      so...there is a group of jackazzes that have been "zoom bombing" courts across michigan with short pornographic clips that just pop up...judge disanto's court was hit this morning and has been a frequent target of their attacks and it appears her channel was taken down mid stream...hopefully she is back on line in short order! was watching when it happened...

      Actually people do this all the time especially to women(mothers/teachers/girlfriends). They trying to trigger a “fawn” response. He wanted her to prove she doesn’t dislike his client by giving them what he asked for.

      I would think that most if not all states have rules of ethical conduct that would be violated if an attorney knowingly makes false statements about the integrity of a judge, in particular publicly and on the record.

      That “you don’t like my client” accusation was a common strategy to try & trigger the “fawn” response. If he puts her on the defensive she’ll give him what he wants to prove she isn’t biased and win his approval. You see it a lot from guys who expect women to want to appease them/care what they think. It’s in the same strategy family as negging.
      If you notice when they’re going over the schedule conflict he also referred to the other judge as MISS once instead of JUDGE.
      So yeah he probably doesn’t think he’s sexist, but it’s there.
      Along with his assistance that he’s “clarifying” as though it’s her who didn’t understand what he said. Very Mansplainy

      I honestly don't think the communication issue is on his part. I don't think she is smart enough to comprehend what he is saying. She misunderstands so many things and then goes full Beotch mode so quickly. Very poor judge. She changed the time on him, he missed it, and she is going berzerk. Angry woman.

      He screwed up long before walking in to court today and had likely already pissed off the judge before asking to do zoom. When DiSanto went over the exact wording of the email over the schedule it was made crystal clear that he was supposed to have filed his briefs by Dec 14th since the email was sent out on the 5th, but didn't actually file the brief until the 18th and then sent a second one on the 20th. Part of the reason for ordering the filing of the brief early is for fairness - so both sides have time to fully read and understand what is in the brief. This lawyer putting things in so late was him trying to pull a fast one over on the AGs office. He's either trying to give his client the Lionel Hutz treatment so he can claim incompetent council or he's as dumb as Lionel Hutz. His words and actions today make it seem pretty clear like the latter.

    This would have gone so much more smoothly for him if he had just said "sorry" at some point... He had real difficulty just stating clearly that he had made a mistake and apologising for it.

      Seriously. He got an email changing the date and time. He changed the date and forgot to change the time. Not great, but it's just a mistake.
      "That's my fault, your honor, and I apologize. What can I do to make sure my clients are represented in both cases?"
      Instead, he argues about whether he saw an email and whether the judge hates his client.
      When you're in a hole ... stop digging!

      Start at 2:20, go back and listen to it again, slow it down if you need to but to me it sounded like he was saying she didn’t like him to zoom in. She interrupted him in the middle of what he was saying so she only heard part of it.

      @@Lwah0812 I've listened to it a few times. It sounds like the attorney says "My client's out of town, you don't like him so you won't let him zoom in, that's why you declined zoom." The Judge responds, "You said I don't like your client, is that what you said?" "Well, no, I shouldn't say that." So, maybe the Judge misheard the attorney. But, if she did, why does he immediately admit to saying it? Why doesn't he say, 'no your honor, I said you don't like him to zoom in' or 'I know your honor prefers these types of hearings in person' or really anything else besides, "I shouldn't say that."

      he told more than one lie. he implied he didn't notice/read the email setting out the date and time, giving his failure to respond to it as indication/evidence of same and he inflated the importance of the conflicting proceeding by characterizing it as a bench trial , as opposed to a prelim exam, since the former would be more easily adjournable than the latter. he's fucked

      He had screwed up before even getting into court that day and thought he would just get what he wanted without any effort. He ignored not only the time of the hearing but also the filing deadline of Dec 14th for his briefs. Filing those documents late only prejudices things against the state because he had time to read their documents and formulate a response before they got a chance to even see his stuff. Filling a second brief the day before trial is a sure fire way to piss everyone off since now the AG's office has to scramble and try to parse whatever he submitted hours before the hearing. Even if he only filed something that was one page long it may require them to spend hours to look up and provide the case laws that refute whatever is mentioned.

      That’s what lawyers are good at, spinning the details in hopes someone forgets the truth. My opinion is that the client wasn’t showing up so the lawyer was trying to bide some time to get the client to court. Was the defendant able to leave the state? That defense attorney better get paid and well.

      Yeah, I think she misheard him on the "you don't like my client" thing, but he definitely was saying bench trial on purpose to try and pressure her into granting his request since the court usually will defer to the higher priority hearing on conflicts. He also did a terrible job clarifying his statements in regards to the "don't like" situation.

Defendants appear half-dressed, laying in bed at home, rolling their eyes and gesturing, muted; witnesses eat and play with the dog; attorneys, seemingly distracted, fail to control their clients, appearing to conduct outside business during testimony. This practice of out-of-court appearances, albeit necessary during the pandemic, now prevents judges from protecting a defendant's constitutional right to a fair trial under the 6th Amendment. Without personal appearances by all parties and counsel, together with the requisite judicial temperament to maintain decorum in a charged courtroom, Lady Justice herself becomes our sacrificial lamb.⚖

    The fact he states he "hoped" the other matter would be bound-over/finished with shows he was aware of possible conflict. Conciousness of guilt, isn't it when suspects use words that imply foreknowledge?

    Most of the time, I get aggravated w how much Judge DiSanto let's ppl disrespect her w constant interruptions but she didn't tolerate it from this attorney! I'm glad. He was so patronizing and couldn't just shut his trap to end the drama. He just had to keep getting the last word

    That attorney shows zero accountability… damn! Making excuses and either legitimately confusing distinctly different trial settings(?)
    Or intentionally jerking the court around
    If it’s option, number one, I worry about the attorneys competency, and if it’s option number two, I worry about the attorneys competency, integrity, and literally everything else.
    Not to mention th “confusion”
    Over the time and date. Confusion is unlike likely as the story changed so many times
    No matter what, not a good look for this attorney today.
    I’m not surprised that the judge got mad. The reprimands were absolutely necessary.

    It's clear he blew it off, and he saw the email. What a jerk. If you screw up, you screwed up, go there, and tell the truth. The worst that can happen is nothing worse then would have happened. But, to go in a lie is just Stupid

    Man what a piece of work. Mis-remembered 😅 so many things. And yeah, he said the judge didn’t like his client. I call flat out lie about the bench trial versus the hearing. My jaw dropped as soon as he changed the reason for the hearing. And the cherry on top was the fact that he requested that the other hearing be rescheduled from 8:30 to 11:30. If he had paid attention and left everything alone all would have been fine. I actually feel bad for the plaintiff as the judge is not happy with his attorney.

    I've said it before and I'll say it again - I don't know how Judge DiSanto puts up with this. She gets FAR more than her fair share of shit from defendants, lawyers and anyone. I really admire her abilities and tenacity.

      @@crunchyfrog555 And she's married, so there's that too. But, Judge DiSanto is probably one of a handful district judges in Michigan you don't want to piss off (Judge King in the 36D, Judge Simpson in Washtenaw and Judge Middleton are also at the top of that list).

    Even if Mercier is right (and she doesn't like his client), you don't say that in open court. Also, here in TN, the attorneys ask one another "What is this judge like?" You figure out quickly certain judges are prickly and strict. Nobody here would have done this.

    Love ❤️ the commentary you made in the annotations over the video in that it was so incredibly balanced and fair to *both* the judge and attorney. I like how you are able to see both sides’ positions and be equally-handed in finding favor or fault to both sides - no bias here in this case 👍 which is refreshing since most channels pick one side or the other and make it obvious in their commentary.

    He’s incapable of describing the court in any non-sexist capacity. Always these coded language like “upset the court”. The court is not upset. The court is speaking to you in a professional and corrective tone. There is no emotion, you keep seeking emotion and projecting emotion, whether there is none.

    Oh boy, I bet he regrets saying what he said! How do you think a judge is going to react when you tell her that she's making his client appear in court because she doesn't like him?!?! Come on buddy! He should have tucked her sctail between his legs and just apologized instead of trying to argue with her! Also, it's not the judges fault that you didn't read the email correctly and you didn't change the time! My guess is, he was planning all along to come in and play stupid about the time and askbif the case could be adjourned again. Then when the judge shot that down he got mad and made that comment out of frustration. Well that led to really p!ssing off Judge DiSanto and she was NOT letting it slide. I'm glad she took the time to contact the other judge and put him in his place! I want to see the hearing at 1 pm! That should be very interesting!

    He put himself in a bind. If you listen to what he is saying he is in the third day of another case. So he double booked himself in the first place, Then he went to the other trial still believing that this trial was at 8:30 a.m. and changed that one to 11:30. If he would have stayed with the other case at 8:30a.m. he would have made this one without a problem. He screwed himself by thinking he was being clever.

    At first, i kinda felt bad for the attorney because of hard Judge DiSanto was going on him. As it became clear that he was pulling wool over her eyes, in retrospect she was extremely kind and patient!

    This Atty has been in this court before Judge D before and he does have an attitude issue. Now he gives her 3 or 4 different stories and keeps digging the hole deeper. I love Judge D because she doesn't let egomaniacs walk all over her but she also tends to allow probation violators to walk all over her. If you're going to hold an Atty accountable, do the exact same thing with defendants.

    I have seen similar issues in other courts. Judges DO NOT like it when someone comes in and asks the judge to mess up their docket because they made a mistake. Judges are not into it. All that said, this attorney really fucked this up right out of the gate. You are asking for a concession, you don't go in hard on the Judge when you need a favor of the court.
