Can the employee leave earlier if they complete the turnover before the 30 day period?

  • If the employee resigns and they've completed the turnover, are they required to stay?
    How can they leave even if the 30 day turnover isn't done yet?
    A lot of resigning (or about to resign employees) have this on their mind just like our reader, Kira, who asks:
    "Atty, I have recently resigned from my job due to family matters and conflicts. I gave the resignation letter to our manager on the same date. I also endorsed and turned over all the files to my co-workers. I asked my boss if I can just render a 1 day turnover, to which he said no. I said that I won't come back anymore. Can I do that? Can I still get my COE and final pay?"

    Hello po. Question: If I suddenly got I'll and file for sick leave while on rendering period and then I presented necessary papers like Medical Certificates and Fit to work form when I got back, does it affect my rendering days like they will add up again the days I've been sick to the days of my rendering?     Good day po Atty. Ramon & Atty. Erwin. Ask ko lng po, may VL & SL papo ako na di na gagamit. Pwede ko po bang gamitin yun habang nasa 30days turn over process po? Tas tuloy2 na umalis after 30days. Palagay po natin na in a week po nagawa na po ng maayos ang turn over.

    Good afternoon, ask ko lang po nagfile ng closure ang company ko ng Feb. 20, 2022 then may one month turn over sila until March 22,2022. Nagresign po ako ng March 4, 2022 entitled pa din po ba ako makakuha ng separation pay? Thank you po

    Gud am po...retired mun. Agriculturist for 16 mos. Ayaw pong ibigay terminal leave pay ko dahil may hinihingi po silang dokumento n makikita naman po yon s filed nila s opisina nila. Pinagoath of undertaking n po nila habang aayusin ko yong mga sinasabi nilang dokumento. Binawi po nila yong oath at hi di n raw po pwede. Tama po b yon, para pong nanggigipit sila.

    I would like to clarify about the Penalty for Late Notice of Resignation. I checked my contract and I saw there that the penalty will only apply when my contract is effective. It was already extinguished last May 31 and I sent my resignation on (July 11). Do these terms can be enforced since the term is already expired?
    They asked me to pay for 20,000 as their penalty.
    Hope you can clear this out for me. 🙏

    may i ask if my wife can resign while on maternity leave and use her remaining 30days leave as a notice of resignation? does the company can insist the 30days render?

      Depends on the company if they will allow it. Again, the purpose of the turnover is to TURNOVER. Mahihirapan po mag turnover if she's not there. Talk the company po so you can come to an agreement which works for both parties.

    Hello po, What if the employee got sick 7 days prior to the 30 days rendering period last? due to COVID19 employee was not able to finish the 30 days rendering period. Is s/he will still be penalized by the company and is not entitled to final pay? Even if med cert is

      Best option po to coordinate with the company para po matugnan yung buong 30 day turnover period. That way, walang magiging issue.

    I respect the word "malasakit" for my employer so i will give 30 days transition to them. Ang reason ko bakit ako mag resign is lack of compensation, I work 3 years as a installer/team leader with a provincial rate since the company is in Rizal, pero yung mga site madalas nasa metro manila po, hindi din pare-pareho ang rate namen mga kapwa ko installer nasa 480 per day lang ako, yung dalawang installers na kasama ko 500 and 550 sobrang unfair sa 3 years ko sa company napako na yung rate ko, i don't like bringing up to my employer bakit ganon. Gusto ko kase sana mag kusa or mapansin man lang nila na wala sila increase sakin (or wala tlga sila balak mag increase sakin) so i decided na mag pasa na ng resignation this month. Madalas pa laging OTY ang mga o.t feeling ko nag aaksaya lang ako ng panahon sa kanila, 3 years without enough compensation tingin ko dapat lang na layasan ko na sila

    Sir pde po ba mg overlap un date of employment eg last day July 30, start date sa new job is July 27 pero illeave ko na po un 3days sa previous job.

      If pumayag naman yung employer mo, I don't see any problems. Yung leave kasi, depende sa system ninyo. Generally, discretion po yan kung papayagan ka. Hope this helped!

    Good day po atty what if na-endorse ng for regular employee pero wala na balak mag go sa pagka-regular. Pero willing naman tapusin yung contract kasi days na lang din naman at matatapos na ang contract pero nag insist si employer nang mag file ng resignation letter 1 day before yung end of contract day. Then pinapalitan yung date sa exact date ng endo, mavo-void po ba yung resignation letter since pinabago yung date (into original end of contract)? Thank you po.

      Magulo po ang usapan ninyo. I recommend that you make it simple. Wag mo na tapusin yung probationary period kung ayaw nyo naman, then just resign properly. Coordinate this with your employer para wala issue.

    eh paano kung hindi nag bigay ng clearance form after ma sauli na ang mga uniform at id tapos walang payslip na bini bigay unang payslip at iba pang payslip ng suweldo tapos na hingi ng certification of clerance ayaw mag bigay binigay lang kapirasong yellow paper nana ka sulat na need clerance to be cleared at after 4 months after clearance maku kuha ang last suweldo at 13th month eh wala ngang pina pirma sa employee na clearance wala ding binigay na copy of clearance pero na record sa video na na accept na ng hr ang uniform at id para evidence at lagi pang nag papa extend ng 30 minutes without pay na sa schedule pa nila na 30 minutes extend all opening for strictly compliance at noong december nag bigay ng schedule na cancel day off daw strictly compliance daw at ang schedule nila sa messenger kaya pina screen shot ko na para evidence bago nila i delete ang gc na ka 9 na 30 minutes extend hindi bayad at sa suweldo ibang ot hindi bayad

    For clarification lang po sana, kasi galing po ako ng corporate world then natanggap po ako now sa isang government agency. Bale hindi ko na po natapos yung 30 days na pagrender ko kasi pumayag naman po previous employer ko na gamitin ko na po yung mga leave ko para mapunan po yung 30 days.
    The question po is, bawal pa po ba ako ideploy ng government agency na papasukan ko po hanggat hindi pa po tapos yung supposedly last day ko po sa previous employer ko po?
    Then kapag po ba sa government agency, yung COE ay pwedeng to follow na lang po sa kanila?
