    Breyer mentioned going to public high school. Only three current Supreme Court justices attended public high school (Kagan, Alito and Jackson). Only 10.04% of all US students attend private high school.

    Re: Bush v Gore. Notwithstanding his recollection, Justice Breyer voted with the 7-2 majority that the remedy devised by the Florida Supreme Court was unconstitutional. But he was part of the 5-4 minority opposing the decision that held no remedy was possible in the time remaining before the inauguration. From Oyez: "Noting that the Equal Protection clause guarantees individuals that their ballots cannot be devalued by 'later arbitrary and disparate treatment,' the per curiam opinion held 7-2 that the Florida Supreme Court's scheme for recounting ballots was unconstitutional. Even if the recount was fair in theory, it was unfair in practice. The record suggested that different standards were applied from ballot to ballot, precinct to precinct, and county to county. Because of those and other procedural difficulties, the court held, 5 to 4, that no constitutional recount could be fashioned in the time remaining."

    Using ONLY ORIGINALISM/TEXTUALISM in ALL cases is no different than using the MODEL T's repair manual for your TESLA. In EVERY and ALL other situations in our lives we'd term this IDIOTIC!
