  • Christine Thornhill, Esq. answers the question "What is Equitable Distribution?" as well as, "How does the judge divide property in a divorce?" and "Is equitable distribution a 50/50 split?"
Christine is a Family Law attorney who has been practicing for nearly 20 years in the state of Florida, helping families through divorce and child custody battles.
She goes into thorough detail explaining the determining factors A - J of Florida Statute 61.075. Here's a brief guide on these determining factors that the judge uses to split property and assets when couples divorce:
    A) How each spouse contributed to the marriage, financially and as a homemaker
    B) The economic circumstances of each spouse
    C) The duration of the marriage
    D) Interruption of personal careers or educational opportunities of each spouse
    E) Contributions of one spouse to the personal career or educational opportunities of the other
    F) Desiring to retain an asset free from claim or interference by the other spouse
    G) Contribution of each spouse to the family income, financial improvement or incurring of liabilities to assets
    H) Desiring to keep the family home as a residence for dependent children
    I) Intentionally harming or destroying marital assets during divorce or up to 2 years prior to filing for divorce
    J) Any other determining factors necessary

Are you sure about that? I was under the impression that equitable and equal don't mean the same thing.

You are correct - equitable and equal do not mean the same thing. My apologies if the explanation wasn't clearer in the video, but essentially equitable distribution is the equal most splitting of assets possible. This could mean that a wife receives the house valued at $150,000 while the husband receives the 401K valued at the same price. These are by no means equal assets as one is a house and the other is a retirement savings account, but they are of equal value.
