Hi my name is Alyssa. I don’t where to start with my case. I use to have a substance abuse problem over 2yr are ago. I’m still fighting to get my kids back from this woman that told the court she is my auntie and we are not related at all. The court thinks she has both of my children which she suppose to have but my daughter is not living with her. My daughter tells me she is being mistreated and it’s stressful that I can’t do anything about it. I need help. When I decided that I wanted to make a change to better myself than my kids got took from me by this woman. I had to call the police to go get my kids because I had custody at the time. The very next day after I went to grab my kids while I was staying in a rehab for woman and children my judge at the time told me to go get my kids and go straight to this place. Which I did but not with my kids because this woman lied about where my kids were.
Hello Ms. Hernandez, I am trying to reach out to you because I have a very unique case going on right now. Someone who is not related to me or my children was helping me with my kids because I was in a very bad situation where one of my kids' non parental family members have been trying to take my daughter from me since she was born. This woman, who was a friend that I knew because I dated her brother, offered to help me with the kids until we could move and go somewhere safe. 5 days before I moved out of the old apartment and 9 days before I signed the lease to my new apartment, she took my children to a judge, made a bunch of false accusations against me that I can prove without a doubt we're all lies, and was able to convince this judge to just give her emergency temporary custody of my children. He didn't call me in , no one notified me me of what was going on, this judge just straight up took my parental rights and gave this woman custody of my children based off of a bunch of pretty severe lies that she accused me of. Since she has done that, I have not been able to do much as even hear my children's voices. She won't let me see them or talk to them and she has denied my sister and under age nieces to talk to my children, as well as my mother. Since they know that I can prove everything they said we're all lies, they have been now coercing my oldest daughter to lie about me and say that I beat her little sister down when she was only two years old for using the bathroom on herself. I won't even spank my children, let alone beat them down. Anyway, this thing is getting real ugly. This woman has access to a lot of money and can afford a lawyer. I am a single, low income mother who can't afford a lawyer. I have to represent myself in court and have no clue what I'm doing. I'm trying to reach out for help. Is there anyway you can contact me? I have to be in court on February 7, 2023. I need some advice, I need to tell my story and get some solid advice for court. This woman kidnapped my children and is seemingly getting away with it so far. I need my babies back home with me. I don't drink, I don't do drugs, I don't go out running the roads and partying. I literally stay home, work and take care of responsibilities. I'm the only parent in my kids' lives, their fathers abandoned them. I'm dealing with a total nightmare. I'm an awesome dad and everyone in my community says so. The mother is 20 miles away. She has been continually trying to color me as a bad parent, and gaslighting, abusing court process by self verifying her opinion into "facts" through a toxic and aggressive attorney. Now the situation has run off the rails. She obtained a court order to have a psych eval without ANY facts to substantiate, just biased "concerns". Her attorney hand picked the evaluator and I have solid suspicion that there is something really scary going on here, as this psychologist is unprofessional and asks for an impossible level of fees way beyond the scope of the evaluation. I have found that when I attend hearings, I am ignored because I'm not a lawyer. I feel terrorized and traumatized by this. No matter what I do, the mother decided what her long term goals are and they are to eliminated me from the picture. I'm the better parent, but I can't prove it. The frustration is beyond anything imaginable. None of the factors up there apply, other than the extremely subjective opinion of one person and her lawyer that I'm "mentally ill" Gaslighting at it's most heinous.
have an attorney defend you just as aggressively. but it's gonna be pricey, for both of you. have multiple psyche evaluations not just the court ordered one under your belt, and document the results. documentation is your best friend. from her text messages, voice-mails, etc
I’m in the same boat 9k in and it’s only one month in and he is the one who needs the psych eval!! This system is broken. My child is so confused it can cause him mental problems later!!
As much as this stinks to hear, your children's well being and care has no monetary value and you should consider that when deciding to hire counsel. I pray that you find an amicable solution. Best of luck.
@@alexdevlin1082 I just finished trial. All of my evidence was objected to and not entered even though there were government documents, not hearsay. I talked to 36 attorneys before this and no one would take my case, even with ability to pay. This trial was like trench warfare. I did OK though. I had a few good witnesses and I grilled the hired gun psychologist who seemed to have memory loss. She admitted to having bias. She didn't give a lamb warning. Her testimony was still admitted with a very passive judge that allowed far too much and is a known abuser of discretion. I have solid appeal merit. Commonwealth v. Lamb is very clear language. I don't understand how she can get away with this. But I got away with some things too. Waiting to find out, but I won't lose my parenting time.
If you are the better parent, you should be able to prove that. Why don't you behave an attorney? That's so important. You should be able to prove her unfit if she is. Narcissist are evil people but you should be able to find an attorney that has experience with that who can help you.
Proof and evidence is so difficult especially for emotional abuse. I’ve seen it all but courts just don’t listen unless a third party saw it happen and even then.. it’s really wild what courts turn their noses up to 😢…
Exactly. Then even if you have documentation trying to get it submitted to the court or getting anyone to look at it is like pulling teeth.
Especially in child sexual abuse. Courts ignore everything... Abusers fet off free...
Lack of communication & wanting to see the child is a big factor.
This one is easy. Are you a father? Strap in, there’s an 80% or greater chance that Mom will make the argument that you’re unfit. And the court will believe her without a second thought.

I love AA, its not for everyone but you meet some great people. I started uploading stuff on my tiktok, i also spoke to a commissioner as well. I was diaged with PTSD, i have my first phyc appointment for DV and SA for the first time. I have taken 3 DSM-5 and she hasnt taken a single one. I havent seen my children in almost 3 months, I havent heald them in my arms for about 4 months. She has never properly co parented with me. All im saying is I am a proud advocate of abolishing parental alienation, custodial interference and malicious parenting syndrome.
I didn't understand what domestic violence was till my therepist explained it to me. After she did then I realized I am domestica violence and sexual assault warrior. I also have been reproductively abused on three different occasions. It's been a road but my ex abuser my have my children but I am free from the abuse.

I had to reply on my backup channel because I don't want to take the risk of my child's mother knowing I posted publicly about her. However, I was able to temporary get a judge to declare her unfit because of a mental health issue, however she has hired an attorney, she is working towards the issue and she is going to get supervision on visits soon, my main issue is the fact that I believe she is a covert narcissist and her abusive mental behavior towards me will never stop, I never want to relinquish the control I have with the child for the time being

My soon to be ex husband was verbally and emotionally abusive to me and his oldest child that lived with us but is not biologically mine. I have proof of it and also of how it affected his child and the other children in the home by witnessing it. We have one child (toddler) together but I'm hearing that because the abuse wasn't toward OUR child, it doesn't matter. Our toddler witnessed it all. It drives me crazy
I can relate to you . I'm sorry for what the children went through. I think this video really highlights the court process and look towards the matter. The hardest thing I had to do was to not react or to be silent after being silenced so long during the relationship. Hang in there and stay calm . Be patient. Wendy's videos helped me see how to navigate through this high conflict case and go from 3 year alienated, to soul custody and deshion makeing and yet the battle is far from over . I have trama that he plays on , and 3 children that are even more so . Find some peace for you and the kiddos and stay in the moment with them . Meet the Chaos with your calm . The children will Discern for themselves in time.
Mesa Az. Mother has no addictions not even a drinker, no abuse, no domestic violence, yet I seem to have no rights, for asking for more than $100 in child support caring for child 85% of the time and to not let a non blood relative who showered with my child around him and According to forensic interview, did dispicable things to him. Yet is now his full time caregiver who testified paid off my exs house truck and lawyer. Most disgusting my son is suffering.
Isn't the burden of proof on the accuser? So if one parent is accusing the other if using drugs, should the accused parent ignore it since it's not true?

This is the 3rd time going through cps, he behaves while under investigation but as soon as he’s cleared, it’s back to homeless, neglect, man nutrition, lack of education on our 5 year old, arrested for stolen cars, meth problems. So freaking frustrating. Raging narcissist that tries to twist the story!
The father of my kids has just recently got diognosed with suicidial bypolar disorder and he is not seeing anyone for it.
My daughter goes to court Wednesday. Her ex~ husband is trying to get my daughter for contempt of court because he doesn't get my granddaughter based on what the original court order said back in 2019. My granddaughter has come home from her dads eaten up with bedbug bites, headlice, talking about roaches getting in her food, and most recent she said that while she was there for Thanksgiving a rat jumped from the cabinet and poppy ( her grandpa) beat it to death with a broom and all the rat blood scared her.
It would be awesome for my granddaughter to enjoy both her parents. I think he suffers from a depression of some sort because i dont know why anyone would live like this. I know he loves his daughter and she loves him. He just doesnt have the mindset to clean his house. Have you ever dealt with a situation like this?

The other parent is unfit and honestly he has been falsely accusing me and terrorizing my life for 5 years not only that I've got 3 years clean and I've done amazing things with my life I am not worried about court so much as I am worried about standing up for myself to be honest because this will be the 1st time I've honestly sit up for myself and bend righteous in myself at the same time I also don't want him to lose parenting time as long as There are sustainable actions put in place to better his alcoholism he has been lying on my name and he just got A dui. My ex has been held in contempt for violating a no contact order two times, he has had his visitation suspended for testing positive for illicit drugs, he has two seperate founded cases of neglect on our two children and one case of founded dangerous substances around our children. Hes an absolute nightmare and thinks im going to be thrown in jail for contempt and is solely focused on that only. Taking him back to court

In my opinion, it should be very rare that ANY parent cannot see their children.
Even if the parent is a drug and alcohol addict, make some time to see them with a police officer nearby, or some safe place.
Children can learn, too, from addicts.
Three major things have happened since our separation, first thing: my soon to be ex switched our son’s primary pediatrician to another doctor before our agreed temporary order. This caused our son to missed three vaccinations at six-month wellness. But his primary pedestrian caught it and gave him the missed vaccinations when I took our son back to the original pediatrician after the temporary order. Second thing: She did not give our son's antibiotics to me when he was with me. This happened with two of his antibiotic courses. Each time, the course was for 14 days, but the three days he was with me, she never gave me the antibiotics and never told me about them. And the third things: when she took him to the doctor for breathing problem, she did not buy the prescribed breathing treatment until three days later. After she bought it, she never gave it to me. Please let me know if I can use this and how I can use this toward the best interest factors. Thanks.

What if the mental health issues are causation of emotional abuse from the relationship partner who is accusing me of being unfit? I have always struggled on and off with depression and anxiety, but it did not hit a breaking point until after enduring years of emotional and verbal abuse and emotional neglect. I’m on anti depressants and I have been seeing a therapist once a week for 5 months now and she has specifically diagnosed me with CPTSD caused by my situation. Emotional abuse is very hard to prove. Also, the emotional abuse and psychological torture I’ve endured has led to me also acting out of character. He would push me and push me until I snap and then pull his phone out to record me. I’m worried because of that. He of course didn’t record him abusing me, just my reactions.
High conflict ex has moved out of state (2000 miles away) 3 times since June '19, ex recently moved again 9/9/21 without getting written agreement or notifying the courts, refuses to pay court ordered half for school costs, etc. Wanting to file for full custody with full legal custody. So my kids were taken away from me 2 years ago and I was in the hospital when they took my parental rights away I'm not sure what the grandmother has said about me but now I'm going to district 19 in prince George and in Petersburg va sometimes twice a week!! In my experience it was financial abuse, coercive control. My spouse assumed financial control by depositing and then cashing the account. Didn't have enough money for basic necessities, had to borrow money from parents. Gave me conditions and terms to abide by otherwise would put in 30-day notice on rental and threaten to get attorney. Received notice of possibly being evicted with kids. As far as the evidence, I would assume it's all in the statements. Spouse did not care about leaving us homeless. Couple weeks later they quit their salary position and responded on the DV/TRO as being only commissioned based. You tell me if this would be considered an unfit parent?
What if the other parents on supervised visits per mediation agreement BUT the grandparent that agreed to host the visits refuses to do them now. And the mediation still hasn’t been signed by a judge yet just the two parties.
Ask to rest it with someone else or have visitation at the office that holds it(at least with the office it's recorded so if denied visitation is happening yu have leverage

My in laws (my daughters great grand parents) have threatened custody because they want my daughters survivors benefits, and they have harassed me out of my job, and threaten custody just to be bullies. I've filed a lawsuit but they threatened because "I don't watch her"---no idea what they mean. And then they use little, I mean little, bullshit ways (even saying that my daughter drawing on the wall and floor with crayons). I mean, little things. They even admitted to saying they will lie about things to their advantage. I mean, I know they are insane and even are making up mental illness I don't have. I was told to not worry so much. But this isn't good for my daughter.

Nope. We are the very fit grandparents who got temporary custody, full custody and then adopted our grandson. We won temp custody just after his birth. It took 8 years leading up to adoption. He is now 17 and Senior year next year. Thriving in all regards. He is the very song in our hearts. God sees great things in this young man and so do we !!

I do have a question… I’m the stepmother here. The CP stopped letting the NCP have his visitation rights about 9 and a half months ago after falsely reporting the 3rd CPS case in 4 years. All cases have been listed as unable to determine. However, she tells authorities when NCP attempts to pick up children that he has a warrant and there’s still an active investigation. The claims have been, leaving marks on one children’s wrists and hitting him with a belt. She’s also attempted to file a domestic violence charge but it was acquitted by 12 man jury. She is pleads that the courts grant her sole custody in order to move out of state because NCP has a paper trail of domestic abuse. Will all of these be considered as domestic abuse to a judge typically? As I mentioned, all cases have been either acquitted or unable to determine. How does a judge feel about alienating children for the past 9.5 months when there is joint custody?
It depends on the judge wen it come to the dismissal of allegation on one who was charged. With the Parental Alienation y'all should get a lawyer to enforce visitation and find her in contempt of denied visitation! Call police each time requesting is denied so it's documented. So I have no domestic violence charges I have a pretty clean record I had one wet and reckless I finished my classes that I needed to for that. I’ve been clean for two years. I’ve just been able to get my son to be able to come to school with me Monday through Friday and me and his mom had a mutual agreement that he would be picked up on Fridays at 4 PM and dropped off on Sundays. She couldn’t make it on Friday and got mad and said that she wanted to switch schools all of the sudden but most of his life he has lived with me now all the sudden she wants him to live with her I feel like she’s unfit but I have no exact proof. The only thing that I have is that he has been with me I’ll take it all his doctors appointments take them to school and everything. How would I win in this situation and how would I file I don’t want full custody I just want a mutual agreement that she will stand on to come get her son when she is supposed to get him, and it’s just so frustrating when I have been the best father that I can be I have a father and sodas, my father, and we all have a strong position in all of our kids lives. Document everything. Put together a schedule you would like to keep to suggest to the judge. It's not true that women always get the children. My ex got 49% parenting time because he lied to his lawyers and had more money for an aggressive attorney. Hire an aggressive attorney, dig your heels in and fight.

In my case my abuser was physically and emotionallu abusing my older child (3 at the time) from a previous relationship, but did everything to me except hit me until the day I ran. He was convicted of the assault, but because none of the other forms left proof and because I couldn't prove my older child's bruises were caused by my ex that all was ignored and my ex got joint legal custody and every weekend visitation with our child together where he continued to emotionally and mentally abuse our child. It still gets ignored for lack of proof, never mind the fact that our child is now of an age to be very vocal about the abuse and has been in the hospital and counseling for self harming behaviors they adopted as a coping mechanism to deal with the abuse.

@@Commandthecourtroom Our child is 17 now and we're in the middle of our (hopefully likely) final legal battle with our abuser. As soon as they are 18 and so much of our time isn't being taken up by our personal battle we intend on adding our voices to that fight for reform.

Will a judge take into consideration the fact that the Mother has already lost custody of a child because she put the child in danger? I am now going for custody of my 8 year old granddaughter and my son (the Father) has signed off on this stating he is unable to care for her. The Mother lost custody of her first child because of the same issues I am bringing into court. There is severe instability and the child has been exposed to multiple men the Mother moves in with to be supported. She refuses to work or do anything to become more self sufficient. My granddaughter is now failing 2nd grade and often lives in filth.

I would mention that you both should be doing tests for the court. As well as counseling and drug abuse evaluation. Be proactive without being accusatory. That makes you look bitter. Be willing to do whatever you ask him to do, even if you don’t need it. Even playing field.

You can get a digital recorder and record all interactions. Document specifically what happened and when. You really have to be your own attorney/paralegal.

You need to get some help with your situation from a knowledgeable person or source. Don’t go into any parenting plan because you are in fear. Reach out to the court and see what resources they have to get you no cost legal assistance. There are resources. Start with the courts website or google for low income legal assistance.

One of the factors listed (that applies in AZ) is "whether one parent intentionally mislead the court to obtain an advantage in a child custody proceeding". how about when a court allows a sister to basically steal her brothers little girl, and adopt her without his consent, banning him from seeing her for 6 years! [how shes got power over the courts we have no idea] because his now x wife was abusing her? how about when this same sister now refuses to let her own mother see her granddaughter anymore, for an unknown reason? I’ve been accused by my ex wife of physical abuse and now also sexual abuse of my 3 year old daughter. My situation is horrific because of the amount of deception and lies involved. I have an ex girlfriend who has mental health issues. She was abused sexually as a toddler, and she became a prostitute while we were together. To avoid uncomfortable conversations she starts arguments and throws temper tantrums to draw in attention. She has accused me of domestic battery and criminal confinement for the second time. The sheriff's department kicked in my front door and drug me out of my house at 730AM on August 4th 2022 with just myself and my son inside the house. This has since left me in a depressed state and I have even been lied about by DCS and loads of false information is everywhere. The public service workers in Madison County Indiana are mentally unstable and even the judges conduct themselves in a less than rational and mature way. It's all sickening to me at the cost of my sons well being. My son has been staying with my mom and brother for 9 months. The court has ruled that I am a danger to my son, and thats not true. I won custody of my son and have taken care of him as a single father for the first 9 years of his life literally by myself. Everyone says get a lawyer and I have tried to do everything. How do you prove years of subtle/sneaky emotional abuse by a covert narcissist (undiagnosed, of course) so that the judge will seriously consider limiting the need for future interactions such as required in shared legal custody?
Document everything. If there are texts at different points in time contradicting the original, and yet they maintain that's what they've always said - that's gaslighting. Derogatory comments, name-calling, swearing, threats or intimidation tactics are all forms of emotional abuse. Evidence of them being hyper-critical: your ex having an inflated reaction to something trivial like not bringing your child's play equipment back undercovers before it rains. Threatening to call police or cause you to drain your finances fighting their allegations via the justice system are considered administrative abuse - of course, that's up to the discernment of a court how reasonable that response is. Anything that establishes a pattern over a period of time is helpful because it shows that these are not one-off occurrences.
Texts, emails, Facebook posts/messages, photos, videos. Voice recordings might help you to recall things that were said, but unless in the recording the other party gives their express consent to it being recorded, it's very possibly in breach of the surveillance laws. There are apps you can download that record your phone conversations, and if you ensure that you are making them aware that you're recording then it may be eligible to be used as evidence but get your lawyer's opinion first.
Guilt tripping and putting words in your mouth can be evidence of manipulation also. For example, if you have expressed your feelings about a situation and they turn around and say that you're placing blame on them for the situation.
Google some of the signs of emotional abuse and see if you can recall any instances where it may be relevant to you, then find corroborating communications that verify the incident if you can.
It could also be, in sabotaging your relationships. Perhaps you have plans with your family and they are aware, and as you go to meet them they call/message asking you to come back because they need you. Particularly if this happened multiple times.

Collect all your evidence in a binder. Take screen shots of the text feeds. Do not have conservations with her and if you do, record them on a digital recorder. Document copies of daycare payment receipts. Gather people to testify on your behalf of your parenting skills. Basically have to lawyer up and work on your own case. Use her social media to show whether she's fit or not as a mother

They could tell her intentions was not good and she's unable to be cordial. Yeah I think she had custody because I failed to respond I filed for custody because she left the house with all three of the kids and wouldn't let me see or speak to him over the phone and I went and filed for custody and then she send over one of my kids filed for custody back in 2019 - late 2018 so she sent over my son and I told her basically that if she wanted them back we have to go to court and if the judge told me to return to her I would but she didn't let me talk to the kids or anything so she responded to my file for custody and when she responded to her she came back to live with me and like under the pretense that we were we were going to work things out and I started getting Bill child support then it was three months after that early 2019 that I like she was living with me not paying bills not paying anything and getting help from the state still not helping with the bills and I would like watch the kids there was a wild when she was working and she still wasn't helping out I would watch the kids and she lied about all of that on the court paperwork saying that he's been 70-something percent of the time with the kids and I spend 15% of the time of the kids and just lighting a lot of things on the response she was awarded physical and shared decision-making we had but like I never proceeded to the court first of all for the reason that I know that the quarter side with the women and I feel like I was better off just having my kid with me even though she was receiving money for him and I was being charged child support for him for like 2 years still not in my child support that 40,000 and throughout the course of the last 2 years she's been back and forth she comes and leaves as she wants and has his men like I never really believed there would acknowledge that like emotional abuse and psychological abuse actually wear something real but now I've been getting more

Unfit parent? I’m in the middle of a divorce with a woman who is a Narc. We share parenting decisions. She is involved with a man who lives 3000 miles away from her and our son. Because I told her I won’t agree to her moving with OUR 10 year old son she is in a rage and threatening me with accusations that she is going to plead with the court to show that I am unfit because I am an older dad and can’t keep up with our 10 year olds activities.
