I think EB1 also has on 2 years backlog for India now but you need PhD in STEM area for it. IT companies are applying for their managers in that category. I got my Green Card in 1997 in EB1 as I had PhD in CE and had some good credentials. Filed I-140 in July after my graduation, and had my approval in September, 485 filed in October, and my EAD coming in December for me and my wife. All done in 5 months though actual Green Card came only after 1.5 years. We had to make one trip to India with our Advanced Parole. My PhD was a long struggle with even my health getting affected adversely but it all paid off with my Green Card process completed in 5 months with EAD for me and my wife. I had only Conference publications but I had Teaching Awards from my University. I used to teach regular courses for Undergrads through my 4 years during my PhD. During my first 2 years for MS, I used to be a TA and then taught a course in Summer and then they promoted me to be an Adjunct Faculty during my PhD. I had appreciation letters from HOD, Dean of College of Engineering etc. that I attached for my I-140 filing. I think my teaching credentials were more impressive to the Examiner to approve in EB1 than my Research credentials.
Actually for physicians after their residency they can apply for their EB2 NIW and have to work for 5 years after that they get their GC instantaneously
if you are interested in research, a PhD is the best way to go and depending on the area of PhD USA might be the best country. For example, in Computer Science and Business US is the best. For sciences and engineering, Germany might be a great option

Nice video, but I don’t fully buy into the argument of doing a phd for green card. The only reason to do phd should be interest in research. Another thing that I wanted to point out is as you mentioned if u r on a stem degree you have 3 years and generally if you have only done ur masters here that’s more than enough to pay off ur loans. Many companies give the option of moving the candidate to a third country like Canada if the visa doesn’t work out, also I have seen many folks who had a good masters degree and great work experience in us and they could leverage that to get a very high paying job in india.
which is the reason many who don't have passion for research will end up not having a phd degree at all though they will get the MS!! Getting phd from american university is not that easy especially the academic rigour it demands i have few friends who left phd halfway after not able to cope up!!

When was younger I really wanted to go US for studies and then settle down there but as time passed I got to know that is an impossible task so I looked at Europe better opportunities got social programs and the politics doesn't change so dramatically that it impacts your path to permanent residency. America is hard especially if ur an indian cuz ur chances of settling there

It is NOT impossible even today. EB1-A exists even to this date and its dates are current (No backlog) and people are able to get Green Card in 1 year. It is just that earlier even average people could get it, now only deserving and meritorious people get it. [For average and less than average (even for meritorious) people marrying an American is also an option which can get you a Green Card but it should be a genuine love not greed.]
The information in the video from F1 to GC is inaccurate. You can apply for EB1A or EB2 NIW for green card without having a H1B visa. Infact, you can even apply for GC from outside of US under EB1A category.
NIW is an exception. That way you can even apply for GC while on F1 if you marry a citizen. These are not common cases and most people cannot take such routes

Somewhat misleading video. You get 3 chances for H1B if STEM degree. So it's possible that you can get H1B by 3rd time. If not, you can enroll in another master's at some university having classes only on weekends and apply for H1B continuously. It is possible to spend your whole career in America. Also, companies generally don't prefer PHDs. The USA is still the land of opportunities.

Hello Prof. A point you made about F1 to green card is actually not correct. I particularly applied for NIW while on opt after my MSc and I got it. I didn’t have to apply for H1b at all. I also have lot of friends who applied for NIW and green card simultaneously even before they finished their PhD and got their green card.
National Interest Waiver (is an exception). It applies to very few people. Also, I meant employment based traditional route for green card. That way, an F1 student can get married to a citizen and get their green card. Such exceptions are not a part of this video

Canada provides better future to International students. I did my Masters in CS at the University of British Columbia and I am a Canadian Citizen now. Canadian citizens can work in the USA on TN under NAFTA. I am working for a US company in Vancouver and in San Francisco. Also, We have free medical in Canada. My friends who went to USA in the same year are still on H1B and fighting for green card in the US. Also, More Canadian citizens on TN in the USA are getting green card than H1B holders because Green card issuance is unlimited for Canadian citizens. The limitations have been put on the country of birth and not on citizenship. So if you're born in India it doesn't matter if you're a Canadian citizen or an Indian citizen.

Please do not misunderstand me. PhD is a degree awarded for doing research and showing original work. A big component of being a researcher is to find the answers on your own. You cannot go ask someone else to do research on your behalf so you could get your PhD. The very fact that you asked such a question and asking me to check something on your behalf is evidence that you are not fit for PhD.

May be this is easy for me to say, since I am a US citizen already, but is it that much necessary to come over to US ? I look back at my life and ask the same question. Yes, I would have made less money in India and would have some what struggled a little bit until I find a decent job in India. But it was very easy then to come here, be employed and become permanent resident and later citizen. If it has become that much difficult, why not to just stay there, do your best and lead the life close to your relatives. Just enjoy life, because the only thing that is most expensive to waste in pursuing this US dream is TIME. If it is easy to come and get a job, by all means, you are welcome! But waiting 20 to 30 years in an indeterministic state is not how I define as stability and good way to spend TIME. Think about it and choose things that are easier on your existence and don't give two f.cks about what Indian society says. And yes, the only reason to do ph d is if you are passionate about it, otherwise just steer clear of it.
Dear friend here is a summary if you enter to us on F 1 then you need to complete your degree which depends anywhere 2 to 6 years then if you have a stem major you can get OPT of 2 years and hopefully you find a H1B sponsor then you have to go thru perm , it takes roughly 6 months for that to get approved and then you file your i 140 if it gets approved which takes 8 to 16 months from then you have to wait till your priority date comes presently EB 2 the case of 2015 is running at the time of this reply and from there it's a 5 year process from GC to Citizenship

It will not stay long , As per me new immigration rules are in pipeline and every one will get permanent resident status soon 😊. Already I see 4 year jump in EB3 which is a positive news. This is not true what you said at 3:35. No one can stop anyone from applying for greencard. Obviously, one can apply for greencard while on OPT or STEM-OPT. You don’t need to be on H1B or any other dual intent visa. Since, for Indians, some of the EB categories are backlogged that’s why it is not recommended to apply for greencard while on F1 visa or opt or stem opt. Bcos u only get 3 years to get greencard approved if u r on opt+stem opt. Which is not possible for Indians right now. I have seen so many PhD students apply for EB1A or EB2 NIW while still working towards PhD. So, please correct this to avoid misguiding. Even ROW people directly apply for EB2 or EB1b through employer skipping H1B. So, the problem is backlogged greencard process for Indians in EB2 and EB3.
F1 and TN are non immigrant intent visas.............still Green Card can be applied when on F1 or TN status. There are few pitfalls to avoid but doable and need to time it delicately. I am talking EB1, EB2 and EB3. Most likely Indians will not qualify for it as Priority Dates takes years to get current and make sure you do not have impending travel once the 140 is filled.

You will see many Canadians who cross border daily basis on TN visa especially Windsor/Detroit and Niagra/Buffalo borders. After working say 5-6 years you realize, I need benefits for my spouse to work or kids to attend universities or even simply have work authorization not dependent on any employer.......apply for Green Card. There is even concept of commuter Green Card, where you can still continue to live in Canada and cross the border as GC holder to work in US. There are few limitations and few ifs and buts to take care of. But its is possible to have Green Card and still not be resident of US. Why would any one do that, just so dependents can also have GC and attend Universities in US and work without any hassle of F1/OPT and H1b/TN.

Contrators from Indian consulting firms actually manage to get EB1-A! I think they r the smartest and indian firms support your immigration much more than any american firm here. Sad truth but I know too many people from India who contracted here and got their green cards in under 3 yrs
Two points are not correct which you mentioned in this and the previous video. 1-Work experience outside of the USA does not matter much. 2- These are rumors that green card for Indians take more than 15 years. I recently confirmed with an attorney and she mentioned that it takes less than 8 years even for Indians and regardless of which category we apply at. Please dont rely on Google search. Better contact an attorney.
Wrong and wrong. Getting work experience outside of the US and in India is much easier and can easily be gotten by nepotism. Therefore, lots of US companies don’t value work experience and internships that are outside the US or other western countries. Greencard for Indians take almost 100 years, it isn’t just on Google, it’s everywhere. Doctors that have helped patients during covid haven’t received green cards in America. I’ve heard stories of Indian workers who’ve been in the US for 15 years and still have no permanent residency. The immigration attorney probably told you it’s 8 years to convince you that you should apply for a greencard and use her services so she can get money.

They do want to hire international students on OPT - they file for 30 to pick them to get 1 - whoever they can get! OPT is cheaper for company as company avoids paying a lot of employment taxes for the OPT employee - so it’s attractive to have an OPT employee and then H1B employee OVER a US citizen !!! It’s called taking jobs - it’s cheaper for companies to hire foreigners as they are cheaper and avoid a lot of employment loopholes! So H1B is intended for seriously positions that they cannot find - unfortunately what it has become is to undercut US citizens who are able to do the job at a higher cost to company! They import with fake interviews those from India who’ll live and accept the corporate bullshit - and pretend that they are the “best and brightest” ….. they’re not! H1B is abused - and the abuse is accepted by those who are owned by their companies so they can take selfies in front of the Grand Canyon or Statue of Liberty so their parents back home can find them a “wife” because the look “cool”! The information in the video from F1 to GC is inaccurate. You can apply for EB1A or EB2 NIW for green card without having a H1B visa. Infact, you can even apply for GC from outside of US under EB1A category.
NIW is an exception. That way you can even apply for GC while on F1 if you marry a citizen. These are not common cases and most people cannot take such routes

Somewhat misleading video. You get 3 chances for H1B if STEM degree. So it's possible that you can get H1B by 3rd time. If not, you can enroll in another master's at some university having classes only on weekends and apply for H1B continuously. It is possible to spend your whole career in America. Also, companies generally don't prefer PHDs. The USA is still the land of opportunities.

A point you made about F1 to green card is actually not correct. I particularly applied for NIW while on opt after my MSc and I got it. I didn’t have to apply for H1b at all. I also have lot of friends who applied for NIW and green card simultaneously even before they finished their PhD and got their green card.
National Interest Waiver (is an exception). It applies to very few people. Also, I meant employment based traditional route for green card. That way, an F1 student can get married to a citizen and get their green card. Such exceptions are not a part of this video

For the majority of immigrants it's done by doing lots and lots of publications, getting cited on these publications and then making a case that the research that you are doing is a) affecting American public as a whole, b) is beneficial to the welfare of the entire nation.

Canada provides better future to International students. I did my Masters in CS at the University of British Columbia and I am a Canadian Citizen now. Canadian citizens can work in the USA on TN under NAFTA. I am working for a US company in Vancouver and in San Francisco.
Also, We have free medical in Canada. My friends who went to USA in the same year are still on H1B and fighting for green card in the US.
Also, More Canadian citizens on TN in the USA are getting green card than H1B holders because Green card issuance is unlimited for Canadian citizens. Professor, University of Toronto and the University of British Columbia are high world ranking Universities.

The limitations have been put on the country of birth and not on citizenship. So if you're born in India it doesn't matter if you're a Canadian citizen or an Indian citizen.

Please do not misunderstand me. PhD is a degree awarded for doing research and showing original work. A big component of being a researcher is to find the answers on your own. You cannot go ask someone else to do research on your behalf so you could get your PhD. The very fact that you asked such a question and asking me to check something on your behalf is evidence that you are not fit for PhD.

May be this is easy for me to say, since I am a US citizen already, but is it that much necessary to come over to US ? I look back at my life and ask the same question. Yes, I would have made less money in India and would have some what struggled a little bit until I find a decent job in India. But it was very easy then to come here, be employed and become permanent resident and later citizen. If it has become that much difficult, why not to just stay there, do your best and lead the life close to your relatives. Just enjoy life, because the only thing that is most expensive to waste in pursuing this US dream is TIME. If it is easy to come and get a job, by all means, you are welcome! But waiting 20 to 30 years in an indeterministic state is not how I define as stability and good way to spend TIME. Think about it and choose things that are easier on your existence and don't give two f.cks about what Indian society says. And yes, the only reason to do ph d is if you are passionate about it, otherwise just steer clear of it.

Dear friend here is a summary if you enter to us on F 1 then you need to complete your degree which depends anywhere 2 to 6 years then if you have a stem major you can get OPT of 2 years and hopefully you find a H1B sponsor then you have to go thru perm , it takes roughly 6 months for that to get approved and then you file your i 140 if it gets approved which takes 8 to 16 months from then you have to wait till your priority date comes presently EB 2 the case of 2015 is running at the time of this reply and from there it's a 5 year process from GC to Citizenship

And regarding Our Indian company’s, not all are bad. Many are really good and they care about our legal status and do quick decision in timely manner. Which MNC’s fail to do.

This is not true what you said at 3:35. No one can stop anyone from applying for greencard. Obviously, one can apply for greencard while on OPT or STEM-OPT. You don’t need to be on H1B or any other dual intent visa. Since, for Indians, some of the EB categories are backlogged that’s why it is not recommended to apply for greencard while on F1 visa or opt or stem opt. Bcos u only get 3 years to get greencard approved if u r on opt+stem opt. Which is not possible for Indians right now. I have seen so many PhD students apply for EB1A or EB2 NIW while still working towards PhD. So, please correct this to avoid misguiding. Even ROW people directly apply for EB2 or EB1b through employer skipping H1B. So, the problem is backlogged greencard process for Indians in EB2 and EB3.

F1 and TN are non immigrant intent visas.............still Green Card can be applied when on F1 or TN status. There are few pitfalls to avoid but doable and need to time it delicately.
I am talking EB1, EB2 and EB3. Most likely Indians will not qualify for it as Priority Dates takes years to get current and make sure you do not have impending travel once the 140 is filled.

You will see many Canadians who cross border daily basis on TN visa especially Windsor/Detroit and Niagra/Buffalo borders. After working say 5-6 years you realize, I need benefits for my spouse to work or kids to attend universities or even simply have work authorization not dependent on any employer.......apply for Green Card.
There is even concept of commuter Green Card, where you can still continue to live in Canada and cross the border as GC holder to work in US. There are few limitations and few ifs and buts to take care of. But its is possible to have Green Card and still not be resident of US. Why would any one do that, just so dependents can also have GC and attend Universities in US and work without any hassle of F1/OPT and H1b/TN.

Two points are not correct which you mentioned in this and the previous video.
1-Work experience outside of the USA does not matter much.
2- These are rumors that green card for Indians take more than 15 years. I recently confirmed with an attorney and she mentioned that it takes less than 8 years even for Indians and regardless of which category we apply at. Please dont rely on Google search. Better contact an attorney.
Wrong and wrong. Getting work experience outside of the US and in India is much easier and can easily be gotten by nepotism. Therefore, lots of US companies don’t value work experience and internships that are outside the US or other western countries.
Greencard for Indians take almost 100 years, it isn’t just on Google, it’s everywhere. Doctors that have helped patients during covid haven’t received green cards in America. I’ve heard stories of Indian workers who’ve been in the US for 15 years and still have no permanent residency. The immigration attorney probably told you it’s 8 years to convince you that you should apply for a greencard and use her services so she can get money.
Confirming with an attorney doesn't prove anything. It's USCIS that takes time.

They do want to hire international students on OPT - they file for 30 to pick them to get 1 - whoever they can get! OPT is cheaper for company as company avoids paying a lot of employment taxes for the OPT employee - so it’s attractive to have an OPT employee and then H1B employee OVER a US citizen !!! It’s called taking jobs - it’s cheaper for companies to hire foreigners as they are cheaper and avoid a lot of employment loopholes! So H1B is intended for seriously positions that they cannot find - unfortunately what it has become is to undercut US citizens who are able to do the job at a higher cost to company! They import with fake interviews those from India who’ll live and accept the corporate bullshit - and pretend that they are the “best and brightest” ….. they’re not!
