The thought process behind SE trademark there was actually really logical, since it is on all screenshots and this was probably a screenshot at one time and SE says explicitly to put their trademark on shit if it involves such things as screenshots i can see the reason behind it. The rest of it is obviously hilariously against the ToS especially the datamined stuff.
Oh I can see the reason behind it, but I think because of the modded stuff, it's not exactly sanctioned by ffxiv/se, had it been normal outfits, non-modded, totally use it! I think I even said that much!
I want to think the GMs would chase the suspects like a 90s Cops show.
