      I disagree with the ruling. I think he should have gotten his money back for the initial tow not the return tow. If another judge said there is no curb then how does the tow company keep the money? He should have gotten his money back and the tow company should have to chase NYC. The plaintiff is the one left holding the bag for their mistake.

    The past 22 years living at my property, I had over 2 dozen times my drivewy blatantly blocked. Vehicle has to be summoned first by either Traffic enforcement or NYPD before it can be towed at offenders cost here NYC. Its absolute hell if driveway blocked after 4pm and on Sundays because traffic enforcement no longer on clock in my area so NYPD takes FOREVER, obviously not a 911 priority. I always take pics all angles of Vehicle in reference to driveway. Of the 2 dozen times I only had 1 instance where owner came a hollering next day and quickly did a 180 when I showed him the pics. His wife parked the Vehicle and told her husband that she didn't block driveway.

    New Yorker here: yes active driveways are a thing in NYC. If someone goes to the city and requests the city cut the curb in a spot that was not a driveway previously you will see ‘active driveway’ signs. Alternately people with driveways will post active driveway signs to deter drivers from parking.

      The plaintiff has the burden of proof initially. 🤷🏾‍♂️
      Defendant didn't really have to justify the tow until the plaintiff proves it was an illegal tow. Even with that letter, clearly he had the wrong defendant.

      I’m from Queens New York and there is such thing as a active driveway sign I guess to influence people not to park there such as if it has a gate or if it doesn’t look like it’s a active driveway for some reason but it is or maybe it’s not but the owner just doesn’t want people parking there they can put up a sign that says active driveway.

      Some don't look like driveways, especially in busy cities. And some look like a driveway but may not be. I.e. it's a slot in front of a home but doesn't have a city permit for parking on it. You can't just make your own driveway.

    Very rare to successfully sue a tow company. They have far too many hoops to jump through to be in compliance with licensing laws and regs.

      It's hard to believe because the cops issued a ticket which means they were on scene and saw that he was illegally parked. He probably got it dropped because the issuing cop never showed up to court, not because he wasn't illegally parked still. Which that court still found that he was in violation, but they still dropped it due to who knows what (again, likely the cop not showing up to prove the ticket).

      @@ThisIsDjYigytugd it was a “close call” as Harvey said. The tow truck company even admitted they are sometimes told it isn’t a driveway and no ticket is issued. I would surmise this “close call” has happened before. Had it gone in favor of the plantiff which it sounds as if it should or could have. The tow truck company would have to then sue the city for the unnecessary tow. No one should be enriched by this tow. Yet the tow company is the only one who was.

      @@meechee2too754 it was only a close call because he got the ticket dismissed. If it wasn't dismissed, then he'd have no right to a refund of tow. It being dismissed means that the tow shouldn't have been requested by the police, but that's the police fault, not the tow company. The company did what they were supposed to given the laws (police give ticket, police request tow). But the tow company didn't do anything wrong, hence why they don't have to give any money back. The police did by giving a ticket that wasn't valid (though we aren't sure if the ticket wasn't valid, the case could have been dismissed due to lack of evidence, not a bad ticket).
      Whether it was a valid driveway or not is irrelevant to the tow company who is only supposed to tow when called and police ticket is given, which is what they did. If he was his money back after getting the ticket dismissed, it's on the city who gave the bad / false ticket.
      The tow company did a job and should be paid for it. But it's not their fault that the city gave a bad ticket. The plaintiffs problem is with the city at this point.

      If he actually sued them, it probably costs him more than the tow. The city isn't responsible for him being too lazy to go pick up his own car. They are not going to pay for anything more than the cost of the original removal tow if they even paid that. Any amount over that was his own fault.

      He was nervous because she took the tow guys side automatically and assumed the guy was lying until she read the paper and then changed her tune. When this young black guy with golds try to use the justice system the correct way by being the plaintiff instead of the defendant he is still treated like a criminal. When in all actuality he was in the right and the police was in the wrong.

      ​@@MrSexykay27It should be noted that the case being dismissed matters for why it was dismissed. It wasn't dismissed because it wasn't an illegal parking job, which matters because the only reason the police wrote the ticket is because it was. The only reason the tow company was called is because it was an illegal parking job determined by the cops.
      The tow company didn't do anything wrong for the tow, but the police may have if the ticket wasn't valid, which that judge didn't say it wasn't, and still found him to be in offense. But that judge still dropped the case (for whatever reason).
      That just means he doesn't owe money for the ticket, but it doesn't mean the tow wasn't valid. Hence why the judge was asking all those questions for why it got dropped and to see if the tow company was at any fault, which they weren't.

      Because in NYC not all driveways are active and can be used for parking if they are not. Helps that not everyone who has a driveway, even has a car to use it.
      So the city has an active driveway sign in some parts, such as possibly at this school, to prevent people from blocking it.
      The court summary she read doesn't sound like it got thrown out for that though, so not sure why he brought that up

    Perhaps the lot is so big that it has a secondary entrance near the actual entrance of the playground and that 1 is not in use therfore it's an inactive driveway.

      why would he understand that. is it his problem that they shouldnt have towed his car ? No, its between them and the city . so this nonsense that I have to understand that you are only doing your job that was ILLEGAL doesnt make any sense. If a cop tells you to tow someone car out of their own driveway illegally, wouldnt that still mean he was only doing his job of illegally towing someone car

      If its not legal, then all contracts that follow are void. If he hired a lawyer, the lawyer would have stated that if the initial action is illegal, then everything that follows is illegal which means the tow truck would have to return the money and then sue the city to recoup whatever they thought they had lost. If he tries to sue the city, he will LOSE!... The fellow had no dealings with the city since the city wasnt the one that towed his car or collected on the tow...
      This judge isnt good at her job but then again, this is not real court and is more similar to arbitration. It's the same as if a merchant sells something on a stolen credit card, he would have to return the funds to the bank and be out of the property to the thief since the action was illegal

      I know someone that had their vehicle towed from a shopping mall plaza for no reason, stole everything in the vehicle (claiming there was nothing in there) and when the person went to get it out of the tow yard tried to charge them all these outrageous prices. I was watching the news and saw the same tow company under investigations for illegally towing cars and charging the owners to get their cars out (after stealing property inside). I told my friend and there was a major lawsuit (my friend won) and the company had to pay him over 5k in property damages and loses.

      From the tow company's perspective, it was a legit tow. Those folks have to bring home a check, too. Imagine if you had to pay people out of your income because a third party may have made a mistake AND you only did what you were supposed to do. Nah, nothing fair about that.

      The tow company doesn't want to risk losing their lucrative contract with the city. Would you sue the entity (city of NY) who picked your company to do business with over the dozens of other towing companies in the city? NYC probably pays them several hundred thousand bucks a year due the contract they have with them. If this tow company sues the city for $320, the city will not renew their contract and will select another tow company to work with instead. Would the lawsuit be worth it?

      Played by who? The police issued the guy a ticket and the tow company towed. The ticket was dismissed based on someone else's judgement. The ticket was issued based on the police officer's judgement. We all make decisions everyday based on our judgement. Doesn't always work out in our favor, but at least the ticket was dismissed.

    Sometimes, JM is very condescending at times. Why does the Plaintiff have to be lucky to have a tow ticket dismissed? The city clearly decided that the ticket was erroneous. It sounds like the school playground is set up to be accessible but it isn't an active driveway.

    The tow truck has a contract with the city. Judge should of had the Tow Truck company return the money and the tow truck company should attempt to sue the city, because they have the agreement with the city. She got it completely wrong. New York City has thousands of illegal "driveways" and homeowners must be fined. You can't just create a curb cut without permits, and say its a driveway. You have to file with the Building Department and the Dept of Transportation to get a legal driveway, and the zoning and setbacks have to allow it on your property.

      Even if that was the case, the tow company can only tow a car if a police write a ticket for it and call them to tow. The tow company doesn't know the laws, they only know when they are contracted to tow. The judge of the case does though and can throw out a case (for a number of reasons, one might not be because it was an illegal parking job).
      They did a job without any negligence and shouldn't be responsible for something that is the police fault. The police should return the money, if it was ruled that it wasn't an illegal parking job.
      Just because the ticket was thrown out, doesn't mean that he was in the right as it could have still been an illegal parking job and the ticket (at the time of writing) was still valid.

      I would say no. One time I was about to park in a parking lot of a building that was no longer an active business. One of the employees of the restaurant next door that I was going to came out and told me that I would get towed if I parked there. It's not worth the risk.

    Why isn’t the basic tow feed returned returned that he paid them and then the tow company sues the city of NY? The only people who got money was the tow company, they acted on NY say so. Everyone is made whole if plaintiff gets money back from who he gave it to. Tow company gets back money for the tow by the people who ordered it towed erroneously ..that’s what’s fair.

Plaintiff shouldn’t be out of pocket and neither should the tow company who did the work. The one at fault is the city that put this in motion

At the end of the day, the tow company didn't do anything wrong and should be paid for their work, but if there is negligence, it would be on NYC or NYPD to pay for the legal tow.

    Nah the toe truck company should’ve given him his money back. Why should he have to chase NYC and sue; when the two companies that work together (nypd and the tower company) are the ones that got it wrong. Those two should’ve been up to date on what’s what and if not they should have to eat the fine/tow fee not the plaintiff .
