Adult Protective Services, Probate court + a wannabe Guardian try 'ordering' Evelyn

- [10/20/09] Once a person is a target of the Adult Protective Service (APS) the 'system' holds on for dear life, with or without the consent of the ones they are calling 'in need'. In fact, there are many cases on YOU-Tube of just this and guardianship abuse.
Evelyn had her own doctor evaluation, did great, and now they keep coming at her. He first wrote a hand written form, all was fine. Then when the wanna be guardian sent him an "expert Evaluation" form, it was ambiguous, and he then corrected it with another hand written letter stating all Evelyn "simply needed to do was keep her currant living arrangements, and she needed no guardian".
If anyone has any horror stories or ideas to make them back away, please post or leave your email - we are working at stopping this assault on a 93 yr old woman, Evelyn in Cleveland Ohio. There is no consent, yet the court sets an appointment for an UN-needed second evaluation (2 hrs long), what happened to peace in one's own home, having righteous courts need to prove jurisdiction and consent? She is innocent and they put her out to make her prove she is guilty?:( Of being incompetent as they think all older people are.)

Evelyn isn't in the 'system' yet - but they think they are on third base, and have made her a ward, unreal, and had a guardianship hearing, and over our objections, now the magistrate orders the DEC 3rd appt. with a Judge. Look up these type of nightmares on you-tube that have happened. Maybe some need APS and Probate, and guardians, but the ones who don't - whew, the 'system' fights dirty, tooth and nail to make it happen.
"Isolate, medicate, steal the estate" is a phrase commonly associated with the perpetration of Involuntary Redistribution of Assets (IRA) and the courts don't keep up with it, and they have a hand in permitting it to happen sometimes too. To do this to a woman who has no need, not wishing their involvement and insistent on making them go away, we now find her story is much like many others.

Thank you for that. I had called in a local agency (JASA) to try to procure help for my mother. Rather than doing anything for us, they reported us to Adult protective Services. In addition to dealing with my mother being sick and invalid, I had to deal with a group of rude, self important bureaucrats intent on making our lives as miserable as possible to justify their existence. A while later, I got a cal at work asking if they could send a psychologist over to evaluate my mother. I told them that she wasn't able to answer the door herself and I was at work and can't accommodate them. After my mother passed away, I came home to find one of them (Mr. Amos) left 5 rude, angry messages why I didn't get back to him immediately when he left a message on my answering machine. This is who APS is.
So it seems there are those who pray on the very young and the elderly! Very, very disturbing, sad and unacceptable!!!
All this stress is going to kill this beautiful person and her blood will be on their monstrous hands! No respect, she's lived a full happy life and now they do this to her. There has to be some organizations in Cleveland to help her.
When my mom was in the hospital they kept telling me that it was because of adult protective services that we couldn't talk to my mom on the phone or ask questions about her. The APS Sandra Roberts told me on the phone that she'd made a decision to validate Neglect charges about me then told me I still had to go to a meeting with her. She'd made her final decision and I still had to go to a meeting with her? At the meeting they didn't listen to my side of the story. They aggressively accused and put words in my mouth and tried to get me to say things I didn't want to say. I never got to see or talk to my mom again. She died after nearly two weeks in the hospital. When she was there the APS lady kept scaring me by saying they were going to do surgery on my mom right now and that I had to say Yes to surgery. I'd call the hospital and they'd say they weren't doing surgery. When I went to the APS meeting I had only two hours sleep and was weeping because my mom had died at 2:15 am. At that vulnerable moment the APS Sandra Roberts chooses to tell me, "I'm going to get you on homicide". I love my mom and cared for her, but APS wants to see what they want to. They don't care about families. The last two weeks of my mom's life they made sure that she never got to talk to her children again, on the phone or in person. My mom died not knowing why her children never took her home or talked to her again. APS wants to Convict at all cost. They don't care about your side of the story or if you really do love your mom. My advice to everyone is to never go into one of those meetings. The rooms are really interrogation rooms where they twist your words to try to make you guilty. Everything I said to defend myself they twisted into words they are going to use against me. It's better to remain silent.

this lady is alert, oriented and in control. maybe all she needs is a little help, a home health aid to come in and help out, a nurse ,every couple weeks to check on her needs.this is going to happen more often, as the population grows older, they will attempt to strip you of your assets, your dignity. they considers elders as a burden to society. shameful behavior to treat or elderly in this way.they should be revered and respected for their contributions to society

Yesterday (12-1-09) her attorney and a very close friend who came from out of state to see her were finally permitted to know her whereabouts (after isolation since 11-21-09) and go speak to her. Evelyn was estatic to see her dear friend and wept. I also hope she will keep her stance and stick to her motto:
"no consent" !!!!!
This seems like an absolute nightmare! We just had APS give us a visit last week from a disgruntled family member making a false report. Thank you for the warning about what can happen!

Being a former government official, I am not a favorite of more government. They always say if you want to kill an idea, send it to a committee. More and more bills is not the answer; maybe what we need is enforcement of the laws we already have. If government officials contribute to elderly abuse, then those officials need to be held accountable.

My case was elderly abuse at it's best. They actually ruled me incompetent and incapacitated, yet I am writing this myself. Jimmie Harris is a liar. A big one. He actually had the audacity to say my nephew would help me with my paperwork. I was working for the MMAP AKA MEDICARE MEDICAID police through a senior program. Get back to work, I don't have a job. I was lied to about that. The system needs a thorough overhaul. They got the wrong people in jail. They should be there. Marie Shipp, Jimmie Harris, Brooke Van Buren, Lavon Lafayette for forging a 500.00 check to Jaque Moss of CMH that never happened. Jimmie needs to be arrested for inappropriately touching me. What puts him above Cosby and Harvey? Investigation please!!!!!!!!!
Thank you for advocating for Evelyn. You are right they medicate, isolate and steal the estate. This was done to my 83 year old mother when her own doctor targeted her with narcotics.
we started early when the not needed adult p/a stepped in, did no good, they lie to steal. She sure deserved better. Know your Mom did too.

She has a live in caregiver, for the last 15 yrs, [ who she loves as a Nephew, & he considers her family too) she has all her wits about her & makes her own decisions. She is healthy & needs no nurse, hospital or APS involvement. Such a shame, lies have been spread - innuendos & now a power play is in effect for her person, liberty & property. APS is not protecting her, indeed, she has a support group of friends around her, & still this..shaking head,the exact opposite from APS & probate gang.
In their sick and twisted minds, they think they own you because you receive social security. What the idiots seem to forget is you paid that money in yourself!! Hell, you will be lucky to live long enough to get YOUR money back!!
In dealing with my own mother, I agree I would need more information to make a decision on this.
And if this is her home, it is lovely, tidy and clean. She really does need to be protected from these people, I fear for her I really do!..
I know people who have worked in care homes, some are horrendous.
Soon the state will bring in their own doctors and their word will be final, unless we can manage to stop these organisations in their tracks, there is no reason at all why this sprightly elderly lady cannot remain in her own home! AT ALL...
Which hospital, is there any way the people involved in this can be prosecuted for causing emotional abuse and distress to an elderly person.
Please there must be something we can use against them in this situation, this must be stopped, almost like some test case...

Stalking also is covered by the Adult Abuse Act.
Coercion, the state is forcing her to follow their procedures.
Stalking her by not allowing her to remain or return to her own home
Harassment by forcing medical tests.
Can't they let her grow old peacably before they try to steal her property?
There ought to be strictor laws, someone should go to jail for crossing the line, Be Respectful to the elders!! You will get old one of these days, maybe.

So I take it if people are in difficulty it gives the State the right to barge in and seize hold of someone and take them away from their own home. Huh! have you any idea how upset this can make elderly people?

My Father was taken without a warrant and took him when I was in another room. I have not heard 1 word in almost 5 months
We tried EVERYTHING, we ran away with her when nothing was working, they sent certified letters to my house, and while Evelyn was here, they used rammers and broke down her door, they threatened arrest if we didnt take her to the hosp for that 2nd evaluation they said,. I have heard horror stories of cps now as well, most seem to sweep it under the rug.

to Sliepnir2006: This was in Evelyn's home. She's sitting at the table in her dinette just 1 month before she was court-ordered to admit herself into the hospital. She wasn't ill. There was no reason to go into the hospital except for APS to take possession of her person, get her disorientated, & then give her a competency exam. Guess how she fared? This is just outrageous and wrong. She is now in a nursing home. She wants to go back to her home! She does NOT CONSENT to this treatment!
Evelyn was court ordered to a hospital. As far as I know she had no food from noon that day til 11:30pm...after spending a night in isolation after a very confusing & traumatic day, Evelyn was competency tested by a STATE dr.(biased towards gov't) Her results came back "poor." & she was declared incompetent, thereby allowing APS to appoint a guardian who will take over ALL assets, her home, etc. THIS IS WRONG in Evelyn's case.. Home visits were fine. Evelyn's fine & wants to go HOME!
I have 3 clients in their 90's. in their homes with care-givers. They are FINE !
I am asking this !!! Who started this mess and what rights legally does ANYONE have over another humans rights (who is being attended to correctly ) WHO started this nightmare for Evelyn ?

I am presuming as of 2020 that Evelyn has already passed away, since this video was 11 years ago. Its sad that today's seniors who want to age in place has to be afraid of being taken away because they are not perfectly healthy, both mentally and physically. Back in the "old days" before APS even existed, your grandparents and great-grandparents were untouchable regardless. Those days are over. Now all it takes is someone to report them to police and/or APS they are forever a case.

Thanks for the responses... APS and CPS could sure use improvements - the power they use to act, is unreal. [In July, North Carolinas Supreme Court ruled that CPS may not force interviews on parents who refuse them.] The rights of the Adult needs to be honored as well. Studies show people involved with APS have more of a chance of being instutionalized, and death, than those not involved...sad isn't it? They may do some good, however, they sure do some harm too!

Didnt do her any good, all we did, nope, crooked system hid her and took all her assets, she died lonely and feeling unloved I am sure.
This reminds me of the abuses of Child Protective Services where children are horribly mistreated in the interests of criminals of the worst kind. Ongoing investigations have been revealing these terrible abuses.
These Adult Protective Services people are probably only interested in obtaining her home and this has nothing at all to do with her inability to live on her own in her home.

she sure DID deserve better treatment by the puplic officials meant to HELP people --NOT injure them and take over their lives. She never consented to this ill treatment, but her entire life WAS taken from her.

There are a number of us getting together, different human rights groups, because we really must show a united front on these issues. If you google CPS sucks you will find a lot of very angry people, because most people are decent and detest any abuse, wither it be to children or elderly people, and what these protection racket criminals is doing is clear cut abuse.
yes...I'm very sorry....we thought we were doing the "right' thing by allowing APS in to inspect Evelyn, her home, her living conditions. All passed inspection, however, a few months
later they came back with a vengeance and as you said: completely "trash(ed) her "life."

I am presuming since 12 years after this video was recorded that, as of April 3, 2021, Evelyn has already passed away. I hope she did live the rest of her life not being bothered by APS.

She was put in a nursing home and was alone, for just over a yr, and died the day after her 3 good friends (us) found out where she was. We had a short visit, she knew us, but she was not well, all the way down to her green wrapped foot.
ohwidow So sorry to hear that. I really fear for future family caregivers. My Father is still living. I have no say. I am no even allowed to tell him what happened to his home, which was stolen by "court professionals". They charge huge fees because I, as family caregiver "abused the Power of Attorney". A total lie. I have proof by way of a computerized glucose diabetic sugar meter. They stole $450K worth of assets.
