    38:20 Residential is not different. Not with a drone. You can fly over gardens the same as you can fly over an industrial site. You do have to be more careful about where you hover, but where you point the camera is the key thing. You could be hovering over someone's garden by filming something in the distance on the horizon. But hovering some distance away and filming into someone's garden whilst someone is in the garden could get dodgy - but only when you publish it. The act of recording is separate from the act of publication.
    Now walking on residential property IS different to walking on other private property such as waste ground or a carpark or an industrial site. A homeowner can use reasonable (minimum) force to remove someone. But at an industrial site there is less of lawful right to physically move someone. Especially one without any security.

    • @Anonymousaudits

      It is different mate, you can't hover over someone's house like we do over commercial, yes fly over over but not hang about as per these audit videos.

    30:30 There is no public land in the UK. It is all privately owned, by someone or something. Anywhere you go you are always on private land. The key thing is whether that land is open to the public to walk on. For the public to be able to use it, it needs to be open and accessible by fee or otherwise. So any private road can be driven on by anyone. Only if it is gated is it a truly private road.
    Also, you do not lose your human rights by standing on someone's private property.
    The only thing that can be said is to be be asked to leave it, if it's reasonable to make that request. So putting one foot one foot onto private property means nothing and it would be unreasonable to demand the foot be moved. But if you were right next to a door way that said staff only and had gone down a path to get to it, then it would be reasonable to tell someone to move away. Force cannot be used unless it was appropriate to do so.

    • @BoronAlloy
      @BoronAlloy Před 3 měsíci

      Use of force becomes a legitimate action if the person(s) trespassing refuses to leave, which then raises their activity to Aggravated Trespass.

    • @TheSadButMadLad
      @TheSadButMadLad Před 2 měsíci

      @@BoronAlloy Not automatically. Refusing to leave that millisecond doesn't give grounds to use force. There has to be actual evidence that the person will stay on the land, such as camping or anything else that the time period will be hours. Even if force can be used, it must be kept to an absolute minimum. So blocking the path and directing the person towards the exit must be tried first. Then it can be escalated to pushing - gently. The key thing is that the force used must be proportionate and reasonable and necessary.
      Refusing to leave does not make it aggravated trespass. It can do, but again it's not automatic. Aggravated trespass is defined as Intentionally obstructing, disrupting, or intimidating others from carrying out ‘lawful activities’. That someone makes a choice to stop work (or even continue work if it's security) is their choice, they weren't forced to remove the trespasser. Especially if the trespasser has done the equivalent of putting one foot one foot on the private property. It should be noted that aggravated trespass does not occur if the place is empty at the time. That doesn't mean the whole property, just the place where the trespasser is.

    It's quite rife in the UK how the public don't understand the basics of what a crime is and isn't.
    It seems like a lost culture of ours.
    Glad to see an auditor actually engaging in conversation about it. And seeing how wrong they are. Then educating them on it.
    Other auditors don't even bother speaking about it. Which suggests to me they only know enough to do auditing.
    Focus Pocus is also very good at this. Because his goal is to see what reactions from the public we get. Regarding the lack of knowledge on law.
    Because that's what auditing is supposed to be about. Awareness of law. Not just making money. DJ & PJ etc seem to be making money out of it not educating the public on laws beyond drones.
