Not every false accuser is acting maliciously and the legal system is always the most responsible for miscarriages of justice. It is possible for a real victim to be mistaken about who had attacked them. I recall the case of Clarence Moses-El, who tragically lost 28 years of his life after being falsely accused by a women who "saw his name in a dream". But that's not the full story. For starters, the police accepted that kind of reason in the first place, which is blatantly ridiculous and indicative of either negligence or corruption (likely racially motivated). Second, the police destroyed DNA evidence that would've proven Clarence's innocence. Third, the jury believed that the women's testimony was good enough to convict Clarence. Finally, the women had actually been assualted, but wasn't clear on who had done it - of the options presented to her by the police, she picked Clarence. It is to be expected that someone who went through something so traumatic could be mistaken, it was the legal system that really failed here. (That said, in this specific instance the victim could've done more to help undo their mistake, assuming they ever recognised it.) There's also the case of traumatised victims making false accusations in order to get investigations started. Children often repress traumatic memories, which may later surface in therapy but not fully show who harmed them. Given the statistical probability that their older male relatives are the most likely offenders, it only makes sense that they may try to get their own family investigated, with all the unfortunate consequences that can incur. It would be a tragedy for the wrong person to get convicted in that scenario, but the victims position is sympathetic here, and their reasoning may be understandable even if they turn out to be wrong. Again, in this scenario we're talking about real victims who may be mistaken, and it is the legal system's job to discern the truth here. It wouldn't be fair to punish the victim upon finding out the main suspect was actually innocent, given that they were actually harmed by someone but naturally can't remember due to the nature of their trauma. Next, it is possible that the accused is actually guilty, but there isn't enough evidence to convict them. Given that that is often a possibility, would it be fair to punish the victim for investigators inability to find the evidence? If it can be proven beyond all reasonable doubt that a person of sound mind is maliciously lying, then yes they should be punished for that - this is just a very difficult thing to prove. If the burden of proof for that was lowered, it might discourage real victims from reporting assault, as their attackers are naturally capable of lying themselves. SA is already underreported in most countries, without us adding such barriers. Justice for someone like Clarence does not involve his accuser doing the same time. It would involve all the agents of the state who guaranteed his guilty verdict through their negligence, corruption and ignorance being punished, and a fat check for Clarence to boot (in my view he didn't get paid nearly enough for all those years lost). Possibly even a rethink of the whole policing apparatus. Certainly the mass legalised slavery that is the US prison industrial complex needs to be abolished. Before I get sidetracked, the point is again that the legal system is always more responsible for miscarriages of justice (even if the liar manipulates masterfully- it shouldn't have been possible to do so!) I fully understand and sympathise with the sentiment of your comment, but there's far too many complications irl for it to ever be possible to implement without causing great disaster, so it's worth reconsidering your position a bit in my view, if only to include a list of exceptions

Not every false accuser is acting maliciously and the legal system is always the most responsible for miscarriages of justice. It is possible for a real victim to be mistaken about who had attacked them.
I recall the case of Clarence Moses-El, who tragically lost 28 years of his life after being falsely accused by a women who "saw his name in a dream". But that's not the full story. For starters, the police accepted that kind of reason in the first place, which is blatantly ridiculous and indicative of either negligence or corruption (likely racially motivated). Second, the police destroyed DNA evidence that would've proven Clarence's innocence. Third, the jury believed that the women's testimony was good enough to convict Clarence. Finally, the women had actually been assualted, but wasn't clear on who had done it - of the options presented to her by the police, she picked Clarence. It is to be expected that someone who went through something so traumatic could be mistaken, it was the legal system that really failed here. (That said, in this specific instance the victim could've done more to help undo their mistake, assuming they ever recognised it.)
There's also the case of traumatised victims making false accusations in order to get investigations started. Children often repress traumatic memories, which may later surface in therapy but not fully show who harmed them. Given the statistical probability that their older male relatives are the most likely offenders, it only makes sense that they may try to get their own family investigated, with all the unfortunate consequences that can incur. It would be a tragedy for the wrong person to get convicted in that scenario, but the victims position is sympathetic here, and their reasoning may be understandable even if they turn out to be wrong. Again, in this scenario we're talking about real victims who may be mistaken, and it is the legal system's job to discern the truth here. It wouldn't be fair to punish the victim upon finding out the main suspect was actually innocent, given that they were actually harmed by someone but naturally can't remember due to the nature of their trauma.
Next, it is possible that the accused is actually guilty, but there isn't enough evidence to convict them. Given that that is often a possibility, would it be fair to punish the victim for investigators inability to find the evidence? If it can be proven beyond all reasonable doubt that a person of sound mind is maliciously lying, then yes they should be punished for that - this is just a very difficult thing to prove. If the burden of proof for that was lowered, it might discourage real victims from reporting assault, as their attackers are naturally capable of lying themselves. SA is already underreported in most countries, without us adding such barriers.
Justice for someone like Clarence does not involve his accuser doing the same time. It would involve all the agents of the state who guaranteed his guilty verdict through their negligence, corruption and ignorance being punished, and a fat check for Clarence to boot (in my view he didn't get paid nearly enough for all those years lost). Possibly even a rethink of the whole policing apparatus. Certainly the mass legalised slavery that is the US prison industrial complex needs to be abolished. Before I get sidetracked, the point is again that the legal system is always more responsible for miscarriages of justice (even if the liar manipulates masterfully- it shouldn't have been possible to do so!)
I fully understand and sympathise with the sentiment of your comment, but there's far too many complications irl for it to ever be possible to implement without causing great disaster, so it's worth reconsidering your position a bit in my view, if only to include a list of exceptions

Yes the justice system fails from time to time, but OP is talking about people who go to the media and drag a celebrity’s (or some regular person who they are mad at) name purely for their own self gratification.
