far behind or what? I am wondering if anyone else is going through this or already has experienced this issue but now have their visa. I really want to help him but I don't know what to do or why it takes so long to issue a visa. I hope someone can let me know what is going on so I can relay any information to my friend.

      When applicants arrive at the consulate missing documents, their cases are put on administrative processing. Circling back later to complete such a case is a low priority for the consulate. It gets done eventually. Best way to speed things up is to be properly prepared or have proper guidance at the get go so that such rooky mistakes and the delays they cause are avoided.

      While there is an official limit of allowing a US citizen to apply for a fiance visa no more than twice in a lifetime. There is no limitation on how many times a foreign beneficiary can have US citizens apply for them.

      A foreign applicant can choose to be interviewed by the consulate that serves her country of birth, country of citizenship or country of lawful residence. So as a lawful resident of Arab Emirates she could choose to have her interview and get her visa from the US Consulate in Abu Dhabi.

      You said "spouse" and "fiance". It's one or the other. If applying for fiance visa the children under 21 years old can be included with the fiance visa. If applying for spouse visa, the children who were under 18 on the day of the wedding can be applied for separately as stepchildren of the USA spouse.

    Hi Sir,
    Good day! Just a quick query regard on our case. We're planning to apply a visa for me to get in USA. My spouse and I got married online last January this year and we haven't processed the ROM yet or any other documents. We met once last February, are we still qualified for a K1 Visa or we should apply for the CR1 Visa instead? Is it required to process the ROM first before applying for CR1? We're stuck in a limbo on what to do next and we'll really appreciate your help.

      As you are married your are ONLY eligible to apply for spouse visa. Your spouse needs to meet with you in-person before submitting your application. The ROM is not needed with your original application.

      The American sponsor can apply for both his/her fiancee and fiancee's child. The parent gets a K1 visa. The child a k2 visa.

      The review process, and the skepticism on all "romance" type visas (K1, CR1, IR1, K3) are equally difficult (or easy) for approval

      Meeting in third country meets the in-person eligibility requirement. Meeting in your partners country, and meeting her/his family friends at the same time also meets the in-person requirement, while at the same time adding evidence of the bona fides of your relationship.

      Interesting. Did she just get out of prison? Does she owe child support? To be able to join you in the USA she will need a passport. The process to apply for a fiance visa is taking about 18 months. She only needs to have a valid passport on the day of the interview. So unless on probation, etc, she has plenty of time to apply for and receive a passport.
