    For these types of videos it's best to get the geologic survey to know exactly where public property and private property is so there are no disputes. Also, it may be a good idea to have some sort of potent mace handy.

    TTA: I really admire your work. Come to think of it, your voice tone is great too. Sounds like you are in control. In charge.
    Though many of us are not out there on the front line with you, doesn’t mean we can’t help. I think it makes sense to apply a little passive/aggressiveness when cops behave tyrannical or even stupid. I think the public has to teach cops to be polite and stay in their lane versus telling us what we can do because someone's feelings are hurt. Examples:
    When they first walk up and you ask for them to announce their name and badge number and they fail. Don’t ask them again. Tell them: “You and I are finished talking. You didn’t ID, we are not going to talk. You are dismissed.” Then ask the next one. Same thing, then dismiss them.
    Don’t forget one of your best tools is silence. The silent treatment is more effective than arguing with them.
    If you ask a question and they don’t answer, tell them, “We pay you for service. If you are not going to answer my questions, you are dismissed. Don’t say anything more to them.
    When they try to coax you to leave or ask if you are done. Just stand there. No answer, no movement. The longer and the more they pressure you, just stand there. No reply and no response. If they put their hands on you, you might as well just sit down. Even lay down. Might even scream in pain as they have hurt your neck and back.
    May as well give them something to think about. You guys are going to really shine on the Internet. Be sure to check back several times. Wait until your family and friends see you. They will laugh. You will be great entertainment for them. Don’t forget to read the comments that thousands of people will make. And think about how your department will regard your tyrannical behavior. You think it will sit well with your chief, your mayor, your city council and you citizens?
    The really ironic part of this is: You have the opportunity to make yourself look good, and nearly every time, you go the other way. Your bad behavior shines through. We see your true side. We see your disdain for the public. Thank you for showing your true self to us. Let leave you with the absolute truth. Let’s make sure you have no doubts. We don’t trust you. We don’t trust you to protect us. We don’t trust you to do anything but protect your own gang. We don’t trust you to be honest. We have such little use for you and your kind, we can do completely without you.

    Public easement. Dont ever just stand in the street bro. Your safety is priority. Also you could check the gis survey to see the property lines. I would even o as far as to print them out so if the cops get cute you can inform them. Stay safe and keep doing what you do. You have a great auditing style!

    Amazing how they have all these directives helping you. Helping you right into a cage when they think they can justify it. For instance, "just stay off their property".     Ok I don't understand, if the police have access to the footage on their cameras isn't it available through FOIA? Seems odd that the police would have a feed from a private business. Easement law in Illinois is 20 feet from the center of the road.

    Every public Street in the entire United States of America has a right away on both sides of the public Street. Regardless if they call it a right-of-way or an easement or public Access. You cannot be trespassed from public property unless you commit a crime. It is extremely rare for any government to put their sign on private property. I would bet my life and/or 10 years salary That Sidewalk belongs to the public.

      If they installed it then it is just theirs... unless the gov. buys it from them. BUT then there would still be the easement, so it can be their own private property with a _public easement._

    Good audit! I like that security manager guy. He kept pressing his case, and was wrong about a few things, but he remained cordial and civil the whole time. He's got good people skills. I would like to make a clarification for the viewers, just so that nobody finds themselves stating things to a court incorrectly, and ending up with things not going their way as a result.
    They most likely DO own the property right up to the curb. What makes a portion of their property along the roadway 'publicly accessible' and what enables a city or state to put signs up within that space is an easement or right-of-way. An easement or right-of-way is a type of land usage contract that modifies a deed. It grants some usage and/or control rights to a non-owner of the property. In other words, they still OWN the land, but the municipality has some usage and control rights to it. In essence, the easement or right-of-way lets the city or state place road signs, require sidewalks or drainage ancillaries, install utility items, and designate it as a publicly accessible area. Since easements or right-of-ways are kind of a contract, they can be written to grant some usage or control types, but not others. You could write one granting your neighbor the right to plant flowers on your side of the fence but not to plant trees, for example, if that's what you wanted to do. But you would still OWN your property. Easements or right-of-ways do NOT transfer ownership, they just grant usage and/or control rights from an owner to a non-owner.
    If you go to court, and you try to tell the judge that, "It's not their property," you're going to end up looking like you don't know what you're talking about. But if you tell the judge, "Yes it's their property, but the portion of it I was on is a publicly accessible easement," then they're going to have to concede your accurate point. I suppose this could help out on the scene also, if the cops are called and you need to justify the fact you are standing in a specific place. It could make a difference if you're dealing with a cop who isn't educated on property law. You want to put the right words into his mouth when he starts looking deeper into it. You DON'T want him just asking, "Who property is this," because the answer is going to be that it's THEIR property. Instead, you want him asking, "Is there a publicly accessible easement extending a certain distance ONTO their property from the curb?"

    “HIPAA (Health Insurance Portability and Accountability Act) is essential for cannabis dispensaries because it protects medical cannabis patients' personal health information, such as medical history, conditions, and treatments. As a dispensary, you may have access to this information, which must be protected under HIPAA regulations.” @TTA, in the future you should speak to how HIPPA has nothing to do with protecting a patient’s likeness/face. As you know, if you are on public property, and they walk out of a private building, you can record what your eyes can see. This includes potentially capturing their license plate that is in public view. If you are inside a public space such as the DMV, post office, police station, city hall, etcetera and they mention HIPPA, please advise them it doesn’t apply AT ALL. People don’t respond to “the onus is on you” if they are ignorant to that. Community health services/clinics follow HIPPA. Still, it’s ridiculous for them to bring it up if you’re inside but the information is being shared in a lobby or viewable with your eyes. Keep educating!

    They built their sidewalk in the right of way. They don’t own the right of way. If the city wanted to widen the road that sidewalk would get destroy and would not be replaced by the city.

    Walking IN the street (i.e., on the pavement) is not only dangerous, it's ILLEGAL. That's why there needs to be an easement on each side of the street. If the easement is publicly owned, then it's called a public easement. Otherwise it's a PRIVATE easement. BUT... in either case, even if it's a PRIVATE easement, the public has a right of access. That's how it works. That being said, always do your research on property lines before going for your audit. AND print the maps AND bring them with you. In this case, you didn't do your homework.

    To be fair, the security guy wasn't a bad dude. He might be misinformed, but he was just trying to do his job. He was very approachable, even when you guys were sort of odds with one another.
    As a side now: James, I'm from Boston but live in New Hampshire currently. In Massachusetts, most dispensaries are privately owned, however in New Hampshire, ALL dispensaries are owned and run by the State of NH. I have not seen a single Privately owned Dispensary anywhere in NH. As far as I can tell, you can't own a dispensary in NH. Just figured it might help with future investigations. Thanks for your hard work! Keep it up! I really can't give you enough credit. You're one of the good ones out here! You stay respectful as possible, until you're disrespected.

    You think they installed that sidewalk out of the goodness of their heart? No. Most cities will take the right of way. Its simply law. They don't have to fight every property owner for the easement/right of way. And even in some cities or states where they still own the land, the city/state demands via law that the public can use it. And the really funny thing is, the property owner still has to maintain it. Sometimes when the sidewalk fails, due to tree roots for example, the property owner has to pay to repair it, not the city. So, bottom line, Rise may own it, but the public retains the right to stand on it/use it.
    Every notice when someone does not have the true authority to force you to do something, but they just try to talk you into do it, they just keep talking. They talk over you, they interrupt your reasonable time to also talk. They won't shut up !!

    Typically speaking, if a business develops land for commercial use, if the municipality has not already installed sidewalks there, the business is then required to install them to meet code requirements such as sidewalks, even if only for the americans with disability act laws. This does not however usually mean the business then "owns" the sidewalk. That sidewalk is still placed on property that would otherwise be a community easement. Those sidewalks and driveway openings into the street which are known as " aprons" all still require permits and inspections to ensure they meet those codes.

    Inside any camera there are several glass lenses behind each other. If you shine a light on the lenses it can be reflected by lens 2 or 3 and the recorder (sensor) sometimes can see that light mirrored. So If the light Goes left, the dot goes right. Same goes for up and down Motion.

I think when you come across police that up hold there oaths and are cordial, we should BZ, give them a big thumbs up... some out there are not so nice... highlight those that are,.. that is my thing to include,... appreciate all you time and effort doing this... you are the man!!!     Don't answer cops about which vehicle is yours; just tell them that it's none of their business which vehicles are whose until those vehicles are involved in something illegal.

    The public right of way (public street) typically includes space for the public to walk (sidewalks) on at least one side. However, if the private property line goes all the way to the curb, there must be an access easement for the general public to lawfully pass through private property, rather than walk in the street, which is unlawful. Easements, for all intents and purposes, are publicly accessible, are technically not public property, but retain all the characteristics of public property.
