He is the managing agent for the owner of the building. In this case, the 330 million citizens of the United States of America are the owners. Donald Trump (or any President) was just the managing agent on January 6, 2021. It is alleged that he conspired to defraud the owners of the building. Of course, that has to be proven beyond a reasonable doubt to a jury in a court of law.
