You can’t arrest for failure to identify unless you are suspected of committing an actual crime in a formal investigation. That’s why our 4th amendment exists to be secure of our papers and person. This is an easy lawsuit to win. Policy doesn’t trump the law nor our constitution 📜😲

@@GottlikeDamon The investigation was poorly performed in an unprofessional hasty manner. One can suspect anyone of doing something however concrete evidence that a crime is being committed is key, otherwise it's wrongful use of power and completely void as far as the law is concerned.
Reasonable suspicion was created when he showed a prank note that he stated was his receipt for the TV instead of just declining to show a receipt while asserting he did purchase the TV.

The cop was triggered when Brenden asked if breaking Walmarts policy was breaking the law, because he knew Brenden was right.
What Brenden was arrested for is commonly known as contempt of cop or failure to boot lick. The fragile bruised ego of the officer that supposedly took an oath to defend the constitution didn’t like being made to look like a chump by this young man.

If Brendan had been asked to leave instead of being detained, then trespassing law might have come into play, but it never did in this situation, therefore the law enforcement was trying to be policy enforcement. Period.
