Understanding the Basic Land Title Document in Nigeria

Now that you've got a good grasp of the different types of land in Nigeria, let's dive into the basic land documents in Nigeria.
1) The first one is a deed of assignment: It's basically an agreement that shows the transfer of ownership, rights, and title from the seller to the buyer.
2) The gazette: In Nigeria, it's a document that records land details, like excision granted to communities. It verifies the legitimacy of the land transaction and whether it falls under government acquisition or not.
3) Excision, it's the legal separation of a portion of land and it's documented in the government gazette. This ensures that the land is no longer under government acquisition. Without excision, the government can reclaim the land without compensating you.
4) C of o and Governor’s consent: a c of o is a certificate obtained from the government to show ownership or legitimacy over a plot of land. The c of o can only be issued and registered once.
When you take that deed of assignment and go to register it or identify with the government that you are the new owner of that land, it becomes the governor’s consent.
The governor then issues a letter of consent or signs on the deed of assignment acknowledging you as the new owner of the land.
Make sure to do your due diligence, you can check if the land has been excised, properly registered, and is free from government ownership. You can find this information in the gazette or deed of assignment.
In summary, the Deed of Assignment and Gazette, the Certificate of Occupancy and Governor's Consent are crucial documents to look out for when dealing with land transactions in Nigeria.
They provide legal protection and ensure that your ownership rights are properly recognized.
In some states, documents like power of attorney, allocation paper and registered survey are used to show transfer of ownership but it is advised to add a basic document from what i mentioned today to be on the safe side. And always confirm that the property you are about to buy is well registered and approved by the government.
