It costs about $350 to get a trade mark application (no you don't need a lawyer to do this) for one category in the USA. An international TM in a bunch of categories would prob be $1000. If you are running a business, run a business.
Trademarking probably wouldn't have changed the outcome. All it does is give you the right (or at least make it easier) to sue. The owner could have trademarked after finding out someone was about to take her name, but she'd then have to sue Jacklyn to stop her from using the name. That would have cost her a lot of time, effort, and money that she didn't want to have to spend. If you know that a trademark owner isn't going to sue, there are basically no consequences to using that trademark yourself.

We sicced the lawyers on them and apparently, no dice. They were still around a few years later, same name and logo. I don't get how it's possible - and we were the ones with the money in that case.

So my boyfriend has owned a business for almost 20 years. He’s had a similar thing happen to him but with a color. Yes, a color. He got a letter from a lawyer to stop selling his product that he created in the color it was as someone had trademarked the color blue. He had to completely scrap all sorts of products and go back and change the color of further production. He didn’t even know you could trademark the color blue. Anyway he learned a valuable lesson as a business owner and he checked and trademarked his new company name for his second business immediately, having learned about trademarks. It’s a dog eat dog world out there and if you don’t watch your back, no one else will. Unfortunately.

I really don't know if Jacklyn thinks she is pulling a big brain move by ignoring everything, or if she is actually delusional. I know for some creators ignoring drama has done wonders for them, but Jacklyn is just a personification of bad business. She possibly can't think she hasn't done anything wrong, but her silence says otherwise.

This really REALLY bothers me, as a Canadian. I work in a law firm and when you search for names, you can search them Nationally and Internationally. I also wonder how much it cost to manufacture the items in Jaclyn’s Koze. After seeing the low amount it cost to make the products for JH Cosmetics, and then how much they marked them up to sell them, I wouldn’t be shocked if these Koze items were low cost to make and are being marked wayyy up and sold for way more than they’re worth.
