    Assessment of Mental (Psychiatry) Disability under Rights of Persons with Disabilities Act, 2016 (RPWD Act, 2016) is based on Indian Disability Evaluation and Assessment Scale (IDEAS) as per the RPWD Act, 2016.
    The term “mental or psychiatric disability” is used when a psychiatric illness significantly interferes with the performance of major life activities such as self-care, working, moving and getting around, understanding, communication, interpersonal activities, and participation. Further, attitudinal and environmental barriers hinder full and active participation of Persons with mental illness in the society on an equal basis. Mental illnesses continue to be underdiagnosed, undertreated, and underestimated in official statistics and discriminated against. This situation becomes worse with regard to providing care and social welfare measures to PMI in the low-and middle-income countries. Persons with mental illness face significant challenges during the assessment of disability due to the following reasons;
    Psychiatric illnesses are often episodic, fluctuating, dynamic and debilitating. However, for the purpose of certification, mental disability should be assessed when the psychiatrist is satisfied that further psychiatric treatment and rehabilitation is not likely to reduce the extent of the impairment
    India signed the United Nations Convention on the Rights of Person with Disabilities (UNCRPD) and subsequently ratified the same on October 1, 2007. The UNCRPD proclaims that disability results from an interaction of impairments with attitudinal and environmental barriers which hinders full and active participation in society on an equal basis.
    A person with disability “means a person with long-term physical, mental, intellectual or sensory impairment which, in interaction with barriers, hinders his full and effective participation in society equally with others”
    Mental disability cannot be seen, hence it is often called “invisible disability”
    In a notification released on January 4, 2018, the Ministry of Social Justice and Empowerment provided guidelines for the certification of the various disabilities specified by the RPwD Act. This document outlines screening, assessment, and certification procedures. The standardized tools to conduct the assessments have been specified and include the Vineland Social Maturity Scale (VSMS) for the assessment of adaptive functions and the Binet Kamat Test of Intelligence (BKT) or the Malin's Intelligence Scale for Indian Children (MISIC) for the assessment of intellectual functioning. In the assessment of mental illness, a clinical assessment by a psychiatrist, rating with the Indian Disability Evaluation and Assessment Scale (IDEAS), and/or IQ assessment by a trained psychologist must be carried out.
    The instrument is simple and comprehensive in quantifying mental illness disability. IDEAS was initially devised and advocated for four important psychiatric disorders: schizophrenia, bipolar disorders, OCD, and dementia. However, as per the Ministry of Social Justice and Empowerment, Government of India, gazatted to use IDEAS to assesses disability on five dimensions: (”Self-Care,” “Work,” “Interpersonal Activities,” “Communication and Understanding,” and “Duration”) and to assess the disability for all mental disorders. Compared to IDEAS, administration of the WHO-DAS 2.0 requires more time, and training of the workforce to administer WHO-DAS 2.0 is more difficult. IDEAS have been found to be very useful in the field for assessing mental disability. Hence, IDEAS is more suited to the Indian setting. However, IDEAS has the following pitfalls such as:
    a) It is not comprehensive
    b) It does not cover all the mental disorders
    c) Currently, it becomes difficult to compute the total duration of illness for episodic illnesses such as Bipolar Disorder and Depressive Disorder.
    Persons with Mental Illness (PMI) are often stigmatized and discriminated, which hinders their full and active participation in society. This is a much larger issue, especially in women, gender minorities, backward communities, and the poor and the migrated populations. Adding to the complexities, PMIs are often not aware of their illness, refuse the much-needed treatment and often are not in a place to exercise their rights. There is an urgent need to address this issue of attitudinal barrier so that the rights of PMI are upheld.

    Do epileptic patients have seats reserved in govt banking exams? Some say epilepsy has been removed while it still comes under chronic neurological conditions. It is contradicting. Please clarify this according to the latest RPWD act 2016 which will help us in obtaining the banking jobs under this reservation.

    Dear sir, Kindly refer (you may read) the Indian R.P.W.D. Act 2016 it is very weak and discriminatory . It recognises 21 types of disabilities classified into 5 main categories -
    (1) blindness and low vision;
    (2) deaf and hard of hearing;
    (3) locomotor disability including cerebral palsy, leprosy cured, dwarfism, acid attack victims and muscular dystrophy;
    (4) autism, intellectual disability, specific learning disability and mental illness;
    (5) multiple disabilities from amongst persons under clauses (a) to (d) including deaf- blindness.
    Three of these 5 categories of disabilities recieve 1 percent of reseservation each and the 4 th category has been merged with the 5 th category and together given 1 percent reservation , although the 4 th category should independently get 1 percent reservation since major population of disabled fall in this category . And above all this the major problem is that even the act which exists seriously lacks implementation for 4th category in most of the institutions and this act is vulnerable to loopholes being exploited by many .
    For example one of the most reputed institution Union Service Public Commission of India has not given reseservation for 4th category .
    Please take this issue seriously since worls's most deprived disabiled reside in India .

      Sir, my brother also took treatment in NIMHANS in august for days. He was bank manager but due to debt recovery pressure he lost his mental stability.       (As today 70 year old male came to opd demanding ID CERTIFICATE for her older sister for aadhaar card purpose)

    Thank you for your video Sir. My brother who has suffered from schizophrenia for the last 15 years was evaluated per the IDEAS scale in Noida district hospital and given a score of 6. A score of 7 is needed for the UDID certificate, which he was therefore denied. The test was conducted in an arbitrary manner with no qualified psychiatric doctor in presence. The reason the examining psychologist gave for score of 6 is that the disease is managed well and he is able to take care of himself and that he does not "deserve" concessions because he already has a job. I do not understand, how does a person who is mentally ill but has managed to come to a point where he can take care of himself now, get left out of the concession. Such a person can actually perform a job inspite of his mental illness.
    My question is: can any concession be availed with score of 6 in IDEAS scale?

    My son's disability was rejected on the basis that depression,ptsd,anxiety disorder are not included in the IDEAS Scale. Is it true that such mental illnesses are not included? He is suffering from the past 14 years and is on frequent medication during the entire period. But the doctors said that only current scenario is included even though he was admitted to ward a few months ago only and is currently on therapy as well.Can we get reassessment from another city or state?     Hello sir, I have 25% cognitive disability and I suffer from focal hand dystonia since 2017. I am unable to write with pen because of this. There is new ruling related to section 2s of Rpwd act in Vikas Kumar vs upsc ruling of Supreme Court. I request you to have a look and please provide some clarity about it. I haven't been able to use scribe despite the new ruling in any exam and I am undergoing treatment in Nimhans only

      Disability is complex and it is not dependent entirely on diagnosis. Diagnosis is just one part. My personal opinion - Since, one is applying under mental disability, irrespective of diagnosis (MDD or Schizophrenia) duration of mental illness is calculated from the day that person becomes ill(not the diagnosis of individual illness). This is my personal opinion.

      There is a separate category under RPWD Act 2016 called ‘Chronic Neurological Conditions’ under that it will be certified

    Thank you sir, I have a question for my long friend
    It going to almost 6 years since diagnosis of "bpd" current his diagnosis says F31, he take many medicines till now, still continuous for six years. Friend is studying he understands things while studying but gets mentlly tired. Should he apply for pwd certificate for his preparation of ugc net exam. Once three years ago he talked to his private doc who suggested there is no need. At present he still thinks same. He also thinks certificate will not allow be competent as normal people. Please suggest ideas it can be helpful

      As per the RPWD Act and rules … the competent authority assessing the disability across all disability are mandated to disclose rejection using .. Form-IX … Intimation of Rejection of Application for Disability Certificate… should be done

    Also sir there is confusion between Intellectual disabilities assessment as VSMS TEST is valid for 0-15 years only
    In such case what if bkt show different IQ and vsml shows different SQ?

      As per the guidelines - The tools that can be used for the same include:
      (i) Adaptive functioning: VSMS
      (ii) IQ testing: BKT/ MISIC
      Based on the above the diagnosis of ID will be confirmed. Based on adaptive functioning assessment, severity scoring will be done and disability for ID charted. One need to choose the above tests depending upon the age of the client, clinical assessment, availability of information, observation and comorbidity

      MR comes under intellectual disability. Vineland social maturity scale is used for assessment of intellectual disability (MR)

      Ms Aishwarya, IDEAS is for all psychiatric illness. Disability is not based on diagnosis but on disability. All psychiatric disorders are eligible for disability certificate

      Please discuss with your treating doctor because certificate is issued based on diagnosis, duration of illness, treatment compliance, treatment attempts, response to treatment, residual symptoms and disability occurring because of the illness

    Sir If a person suffers from a mental illness for a long period of time(12+ years) but he has good intellectual capacity and academic record, do the chances of getting a disability certificate gets reduced, even if all the other criteria gets fulfilled? Does having good academic intelligence diminishes the possibility? Thank you 🙏

      Academic capabilities are just only small part of the disability assessment.
      Like a person with locomotor disability or person with blindness … may have excellent intelligence or intellectual capacity but disability certificate is given for their disability
      Similarly, person suffering from mental illness (if he is a student) his academic performance is excellent his disability rating may decrease marginally (maximum 20%) but he is entitled for disability

    He also gone through ect, tried all type of medication and combinations of medication but none of them helped him to overcome this
    Can he get permanent disability certificate for it?
    His treating psychiatrist don't know about disability benefits

      Permanent disability is usually not given in psychiatric illness. Every five years reassessment is the norm. Unless, it is treatment refractory and very well documented, providing permanent disability becomes difficult

    Sir, I have OCD for more than 9 years but taking treatment for more than 2 years under a primary health care provider of Ramakrishna Mission Charitable Dispensary. I've been taking antidepressants for more than 2 years. I really have a hard time to cope with my disorder. I can not study with full potential.       @@AmitKumar-vk5is I haven't yet tried to get it bro. I will soon contact my nearest Government hospital regarding this. Currently, undergoing treatment and preparing for my exams. This disorder really decreases our speed and performance unless managed properly. I'm trying ERP on myself by taking tips from Ali Greymond's CZcams channel. You should consult a government hospital doctor regarding this. You should also go to Ali Greymond's channel to know ERP technique. She is a great therapist who treated herself on her own. Treat yourself and live a quality life. We deserve to live a good life. Keep on doing your recovery work. Consult a good doctor and take medicines if he prescribes.

      Yes. Disability construct is not based upon diagnosis. It completely based upon impairment caused because of any illness and interaction with barriers (environmental and attitudinal) for full participation

      Disability concept have been evolving and at present the understanding is to provide the disability certificate based upon interaction of impairment and barriers. You are absolutely right you can issue disability certificate to any of the psychiatric diagnosis. Considering the same ‘temporary disability’ was added.     Let's say a person was diagnosed of depression, anxiety, suicidilty, mood swings with on and off pharmaceutical intervention for 7 yrs.
    Then, a formal Borderline Personality Disorder diagnosis is made during hospitalization for suicidilty. Patient is unable to sustain employment at any workplace and keeps switching careers. It has been 11 years since start of psychiatric symptoms.
    My question is,
    What is the duration of illness?
    I find it extremely difficult to understand how DOI is calculated.

    Sir, i went to hospital for mental disability certificate for my brother he is suffering from mental depression Dr said by these prescriptions and treatment for disability certificate is not posibble. What he is doing he is not able to take the decision. Currently he is taking Naltima, Nexito, vantab, decorate 500 mg, zolfresh 5 mg. Please guide.

      Usually treatable conditions and alcohol/drug use are not certified. Please talk to your treating physician
      Only after adequate treatment, all possible treatments have failed and based on severity usually disability certificate is issued

      ​@@pravinpatel-pe2rh Depression is 90% curable but in some cases it is not treatable just like my brother. Also Depression is mental disorder/illness. My brother had salary of Rs 1.5 lakhs he resigns from service without any reason. Because he was not in his consciousness.
