    A lot of these GOP senators are not impartial, they've already made up their minds.
    IF a normal juror doodled or pretended to read during the prosecutors opening statement, the judge would kick their ass out.

      I think they'll discover that voting for an acquittal will be more damaging in the long run. How many red hats actually will support someone like Rubio who used to hate Trump and not bows to him?
      Consider the fact that both of the GOP senators in Georgia loudly supported Trump and they both lost. Many political analysts have figured out that when Trump's not on the ballot the GOP doesn't do well. To be fair, they did make gains in the house in 2020, but didn't take the majority.

      Who cares about that? The biggest worry for me is that the Senators are the jury in a trial. What other trial can any of us speak of where the jurors are allowed to openly speak about the case legally? What other trial could the jurors go on national television and give their opinions about an ongoing trial?
      A lot of changed need to be made in the legal code and some new amendments need to be made.

      That's what you get when your foolish client doesn't agree to your defense strategy. From the sound of it, he was entirely uncooperative with his somewhat better options a couple weeks ago, and so now he's down to these clowns who are likely working for free and about to lose any credibility they may have ever had. They are at trial with next to no prep time, and he's the sort to fire them in another day or two just for fun. What a bargain for these guys to make- another great Trumpian deal. 🙄

      I haven't watched this proceedings but I did watch the House inquiry. Hands down the witnesses and attorney Daniel Goldman stated clearly that Trump was in the wrong to use coercion in holding up funds to Ukraine in an attempt to discredit Biden. He got off because of the dying loyalty of Republicans who would rather think about their meal ticket than justice. This is the sequel.

      It was expected that the GOP would close ranks and there would not be enough votes to convict and remove. And that is what happened. The obvious incompetence of 45's defense team only underscores how useless the impeachment process is. No matter the charges, evidence, or defense, the process is intrinsically flawed because requires a significant number of the impeached's own party to risk their own poltical ambitions and vote with the opposing side.

But even if the defense had made legitimate and compelling arguments, the impeachment process is still flawed and does not work because it was not designed to work with a polarized, two-party system. The Founders were not fans of political parties and purposely didn't design a system that accommodates them. With two distinct parties, there is no possibility of "unbiased jurors," and conviction requires a significant share of the accused's own party to stand with the opposing party. Even when it's warranted and senators rightfully do so, it comes at great risk. We're already seeing the GOP's efforts of retaliation against its own members. 😔 #broken

      I'm not sure how closely you've been following this but Pelosi is absolutely correct about McConnell's underhandedness here. When the House impeached 45, the Senate was no longer in session and was not scheduled to return until the day before Inauguration. McConnell refused to call an emergency session to hold the trial and he was the one who suggested that mid-February would be appropriate. For him to then call out the House in his speech saying "the House didn't send over the papers," after he said not to bother because no one would be there - that's nothing but classic Mitch.
      Polls show that the majority of Republican voters still support Trump. Only 20% blame him for the Jan 6th Insurrection and 70% say they would not vote to re-elect a senator that votes to convict him. We never expected to have enough votes to convict and this proves we were correct.
      The Trump faction of the GOP is not some extremists offshoot - it's the majority. However, the GOP cannot win with just Trump voters alone. They need to hold onto the moderate "real Republicans" in order to win. This is why the GOP voted to stand by both Greene and Cheney during the same week - despite the fact they represent two opposing ideologies.
      McConnell made the same choice in his decision to acquit in the trial but powerfully condemn Trump in his speech afterward. Republicans can feel like Trump's been held to account and the Trumplicans, although annoyed by McConnell's words, can continue to tolerate McConnell since he did not vote to convict. McConnell leaning into the ridiculous constitutionality defense was nothing but a cop-out.
      In both the House and the Senate, this was the most bipartisan Impeachment in history. The evidence connecting Trump to the Insurrection is incontrovertible. As far as the House Managers - their presentations were impeccable. Even if you watched the attack unfold on live tv, this was the first time the entire assault was made evident in chronological order.
      There will be an independent investigation, which will likely take a year if not two (9/11 Commission released their report in 2004) and it may very well reveal inside actors - and if it does, they will be adjudicated by the DOJ in a criminal trial.
      An impeachment trial in the Senate is not a criminal trial.
      It is not a legal proceeding.
      It is a political proceeding.
      And politics, especially these days, is mostly theater. The presentation by the HMs was just as much for the American people as it was for the senators pretending to be "impartial jurors." We expected to get 4 GOP votes for conviction - getting 7 *is* a win. There is no requirement or expectation of burden of proof beyond a reasonable doubt. It is why the Defense's free speech and due process arguments were invalid. Criminal convictions result in incarceration. Impeachment convictions are simply a loss of employment. Lesser punishment = lesser standard of proof.
      Leader McConnell made it perfectly clear that Trump is wholly responsible for the Jan 6th attack on the US Captiol. Every Democrat in the House and Senate agrees. Several Republicans in the House and Senate agree. Some Republican governors agree. National security experts agree. The majority of the American people agree.
      You have every right to be angry about the assault on our democracy and the abhorrent absence of accountability - but channel that anger where it's deserved: the former president, his dumpster fire of a party that enabled and defended him for years, the alt-reality fake news ecosystem that has defended and repeated every one of his lies for four years, and finally at the Founders, who designed a system incompatible with poltical parties - especially when there are only two.
      Jefferson said we should draft a new Constitution every 19 years because what might have worked then might not work in the future. He was right.

Even these layers finally have been found to take the case do not think their client is innocent, they think he is guilty and are disgusted. The republican senators are useless as judges against their own partner. A judge should not have any connection to the accused. This is nonsense.       To be fair, yesterday's arguments and vote were just deciding whether or not the trial was even constitutional. Which it obviously is since not holding it would explicitly impose that so-called "January exception" (actually a "November, December and January exception" due to the fact that the Senate majority leader could always just delay such an action until after January 20th, as Mitch did. He'd probably get a lot more flak for delaying by two months than he did for delaying by a week, but I'm pretty sure nothing could actually stop him from just letting it rot on his desk like everything else he's been given over the past 6 years, if he was willing to dodge the media for that long).
      I must admit I'm morbidly curious what they're going to pull out to fill 16 hours worth of defense arguments for the real trial (which started today with the House managers first 8 hours - I'm sure Seth will humorize it for us in tomorrow's Closer Look :D). Whether they'll actually try to mount a real defense or if they're just going to waste more time on diatribes about Greece and Rome that probably aren't even true and just trust that the Republican senators are going to acquit regardless. I mean they're probably aware that Trump won't pay them anyway so they likely aren't going to spend _too_ much time preparing.

      No, because it’s not an actual court of law. Otherwise none of them could be jurors since they are all witnesses/victims. The judge that presides is merely there to keep order and rule on actual legal questions. An impeachment trial is not a criminal trial. He can be charged under criminal law later but the goal of an impeachment trial is to remove a public figure from office because they present a threat with the power of that office. Also it allows for other consequences like preventing him from holding any office again, taking his presidential pension, removing secret service protection, preventing any access to sensitive information, etc.

      Some lawyer's know what they're doing, he makes me wonder what is the strategy behind a lawyer acting like that, I'm pretty sure they got something in hands but they're waiting for the right moment.
