SCA hears state appeal against Pistorius conviction

  • The Supreme Court of Appeal in Bloemfontein hear an application by the National Prosecuting Authority to challenge Oscar Pistorius's culpable homicide conviction. In 2014, the Blade-runner was convicted of shooting dead Reeva Steenkamp on Valentine's Day in 2013. The state believes Judge Thokozile Masipa erred in her application of the law when handing down judgment.

    We only have Pistorius' word that
    He thought he was in danger and thought Reeva was in the bedroom - how can they be 'factual findings' ???
    Are courts always expected to believe the testimony of people charged with crimes or is it possible that the accused will tell lies to protect themselves and evade punishment ?

      I believe that too - didnt believe his statement of events AT ALL !!! - however the prosecution were unable to prove it
      They hopefully have during the appeal shown that firing four exploding bullets into a small toilet is deserving of a murder sentence though

    It's a cold day in hell when people can get shot for going to the bathroom. It's a cold day in hell when you can shoot through walls just because a noise was made. If people get as scared as Oscar did, they need to be put either in prison or in a nut house. There's no excuse for what he did. Find your loved ones before shooting through walls. Show some balls. If he's moving fans and he can't figure out that she went to pee than he's crazy. It can't happen. He knew it was her. He found out that she was leaving him for a man with legs and balls.

      +Jennifer Adam One thing they seldom mention is that Oscar lied his ass off. It was obvious that he was lying. He kept add things to his original bail. He made up the window sliding open and later add the slamming. He made up the door slamming and changed the whisper to a low tone. He said in his bail that he went onto the balcony to get 1 fan and changed that lie. Everything he said was a lie.

    Whatever happens in this tragic case I hope that Pistorius has to return to prison
    I cannot find any sense of justice in him spending less than a year there before being released into a life of luxury at his uncle's mansion
    South Africa needs to show the world that it's judicial system does infact deal in justice - for Reeva - her family and friends - and for all the less privileged convicted who are facing harsher punishments for much lesser crimes

    I'm sure not even Barry Roux believes what's coming from his mouth when he argues Oscar's state of mind. If Oscar is so overly anxious, why did he go to sleep with his balcony door open and ladders stacked on the ground below it and why did he leave a broken window on the ground floor unrepaired?
    Furthermore, not only did he have a housekeeper on site, but his property was being checked hourly by security guards. And to top it off he's never been burgled, so if he is as overly anxious as Roux claims he should have been in a secure psychiatric unit, because he posed a danger to the public.

      +Keamogetswe Letoaba not for man in his physical condition. For a man without legs Defense proved its equal to having like a PTSD and the psych report proved he had hyper vigilance problems and was constantly with a gun prepared to shoot because he had no legs to stand his ground against an intruder. Pistorious has to live with the guilt he negligibly didn't check for Miss Steenkamp in the dark when he heard a sound.

    Unfortunately judges do not rely on their emotions when arriving at their decisions. Im not an expert in this Law thingie ... I cannot give educated or well informed analysis on legal issues.... I do know however, that... unlike us ordinary or lay people, who rely on our emotions to judge situations, judges do not do that. They rely on admissible and tangible evidence. They look at what the law says, and apply It to facts placed before them.

      littleollieowl You flatter me...thank you! I had it correct didnt I though. I may not be from South Africa but I called it correctly and only reported the released information. I do have a legal background for advocating for victims. The Superior Court having now found Mr.Pistorius guilty of "Dolus Eventualis" meaning for a variety of reasons Mr Pistorius should have foresaw he placed whomever was in the toilet closet in imminent danger with his pistol loaded with a specific ammunition and should have foresaw death would be a possibility. Thus meeting the criteria for murder

      Carolyn Porter​​​ Congratulations on back tracking! You thought that nothing would become of the appeal. The legal basis of appeal -Dolus Eventualis was flawless. All you kept repeating over and over again was that he has an anxiety disorder and that he was hypervigilant. There are 100s of thousands of people with anxiety disorders, they don't shoot indiscriminately into doors!
      'Advocate for victims', well you certainly haven't 'advocated' for Reeva! All your comments prove to me is that perhaps you are a mental health nurse. If you were legally qualified (as I am) you wouldn't spout such disputed garbage and with such conviction! Most of it you got from Annette Vergeer and a psychologist paid for by Pistorius. That evidence was met with huge scepticism by the judge. Seriously you suffer from the Dunning-Kruger effect as someone else mentioned on here. Although that isn't an excuse either for discharging a firearm! Don't be flattered honey. Just be honest, state your opinion but don't spout it as if you are the oracle.  p.s Yes, 'applying the law' is a better phrase than 'evoking the law'. It was the way it was stated in law school to me. You know, the place you think you went to.

      I believe Roux got the Defense strategy wrong but where could he go? There's a reason Mr Pistorius shot into the door. His Psychological report certainly lent itself in a direction where Pistorius is a compromised individual.
      You also have it partially wrong....once Roux erroneously put Dr Merryl Vorster on the stand to testify on how Pistorius suffered from GAD was crying and genuinely upset etc he opened the door for Nel to then say well maybe the Defendant should be tested and thus Masipa commissioned and ordered such to be done independently at Weskoppies Hospital. So not all was bought by his team. Get your facts straight.
      I have attended law school but didn't complete due to my having a physical disability. But my work throughout the years provides experience in the field. Beginning with the reason for my advocating work which are for Domestic Violence as one who suffered and endured Spousal abuse. As well as I also come from a family who suffered a great loss as I lost my grandmother and my uncle to murder suicide. So my opinions are valid to me and I'm entitled to my own opinion. Thank you!
      This case was plagued from the likes of Botha in the beginning and the botched police work during the investigation. I stand on my opinion and base it on the findings of the report and some of the Prosecution's own case in chief. We know Prosecution doesnt have to provide motive but Nel went to great lengths to try didnt he? For example in over how many 1000s of texts and the like he found 1 argument and his own witness testified he found the reading to be that of a normal couple.
      Nel had to reverse his position about Pistorius wearing his prosthetics. He also lost the argument about the jeans.
      My bottom lines are....again sorrow for the loss of Ms Steenkamp and for her family. Sorrow for the Pistorius family and the fall from grace. I do not believe Pistorius meant to kill Ms Steenkamp or anyone. I just believe he is a paranoid, hyper vigilant individual and those like him who are vulnerable to the point they feel no recourse but to own a gun and just go shooting into doors because he hears sounds and is negligent in seeking out the causation is just negligent and it unfortunately led to a death.
      We shall see what is next....to be continued!

    What i have noticed about SCA is that when an Attorney or Advocate appears there must be well prepared in all aspects of the case.....Statute, case law, reasons provided for decision and the facts. 28/9/2022 note made .

When you hear a noise, everyone looks at their significant other and when they can't find them, they assume they are in the toilet and all ends well. Oscar is lying. He knew she was in the toilet. No one hears a noise and goes ballistic like Oscar said he did.

      +Susanne Müller It takes 2 seconds for a person to get out of bed and go pee. Everyone in a family goes to a toilet without asking for permission or without telling anyone. You have to see,feel or touch your family members before making an idiotic decision to pick up your gun and start shooting through walls and doors. My wife go to the toilet all the time and I always hear noises in the house. I have never panicked and gone ballistic. My loved one would all be dead if I did what Oscar did. He's lying and he's missing his balls as well as his legs. All the evidence shows that he mentally abused women when people weren't looking and then he finally killed one of his female victims.

    I am grateful that South Africa has recorded this for us. However, I feel very sorry for the lawyers having to wear all those English Legal Robes in such a very hot country. In the West Indies, I believe that Barristers are allowed to dispense with those robes and wear appropriate lighter clothes in order to cope with the heat!

    Justice Leach gives a great 3 minutes of verbal take down of Barry Roux.( 1:47 to 1:50 must listen to CZcams) He uses his words as quick fists to jab this money hungry advocate, Barry Roux and teach him a school lesson in law in this case. No harshness, just swift jabs to make Barry squirm in his shaking pants. Let's hope justice will be served for Reeva and her family on the sentencing by the trial judge.

    I find it ironic that all of the "factual findings" that Barry Roux quotes aren't actually factual. They're based on Pistorius's lies that, perhaps, could not be disproven. The gunshots, the death or Reeva - these are factual. "Pistorius thought his life was in danger" is only a claim made by Pistorius, whose testimony has been widely regarded as unreliable, inconsistent and based on a series of unlikely circumstances that are all required to make the story possible.

    The point is Masipa believed he shot into the door out of fear which makes him guilty of shooting but the Prosecution has no proof he intended to murder Miss Steenkamp. There also were 2 cases precedents.

But in this instance he fired without aiming? So it was just bad luck that besides Bullet B, each successive shot was more accurate and deadly than the last?

The whole point that nutty judge got wrong was abundantly clear - it did not matter if he intended to murder Reeva or not - the point is that shooting 4 times into an enclosed space indicated he intended to murder someone - persona irrelevant.       +Eze Nwosu The bedroom wasn't even that big, the distance from the bed to the balcony door was only about 1 metre! How he could make a return trip from the bathroom back to the bedroom, fetch a gun from the bed she was supposed to be lying AWAKE on and not see or hear a word from her is just too staggeringly implausible.

    Oh my, the Justices just said, "it didn't matter, he shot at the person in the cubicle and it turned out to be ""poor Reva""" oh my goodness, he's team Prosecutor. Lol now I understand, its' about time someone actually listened to the evidence. The original judge picked just one of Oscar's reasons for killing Reva and ran with it.

Who knows, maybe the 1st shot was intended only , but then at the critical moment he may of thought 'i cant leave this here i must finish the job so as to never have to become face2face with Reeva knowing what he done and also knowing that she fully well know he meant to shoot at her after an arguement.

      Because culpable homicide conviction rested on parts of Oscar's evidence - even though he was deemed a "poor witness". The argument is that his evidence was actually "impossible" because of circumstantial evidence ignored by trial court. If that is the case then his version should be set aside completely - including all the stuff about him being scared. Because no independent evidence of how or why he fired shots. It would simply turn on the firing of bullets through a door into a small space.
      SO circumstantial evidence still relevant in strengthening Nel's argument that Oscar's evidnece should be ignored completely - and form no part of the judgement.

    In this case, the fact the Prosecutor has to go to the Court of Appeal leaves me with little faith in SA Justice. One can only hope they get it right second time around

I can think of many cases in my own country where it took campaigners years of campaigning to get dodgy acquittals and court rulings overturned.

    Defence is there to ensure State has a case .When defends starts getting aggressive it’s a sign their argument is not robust . It’s not Roux ...he merely doing his job that is in all our interest . What is left here is the ability for the accused to navigate around ridiculous actions in a scripted manner ! If he is found guilty it is clearly premeditated as he had already had an alibi as he came down carrying her body and saying he shot her cos he thought she was the intruder....he was able to take stock of the enormity of his situation and create his defence on the day of the crime !

    I think that the prosecuter made a mistake from the beginning.When OP said the shooting of Bullets were an accident or he shoot in fear of his life uncontroled at the Toilett door he should mark a circle of all for shoots at the door.Shooting for shoots in rapid sequence uncontroled or in panik or fear could never be in a so closed circle of target

    A lot of people jump into conclusion that Oscar deliberately killed Reeva, and do so with conviction. I have a hard time believe so. I think the reason why they jump into this conclusion is because of the prosecutor skills. It is hard to explain your mental state or why we act a certain way, especially with this prosecutor. In my opinion, it is not fair to conclude that he is guilty because he contradicted himself. I wonder when would you believe an accused did not act erroneously. If I was in his position and believe there is imminent danger, I would not count how many shots I would fire. I just feel sorry for this guy because of the way people inherently think an accused is a liar and want to escape prison.
