  • The Employer Nominated Scheme (ENS) - Subclass 186 visa is a Permanent Employer Sponsored visa that requires a company to nominate you for employment. It is similar to the standard TSS (482), visa but the TSS is temporary. The 186 is permanent.
    You can also apply for this permanent visa anywhere in Australia, so Sydney, Melbourne and Brisbane are fine. However, you can only get nominated for this visa in certain occupations and if you meet certain requirements. It is not for everyone.

    WHAT CAN YOU DO ON THE 186 VISA?
    This visa is a permanent residence visa for skilled workers. It allows you to live and work in Australia, have access to medicare, include family members and may eventually lead to citizenship. The ENS visa allows you to work in Australia under one of two main streams. The stream I am discussing the Direct Entry Stream.
    The Direct Entry Stream
    This stream allows you to apply for to apply directly for the permanent employer sponsored visa. In order to apply for this visa
    • You hold a full skill assessment in an occupation on the MLTSSL
    • You have worked in the occupation at the required skill level for at least 3 years.
    • English test report (IELTs 6) in each band (or be from a native English speaking country)

    What is the Process
    The permanent ENS visa is very similar to the TSS visa, however the company is not required to become a Standard Business Sponsor. Only the nomination and visa application are required.

    Nomination:
    The company must submit a nomination application for the employee
    The employer must apply to the Department of Home Affairs to nominate a foreign employee to fill the position. Immigration will decide if the employer fulfills the nomination requirements.
    To be successful in nominating an employee the employer must demonstrate that:
    • The position that the sponsored employee must fill is on the MLTSSL
    • The employee must show the genuine need to hire a foreign worker
    • The foreign employee is paid at least the Australian Market Salary. That it, he is receiving employment remuneration equal to that or above that of an Australian citizen. This must be at least $53 900 + Superannuation (usually it is more)
    • You must have a full time employment contract for at least 2 years from visa grant

    Visa Application:
    Apply for the visa
    • After the employee has been nominated to fill a position, they may then apply for a ENS employer sponsored visa to fill the position. In my experience the nomination is the hard part. The visa is the easy part.
    To be successfully granted the visa the employee must demonstrate that they:
    • Possess the required skills, education and qualification to fill the position
    • Skill assessment and at least 3 years work experience at the required skill level
    • Have Competent English
    • Are of good character and health

    - Visa Application Charge - $4045
    - Training Levy Fee - $3,000 or $5000 depending on the size of the company
    - Nomination Fee - $540

    Visa Processing Times:
    This can vary but the current time taken is around 3 - 14 months. Please note, skill assessment can take upwards of 3 months to process as well.

      It could take considerably longer. Immi is processing a lot of visas very slowly atm

    Hi Nick, thanks for your video, was really helpful.
    In my case I have a been working as a Cook since 2017 and I'm working as a Chef currently fulltime and have 3 years plus experience as Chef since 2018. But I received my Cert IV in Commercial Cookery (Recognition Prior Learning - RPL) on Oct 2020. I may have worked more than 6000 hrs worked in Kitchen as Chef and Cook. I have a willing company to sponsor me with whom I'm working for past 2 years as a Chef.
    My question is do I still need a 3 years fulltime Chef experience post my Cert IV which was on Oct 2020 for me quality to apply ENS 186 Direct Entry System.
    Please advise.

      Hi, yes electrical Engineer is on the MLTSSL, so if you have a skill assessment you should be able to go for the 186 DE.

    Hi Mate, I'm in Australia on 489 visa and due to delayed processing time of 887 visa, I intend to opt for 186 visa (direct entry) as I'm have a full time employement in my Engineering profession. Do I just need to speak with the employer to nominate me. Will they give me a letter, or they will process my nomination and post receipt of confirmation I need to pay the visa fee, training levy fee and nomination fee all together or nomination fee first and after nomination the rest of the fees for applying visa.

    I have 2 years of full time work experience as a chef because of section 48 bar I couldnt apply for 482 I won AAT and I got student visa... now the government put chef in critical list so can I go for 1 more year under my employer and get 3 years of experience done then apply for 186 direct entry or just get 482 from the employer.... because my employer are willing to sponser me in both cases??

    Does the 3 years of experience have to be after ACS deducted 4 years? So I have 6.8 years of experience and ACS deducted 4 years out of it..So am I eligible to apply for the visa or I have to wait for it to be 3 years after the deduction?

      What occupation? Generally speaking it only matters on when you meet the skill level requirement (not when you do the skill assessment)

    There's something I don't find anywhere. Please, may I know if to be sponsored with a 186 visa as a chef, by "3 years relevant experience" , does it mean experience as a cook counts? Or not?     Hi just a question about 3 years experience.
    I’ve been working full time as a general hand, post qualification (cert 3/4 diploma in hosp) from
    1 April 2019 - 3 March 2021
    Then, i’ve got a positive skills assement from TRA as a cook/ chef dated 22 April 2020
    Currently, I’ve been working as a chef de partie from 8 March 2021 til present day under tss 482 visa.
    Am I eligible for ens direct stream to the same company or a differenr company? Thanks

      Probably not. You would need 3 years of full time post Cert IV experience in order to apply for a 186 as a chef

    Is it mandatory to work at least for 2 years with the company or once you get aproved the visa you get Pr and you are free to change jobs if wanted?
