With regards to Scarlett Johansson's Lawsuit seems like Disney has pushed back giving us a different side to this stating she has been paid $20 million and that discussion were had about the premier access deal with her contract, but if that was the case why would Scarlett Jo even bother with the lawsuit. Is it for more money or something else we are not aware of? Thoughts?

      It's so obvious that 2019 was intentionally built as Disney's peak year (financially). Lion King remake, Endgame, Rise of Skywalker, Toy Story 4, Aladdin... and then in 2020, almost no big movie. Iger wanted to go out on top, and he did.

    I don't think BW was a great movie - I think it was mediocre - but there is no doubt that the streaming service had an impact on tickets sales...she's right, they fucked her over with this move - if that's their new way of distribution they should include that in the contract

      Everybody knows Disney is a company. And everybody knows that a company’s first objective is to make money. She would have a case if they released the movie on D+ exclusively; but they honored their requirement to do a theatrical wide release. No one wanted to lose money on this. If BW was on its way to $1B and on D+, the lawsuit would have never happened. They are fighting over the carcass now.

The Disney family are shareholders and can't do much without support of other shareholders but they could've fought for that harder to be fixed under chapek and especially since iger was in charge. Chapek will do what he did to the park employees but with Disney+ talent too I expect

    I agree with John to a point. They’re not using covid as just a cowardly excuse, NO ONE saw a giant pandemic that would affect the world globally you can’t ignore that, and it’s not “cowardly” to try and create new avenues for people to see it that would make them feel comfortable. That being said Disney SHOULD have negotiated that with marvel and Johansson and her cut being taken by Disney plus must be addressed. Putting it out in Disney plus was not the issue, not negotiating it was the real issue

However, what she is claiming is that new subscribers decided stay home rather than sitting in a movie theater (hence not adding to the head counts for her bonus) and she wants a cut from these new subscribers who paid Disney. I think she is fighting an uphill battle about how much the movie and her name led to additional people registering for Disney+, especially given the pandemic and other shows on Disney, such as Loki released five weeks prior, that probably also added subscribers. I read a comment from a contract lawyer yesterday and this person was saying that Scarlett would lose if it goes to court.

    Rob says you get what you negotiate, and Scarlet did get what she negotiated. Per Variety:
    According to the suit, Johansson’s contract guaranteed a “wide theatrical release” for “Black Widow,” meaning the film would be shown on at least 1,500 screens. Johansson’s lawyers argue that everyone understood that to mean an “exclusive” theatrical release, under which “Black Widow” would not be available on other platforms for at least 90 to 120 days.
    She got a wide theatrical release on 1,500 screens. Her team is arguing that exclusive is understood...because it WAS NOT written in the contract as such. Granted, in 2017 this was not something that would have ever been considered, but still...it is not there.
    Courts will decide if that assumption is valid if it gets that far. But this is a legit legal disagreement with what seems like 2 valid opposing sides.

      The court will also have to weigh the issue in light of whether or not this contract breach affects others who worked on the film, correct? As I understand it, this lawsuit is pushing back and testing the waters for A LOT of the crew that worked on the films, and who are also being screwed

      I agree she deserves to get what she is owed according to what she and Disney agreed on, however on a separate note, I do think what these people get paid is an obscene amount of money, but then people make millions on only-fans for showing their feet so the whole system is just really bizarre.

      Rob actually read a better article on this topic on his channel. Her contract said theatrical wide release and her lawyers are saying exclusivity was implied/understood. That's not a strong hand. Disney honored their commitment to do a theatrical wide release. You remember last year when people wanted them to release this on Disney+ while theaters were closed? They literally could not without redoing her contract. Wasn't the movie also supposed to come out in March or April 2021 and they pushed it back one more time to try to salvage this thing? They basically didn't pay her off because they probably would have to pay off Stone, Rock, and Blunt too. It's unfortunate this went public, but this may be $100M+ combined additional compensation for all four of them at the same time the movies aren't brining in much money.

    This issue aside, my lawyer brain's first thought is (going with the assumption this is a public claim): what kind of a rookie lawyer does not include an arbitration clause, with an NDA on top of it, in their movie deal contract to ensure these things never see the public light?
    I mean sure, because of how big the topic is, someone on the inside might have leaked some rumors about it regardless, but they would have at least somewhat mitigated the PR damage?

      Except this sets a precedent for others as well... there are some really great breakdowns on the internet about how this could help the "smaller" employees as well, it's quite fascinating. The fact that you guys just focus on the money sum means that Disney's distraction tactics are already working, don't fall for it.

    An important thing to point out is that Disney gets most of the money from D+, a percentage of the sales in D+ isn't the same as a percentage from cinema tickets.

      @@griswoldclark6835 What you don't understand is that by releasing the film only in theaters it would take Disney longer to recoup their investment before profits that would kick in the backend deal Scarlet was hoping for. She didn't even wait for a China release for this absurd argument. By going D+ and theaters it's a win for everyone especially Disney because they can recoup their investment quicker and they are still giving Scarlet bonuses off Disney plus Premier Access. What else does she want? Because moviegoers are not repeatedly viewing films. Look at every film released. Fast 9 was saved by China.

    If she sues Disney, it could be devastating for us as consumers. Then more actors will sue and Disney will have to make fewer movies or TV shows, Disney will not see Disney plus as a money maker. Which in turn will cause them to lose subscribers. I think Disney needs to get dirty as she did her. Look how many great performances has she done before, not many in my book. Sorry, it's true, and Disney needs to win this one!! I think this was a big mistake for her to do. I been acting to back in the days. And i must say you need to look at the bigger picture here. She might lose all over this, i would think what is coming down the road of films she will be in. If she loses well i think it bye-bye for here

    This reminds me of owners of sports teams feeling like players should be happy with making millions of dollars & to not want more money in a contract renewal. Casual movie & sports fans might feel like actors & actresses should be happy with making millions of dollars & to not want more money. I do agree that future contracts must include streaming right that could occur at the same time as a theatrical release.

    Where Covid come into this, from what I understand, is that Johansson is saying them releasing the move on premier access at the same time as theaters that it cut her out of some profits based on what it makes (or could make) in theaters, and what it makes in theaters is less because it's on premier access, and it's on premier access at all because of Covid.

    Disney, as most big corporate companies, behaves like a big bully. Maybe Chapek is handling the PR worse, but Iger was no saint either. I remember a very bullyish behavior from Disney towards Tarantino and "the hateful eight" not that long ago. I'm not trying to diminish the bad direction under Chapek, but I get the feeling Iger's run might have been not so different if his hadn't been the years of plenty for Disney.

    Disney is trying really hard to spoil the image of Scarlett Jo by making people think that she is too greedy for money which by the way is very unprofessional from their side because she has been a part of many successful disney ventures which amassed billion of dollars at the box office, so I don't think she did anything bad by suing Disney over this issue. I really think she deserves to be paid and respected just like other male celebrities who have worked with MCU and Disney and earned millions of dollars as profit

      If she made 20 million dollars on a 200 million dollars box-office, then she would've made a lot more without Premier Access. F9 and Quiet Place 2 dropped 30%-50% from previous films, and Black Widow's estimation was 800-900 million dollars. So it would've made 400-500 million dollars in the pandemic, giving Scarlett Johansson 40-50 million dollars.

    The covid reference is because it affected the release strategy. The response may be crappy but it isn’t incoherent. Their “desire” was a result of covid. It sucks for Johansson but nobody was excited for that movie, it got okay-at-best reviews, and people are not eager to go to movie theaters.

    Kevin Feige has the cards here. If he opted to stand alongside Johansson, cash in his chips and threaten to leave the Disney table, that would have a serious effect on the landscape. The question is whether or not Chapek is idiotic enough to call his bluff, and whether or not Feige would in fact be bluffing. The only reason another movie house wouldn't want Feige right now is they couldn't afford him. Feige doesn't need Disney anymore. Disney needs Feige. He won't do that tho, cuz he doesn't really stand with Johansson. He's just putting on airs. He's never been on her side, or we woulda got Budapest ten years ago. This will be settled out of court. A whimper and not a bang.

    Anthony Mackie at a comic con years ago said that in the 80s and 90s it was Stallone film, Schwarzenegger film, A Snipes film and now it's no longer the actors film but a franchise film now with the MCU. The character becomes a bigger star than the actor/actress portraying it which kind of sucks. I just hope that the Disney Plus premium access ends after Jungle Cruise.

    This is an interesting scenario because I could see this going either way. Disney TECHNICALLY has fulfilled their part of the contract. The box office is what it is. And that’s how the cookie crumbles. On the other hand, it is crystal clear that the box office was hurt due to the Disney+ Premium Access release.
    It’s all going to be about Scarjo proving actual losses. If she can do that past 50% belief (which isn’t unreasonable), I think she can win.
    What I know will NOT happen is a settlement. They can not afford to settle this. If they settle, they will owe every other actor with these provisions the same percentage cut they paid to Scarjo. If I were Disney, I’d take my chances and continue to point out that my part of the contract was fulfilled.

And what would happen if a person steps down what would happens to the contract when a new person comes in if the original agreement that was signed as Scarlet Johansson & Bob Igor would that contract be voided when he stepped down?
