This is all the work of lawyers, getting the AFL to demonstrate that they are taking all possible measures to prevent concussions, so that 10yrs down the track today's players will have no recourse for law suits. This is a world-wide phenomenon that will eventually lead to the end of all professional contact sports.

Im very sceptical of this actually. There have been cases where players have tried to sue the sports governing body for injuries suffered games and none of them have been succesful. Thirty years ago an ex Italian soccer player with dementia tried to sue the Seria A (well his daughter did ) for his condition. Something to do with heading a wet ball over a twenty year career. Cant remember exactly what was involved but the Italian courts threw it out nonetheless. I dont think there has been a successful case anywhere in the world actually. When you choose to play sport, you accept the potential risks.. the only exception is when you are the victim of violent assault etc which is deemed outside the rules laid out. Somebody tried to sue Roy Keane from Man United for a dirty tackle if I remember correctly. He didnt have a prayer suing the club or the FA, but he did have a case to sue the player who had injured him through a very dirty tackle.

AFL players get paid big $$$ if they’re any good. They shouldn’t need to work another day in their lives after footy if they’re smart with their money.
So get out with that. They step out on that field with the intention of being the best and making big $$$. It’s why they’re there.
You can’t whinge that you were never quite good enough and so didn’t make the big $$$ and now you’ve got concussion issues. The individual still chooses the path they took to play AFL. Nobody forces them, they knew the risks, they decided to have a go anyway.
Maybe it should be expected that players actually take some personal accountability. They choose to have a crack at AFL, whether they succeed or fail, get injured or are unscathed. They know what they’re getting into.

This should be the final rule change:
Every player should sign a contract that they understand they might receive head high contact/concussion. By signing this its make them unable to sue the afl down the track if this may occur and they accept all liability as it's a contact sport amd these things happen.
If they don't want to sign then don't play

I am a safety professional and it's a well-known established understanding that you can't punish people into being safer. Taking concussion out of the game is admirable but it will never be achieved through fines and punishments. The health and safety laws that people mention when talking about concussion and players "workplaces" does not require all risk to be zero. Risk is a part of work (and life) and the requirement of the WHS law is to lower the risk as far as reasonably practicable. That's what the AFL will have tested in these court cases. Did the AFL do what would be considered reasonable to manage the risk to concussion related injuries? If work had to be without risk, then we wouldn't have police, firefighters, and a lot of other professions. There will always be different opinions on the acceptable level of risk, and the courts will decide. At the end of the day if you have a system of work that requires 100% of the workers to get things 100% right 100% of the time, your system will fail. I think the AFL has to settle on its risk appetite within the game rules and stand by it. Risk will rarely every be a zero-sum game and while it's admirable to try and achieve zero harm it's not a realistic quantifiable goal in many occupations, including contact sports.

Patrick Dangerfield did the same thing as Toby Bedford, Dangerfield got nothing, Bedford gets 3 weeks? Typical Geelong players being protected by the AFL. I don’t care if the outcome of the player being tackled is different it’s the exact same motion.

Joel Selwood and Dangerfield were/are endangered species in the eyes of the AFL. Nobody can touch them, but they can do as they please to someone else.

Afl players get 10 times the average salary. They benefit from this their whole playing career.
Once they stop playing and start looking for a job that pays 60k a year, like most people live on, they
figure I'll sue the Afl. If you don't want to get injuries in a contact sport, then don't play it.

  • @BovineJustice

This is all theatre and the whole AFL stance around concussion is posturing to try and reduce liability. There's two real simple questions you can ask to determine how serious the AFL really is.
    1) Is protection of the head and prevention of concussion in the AFL the utmost priority? In the AFL is the head "sacrosanct"? True/False?
    2) Do helmets/headgear help mitigate damage to the head and reduce head injuries, True/False?
If both answers are TRUE, then helmets would be mandatory in the AFL. Yet helmets are NOT mandatory in the AFL. So which statement is false?
    Ask the AFL.
Edit: Further to this, why have we seen basically zero innovation in the design of protective headwear in the AFL? When Phil Hughes got hit, immediately the helmet design was changed specifically to prevent that injury from ever happening again. Maybe the AFL will figure out the image of the game or players isn't worth as much as the 100s of millions, maybe billions it'll have to start dishing out in lawsuits in the future.

I don’t understand how players can sue the afl in a contact sport for incidental concussions. Unless there’s some negligence on looking after the players mid game after a concussion (even though players would lie to get back on the ground) how can they possibly have a case. To that point the afl is now trying to doctor the rules, destroying the game to keep as browny said and rightfully so the concussion campaigners happy. This sport is becoming an absolute debacle.

So only a miraculous standing grapple will do.
This leads to more chance of one of those great drop-ball “disposals” is more likely.
Or even better, the new throw-pass to a hovering team mate.
The AFL has to stop its delusions.
Neither of those acts had malice or intent, nor negligence.
    Footy is hard to watch.

It's time for people in the AFL community to call out Laura Kane and the rest of the wokie crew in charge at the AFL. How much longer will we let these people ruin our game. Let people sue the AFL, you don't need to change the fabric of the game, let them take it to court.

Players are getting hurt because they are CHOOSING to take possession and try and BREAK the tackle whereas twenty years ago they would either knock it on to advantage or dispose of it instantly as soon as it hits the fingers. I mean, its a contact sport, dont want to get KO'd? Dont get Caught with the ball!! This is the unintended consequence of umpires refusing to apply the RULES of holding the ball and deciding on their own to turn our game into rugby. Every single one of these guys who has been hurt only has himself to blame. The players duty of care is to THEMSELVES first and foremost.. so if you dont want end up in an MRI machine on Monday morning, DONT GET CAUGHT WITH THE PILL!!

The AFL are eliminating litigation responsibilities from them to whoever is the tackler. If someone in 10 years wants to make a claim they will have to identify the individual who tackled them and caused the head trauma, not the AFL.

IF U KNOW THE GAME, U KNOW THE RISKS. ALL PLAYERS SHOULD SIGN A CONSENT CONTRACT PRIOR TO PLAYING UNDERSTANDING YOU MAY GET CONCUSSED IN A CONTACT F...N SPORT. THE GAME WILL END UP TOUCH FOOTY.THIS IS BECAUSE EX PLAYERS ARE TAKING THE AFL TO COURT LEFT RIGHT AND CENTRE.
