What annoys me as an Etsy seller is having loads of non handmade items, Disney stuff and the shops are selling tons! It seems rather unfair to say something needs to be handmade and then have few things handmade. It seems unfair to remove listings or suspend shops when you have no one to talk with. The fees are ludicrous and what do we get for it? Our shops shut down, our listings buried? Items like vintage dishes, feet pics, google images are allowed to be sold. It’s frustrating. I have been allowing my items to expire and I will spend the money Etsy steals from on my own website marketing.
Etsy shuts down ANYONE! No reply. No refund! Handmade book covers i made myself, pictures i designed and sewed on myself. No copyright. Or was it because i didnt make the denim myself, or the lace, or the beads i bought and sewed on. Shocking company! Quick to take your money, but just as quick to close you down for no reason. Customer support is NON EXISTENT!!!
Feel sorry for you. I’m in the same boat. Etsy shut me down because their system suspects i have fraudulent activity. All I’ve done is buy mock-ups from Etsy for my store and i was shut down. 2 appeals and they won’t hear a thing 😭

I just saw J Edward Neill's YT video about getting shut down on Etsy for his remarkably stunning art that he's put on his #1 selling Tarot cards. Etsy believed that he copied Temu rather than the other way around. He appealed by pointing out that he'd even sold those original paintings on Etsy as well. He got a bot reply. They finally reinstated him after a week of lost sales, but in the meantime, he'd moved over to Amazon and his own website.
Creating good, original art takes time. Arguing that fight kills creativity. Artists are realizing that Etsy is not conducive to having a profitable handmade business. Without sellers, Etsy is literally nothing. Nothing means stockholders sell. If you can't bring in more buyers than just AI-on-POD sellers... uh oh, Etsy.

I just saw his video about his tarot cards with his original artwork and ETSY removing his bestselling tarot cards. I didn’t know his listing was reinstated. That’s good news. I also didn’t know Temu copied him, but I’m not surprised. I will never, ever buy from Temu. I hope others consider doing the same.
As if anyone copies Temu! They knock off so many original artists, it'll make your head spin.
As a person that purchases wholesale fabric to make items, I am actually restricted from making and selling anything that uses Licensed Fabric, such as Disney prints. So it's actually a violation to make a pillow using Disney fabric, or any other Licensed fabric and resell it. You are only allowed to make items for personal use only. I do have people request things, so I take those on a case by case basis, but I never list items that use licensed fabrics. I believe even the salvage of the fabric states "for personal use only" on it. Just an FYI as I tried to do everything I can to not get my store or listings removed.
It would depend on the fabric. If it has explicit "for personal use" licencing then it can for sure be an issue🤣
@brandcreators The dude said you can go buy Disney fabric and make a bunch of pillowcases to resell. He didn't say it depends on the fabric. Go do your homework before you put out another video like this, giving mis information.

Yep, I stopped short when he said that. All fabric with designs are for personal use UNLESS it's specifically licensed for commercial use
You can charge for your time if they buy the materials themselves
Amazon makes you input your license to sell another persons copyright image. If Amazon can do it, so can Etsy, especially when it comes to Disney, Taylor Swift, etc. Etsy's lame excuse that the copyright owner has to report it is their way to steal right along with everyone else. All Etsy cares about it the sale they generate while knowing it's a violation.

This is honestly ridiculous. How can you shut someone's shop down without even an email to the shop owner first to at least inquire? Crazy bad business policies.
Why Etsy let the listings with Disney in the title? Simple, 20 cents per listing, and if a product is sold - more fees. Etsy lets Disney to do the work of finding these items because Disney doesn't have time to find every little listing. Is always the money. They will continue to do so till the pressure on them will be too big.
Of course Disney has the time! They have teams of lawyers on payroll to do the work for them
I'm a small independent artist and livestreamer and I actually went after someone on CZcams for DCMA/copyright violation for passing off two of my livestreams as their own on their TY channel without my permission or prior knowledge. It's not just big companies that will go after copyright infringers, small players like myself do so as well. Etsy needs to do a lot more to protect copyrights and prevent infringement.
Funny how Etsy allows them to post, pay for the listing, then take it down. It doesn’t sound like a lot of money, but it adds up and is “free” money for Etsy. It’s good Etsy is cracking down, but they need to refund the seller and give them a reason why. eBay can tell you why, they should be able to. And it might help people wake up and realize you can’t use copyrighted or trademarked items without a license.
Im not sure what happens when a listing is flagged by the AI, the reviewed and taken down. But for the ones submitted to etsy by the copyright holder, (universal, sony, etc), Etsy takes the listing down, messages you saying its been taken down and why it happened. And they also give you contact information of who submitted the claim that way you can contact them for counterclaim or whatnot. Etsy doesnt have anything to do with the process except taking it down after verifying a legit copyright claim, and putting it back up after proof of winning your counter claim. There is legal precedent and many cases where the copyright holder cannot sue the website for copyright infringement. Only the third party seller, us, can be sued. Thats why Etsy in their agreements that you accept when you post a listing, say its your responsibility to ensure what you post is handmade and does not violate copyright. With the risk of losing your listing and the fee you already paid for it. No, its not much money for etsy, but it would be more complicated for etsy to have to run around to try and give everyone back 20 cents, not sure what fees they pay their financial transaction company, and also provides a sort of punishment that will happen since you listed something your not supposed to
The guy you interview need to do is homework ETSY falsely cancel account. I have My own trademark with my cosmetic products and my brand. ETSY SHUT ME DONE FOR NO REASON. so that is not true YES I APPEAL several time also I have not gotten my last pay it is setting in my ETSy account since Dec.2023 and waiting for them to release my funs I don't care for them ETSY NEEDS TO BE SUED FOR ERRORS.
Where do you live? Etsy must follow the laws of your own country first and foremost therefore, you can take the legal representative for Etsy legal in your country to small claims course. In my country this process is $60.
At a guess I'd say less than 40% of Etsy products are genuinely handmade or designed by the actual sellers (POD).
Every week I receive these "Etsy Picks" emails. Today's email featured some nice patchwork, quilted jackets. All were "star sellers". ALL these exact products were available on Alibaba, Aliexpress, Indiamart and Ebay. A couple of days earlier another Etsy Picks email, featured some nice looking Moroccan lamps. Again, these exact products were available wholesale and on Amazon and Ebay. Every email is the same. Always has been.
If Etsy removes all the Policy breaking listings there will be literally nothing left.
As a genuine handmade seller this makes me sick to my stomach. I am definitely looking for another way to sell online.
I used to sell on Etsy, but in 2022 my shop was banned as all the Russian's shops. I moved to other marketplace. And what I see on Etsy? Some very unhonest people sell my digital patterns and tutorials on Etsy. Talking with other sellers we found out a network of such thief shops! So now I see Etsy is supporting thiefs! Yes, listings with my patterns were deleted, but its temporarily. I'd like the whole network of this thief shops to be banned 😢
They did not remove anything relevant that is 100% not handmade at any way shape or form. Envato fake access is still there, Windows 10 and 11 licences are there, Microsoft office, 4K UHD ripped mp4 movies are there, entire tv shows (search TV series digital), screen protectors, radio code keys, and many more like that....
Etsy is making money 🤑💰 off of copyright infringement items and turn a blind eye to such products until a legal copyright infringement case arrives against Etsy.😮
Amazon detects my listing titles of the word Apple and I get warned for using the word apple in listing title where i just want to use a photo of a fruit... One of the biggest company doesn't know the difference between an apple fruit or apple company. I have little faith a lesser company can come up with a good solution
It's a huge problem that unfortunately does not just apply to obvious stuff like Disney crap and the like. It's also a weapon to eliminate competition through illegitimate copyright claims. I had a bunch of listings delisted by Etsy due to supposed copyright violations submitted by some rando website (appears to be a Chinese operation that scrapes patterns from other sources an resells them). The patterns/images under contention consisted of simple geometric patterns. Nothing particularly original or special about the patterns, in fact the exact patterns and variations thereof have been used for hundred (if not thousands) of years by various cultures all over the world to created privacy screens, shadow screens, and for general simple decoration in a variety of media. There was no effective way for me to protest the rediculousness of the copyright claim, so the listings remain taken down.
I have contacted consumer affairs and the ACCC in Australia. They can't keep suspending shops within minutes of paying set up fees, no explanation why, yet keeping the money and not refunding. Those millions of listing's they are taking down all had fees paid on them. I'm not saying all are genuine, some may have been for good reason such as copyright, mass produced etc, but they are doing it to genuine hand made sellers as well. Let's see if they can look into it further.
You need to take the legal representative for Etsy Australasia to small claims court. Take the presentation directly not Etsy. My friend did this against Meta for $60 and won against meta lol!
Etsy will list anything then take w/e violates a term later rather than flag it up front because once you post they get paid, if they flagged it early they would not get paid…
I don't know how etsy works because I received an email saying that 1 from my listing was deactivated for IP Infringement, BUT I dont have any active listing. I closed my shop 2 years ago 🤔
You can sell anything legally that you owned if you sell as new you cannot so intellectual property for instance disney items new if you are not a legal distributor but you can sell it new in box as pre-owned legally
Yes that would be what is typically referred to as the first sale doctrine. That's why people are able to resell Disney tumblers and things on ebay.
With Etsy though it's much more of a grey area since only certain used things are allowed on the platform (e.g. vintage)
I also wanted to open a store on Etsy with fine art. Worked for 12 months creating paintings but now, seeing what is going on, I surely say NO to Etsy.
Have to agree with you. I design all my own stuff and are copyrighted. But I am seeing way too many bad reviews about Etsy.

I had an IP infringement claim around a month ago. The links that were provided went to a fraudulent website in another country. I emailed the “person” who filed the complaint and got no response. I then filed a counter claim and within 10 days Etsy restored my 4 listings. Yesterday I got yet another claim. This was a trademark violation supposedly filed by a commercial concrete construction company. Keep in mind that they are filing this on an ornamental concrete statue that I make. The person’s name was “Jane Doe”. Clearly this is a fraudulent claim which I have emailed Etsy about but as of right now they have not responded.
By the way, the first claim I received had a url link so that I could challenge the claim. The one that came in yesterday did not because it was a trademark claim. So I may be screwed.
I’m getting so confused. What’s the safe way to list POD items (original designs) so that your listings aren’t in violation of any ‘handmade’ rules? I spend (on average) about a week on each design, but then use a printing partner to print and ship… would that be considered handmade?
I might be conflating two different things here (Etsy’s ever changing policies & Etsy seller outrage), which perhaps is the reason I’m getting so confused. As a painter, photographer, and someone with a degree in fashion design, I’m no stranger to the more traditional mediums, but I’ve recently taught myself how to use Illustrator, Photoshop, Fresco, etc.. And I’ll be honest, the only difference I’ve noticed between the traditional mediums, and utilizing these softwares, is the cleanup and the much higher expense of these softwares.
With that said, it would appear that there’s a major POD disconnect, out there in Etsy world. I watch a lot of YT videos and read a ton of comments, on what’s considered ‘handmade’, and there’s quite a wide range of subjective opinions. Frankly, too wide for me to land on any point of understanding.
For instance… if I were to take one of my oil paintings (or original photos) and had them printed by a printing partner, to sell on Etsy, nobody seems to have an issue with that. But, if I spend the same amount of time creating a design, using the aforementioned software, and have it printed by a printing partner, that seems to trigger a wave of shade and shame from many in the ‘traditional medium’ handmade community.
I have absolutely no desire to pull wool over anyone’s eyes; I prefer to operate out in the open and with integrity. But I’m officially confused as to what my hard work would be considered on Etsy.🤯
If you are not creating the finished product yourself , all you need to do is list the production partner during the listing setup processs

1). Classify as handmade and add the printing partner, right?
2).Do you think it would be ok to list all the printing partners I use (I use several different ones) within the “About” section of my shop, and then just state that I use a printing partner in the individual listings? Or, should every listing have the exact printing partner listed in each individual listing?
3). If it’s a printing partner like Printify (more of a hub of actual printers, rather than a printing company themselves), should I just list “Printify” as my printing partner? Or do I need to be drilling down even more by stating MWW, Swift POD (etc.) via Printify?
The ‘shame and shade’ is towards the people who *don’t* create their own artwork. It’s towards the low effort, buy clip art and/or whip something up on canva with elements you didn’t create.
@@karenl8837 Thank you! I was hoping there was some nuance to the whole ‘POD is destroying Etsy’, thing. Hopefully, one day soon, the Etsy classification system and the verbiage on the topic of POD, will gain some distinctions. As it stands today, anyone that’s not doing what you described (buying clip art / whipping up something on Canva, w/elements they didn’t create) seems to get lumped in with those that do.
@@janedarc7731 I think sellers definitely distinguish those who are creators and artists and those who are hopping on the POD bandwagon, it just probably doesn’t feel that way to you… I would probably feel that way too. It’s a shame the low effort bandwagon hoppers are clogging up the search and preventing buyers from finding truly unique creative stuff!
Yes competitors report and it’s my belief that Etsy does not do their due diligence. Asking for a review by phone gets you hung up on. Asking for review by email gets you a form letter. Emailing Josh Silverman gets you a form letter. No idea if a real live human ever did a review. Not sure what you have to do to get a review.
You are incorrect on one thing. You cannot buy licensed fabric, make something out of it and sell that product. You have to have a licensing agreement with the trademark owner to sell. And it costs and arm and a leg. I make dog collars and checked into getting NHL licensing for the collars. This was about 15 years ago. It was $25,00 per year per team. I forget the product volume. I purchase fabric from a wholesaler and I am not allowed to buy any licensed fabric as I am a manufacturer, not a reseller of fabric. I could sell a "make it yourself" pack with the licensed fabric included as I am not selling a finished product, only the parts for someone else to make it for themselves.
Correct some liscencsed fabric would have a personal use only liscence

How can anyone trust what you have to say if you can't spell it? From information about Disney fabric to not being able to spell......smh.
One time I used the word "amber" to describe a bead color and that listing was deleted so fast by Etsy, it made my head spin.
Amber stones were used for teething necklaces for babies and a baby died, so that blacklisted the word. It wans't the amber itself, but the necklace which strangled the child.

Print on demand companies need to ask for licensing to make sure that it’s OK that they print it. They are a big part of the problem but really it’s me because I do not sell any infringement items things in my shop don’t move like let’s say a little girls T-shirt that might just have a summer theme on it, but it doesn’t have a Disney castle behind it or Disney princess sonic isn’t gonna sell because people want what they want and they don’t care that the sellers don’t have the right to sell it. They don’t care and they don’t know, so I feel like it’s a direct hit to my shop because I don’t sell that stuff
My biggest competitor has over 144k sales and has stolen over 1000 photos from Shein. None of their listing photos are theirs. I've tried report them but nothing happened. What else can I do?

What about this : Sewing Pattern sellers using gorgeous pictures from the Internet of beautiful models and designer clothes as their product images. They sell the patterns without any instructions and the technical drawing looks nothing like the product image? Genuine designers like me, with product images of the garment I made, shot in my lounge on my mannequin, cannot complete

I think they shut me down for this and I don't even what I did. Idk how long ago and I don't even have the number that's linked to that shop anymore and can't log into my account. I literally have no way to contact support
AI BOT is scanning products innocently. They used a scanning tool and sent me a violation email while both the title and image were not the same as the violation they said and there was also no number of the original registered copy. My shop is dying. I asked them for support and they told me to wait for a reply email. I'm very tired and exhausted.
Many shops use just Mouse ear silhouettes without detail in their designs. I also see that a lot of these designs are promoted on Etsy Pinterest account. Is that possible now? I have heard that the first version of Mickey Mouse is already in the public domain.
The listings will be up for months before they're taken down sometimes and how is an item made in a factory handmade
Etsy takes down whatever Etsy wants to take down at any time. They could take down Disney things just because they want to or for violating the handmade policy. They don’t give reasons as it is.
Loads more are there. like the Anti Social club stuff. trade marked. Hopefully they’ll get most of it down and that will help the rest of us honest folks.
there are a few exceptions to the rule of copyright (besides the fair use rabbit hole) -- one is educational purposes, the other is irony, parody or comedy. ...
correct but those are defenses that have to be found as valid by a court
@@brandcreators I have used in DMCA or CZcams take downs, the parody law when a few big shots were attacking my husbnd.
He had a comedy news show, so it was easy to counter the complaint on youtube. It can be used for visuals as well.. I remember the case is an Annie Leibowitz case- but it can be used across the arts.
My question is this.... Lets say i am making and selling cupcake sprinkles inspired by spiderman. I dont call it Spiderman on the title and description.... but can I call it Spiderman in the tags?
No, tags are also the reason shops and listing are being taken down.
Etsy should just let Disney have some employees comb through the listings.

Blame the print company too. When Betty white died I did a shirt design with one of her quotes. No photo. Just funny saying. After I sold the shirt the shirt Printify refused to print it. Said it was a violation of their policies. What a joke
