  • The latest Chinese claims of coral reef damage in the Second Thomas Shoal - a flashpoint between Manila and Beijing in the South China Sea - are
part of a long series of tit-for-tat, says Eduardo Araral, Associate Professor at the National University of Singapore’s Lee Kuan Yew School of Public Policy. He tells CNA's Asia Now why the United States is not likely to get involved.

The problem is not the Treaty or the ruling, its ASEAN!
Like Singapore they just saying they are neutral but they really don't want to get involved
If ASEAN members really don't want to escalate the tension and they don't want the UN involvement in SCS then why ASEAN don't want to speak nor invoke any resulution?
This not just an ordinary misunderstanding it's already escalated to almost invasion like actions
China is no longer in SCS they are already inside WPS as it is already past thru 200 notical miles to Palawan

So CNA don't want to talk about this ?
8 Jul, 2024 , A recent Philippine submission to the United Nations over claims to seabed territory has sparked vigorous protests from Malaysia, reviving a long-standing territorial dispute over Sabah in northern Borneo.
The historically complex dispute, which can be traced back to colonial-era agreements, has significant political and economic implications for both nations given the region’s considerable oil and gas resources.
Malaysia submitted a diplomatic note to UN Secretary General Antonio Guterres on Saturday rejecting a filing from the Philippines to the UN.
Manila had registered its entitlement to an extended continental shelf in the Western Palawan region of the South China Sea, defining the seabed areas over which it has sovereign and exclusive rights to exploit for natural resources.
Malaysia said it “categorically” rejected the Philippines’ filing on the basis that the extended continental margin in the submission “was projected from the baselines of the Malaysian state of Sabah”.
“This clearly disregards Malaysia’s indisputable sovereignty over the state of Sabah,” the diplomatic note said.
Malaysia’s protest came just as the country’s foreign minister, Mohamad Hasan, paid a courtesy call on President Ferdinand Marcos Jnr in Malacanang Palace and met his Philippine counterpart, Enrique Manalo, on Monday.

But PHILIPPINES instead give more bases to the US ...while engaging in a dispute over a vast span of water without clear evidence of rights except a court ruling which is biased.
Nothing can be better than to negotiate with China 🇨🇳 for better rights upon the basis of recognising the needs of China 🇨🇳 and the Philippines.
China 🇨🇳 wants security and protection from the aggression of the US, and if the Philippines is doing this to aggravate the position, then there will be greater troubles .The previous president of the Philippines was much wiser ... peace and economic gains are better than conflict and war .

U$ have NO obligation to defend the dispute maritime areas.
Document 578 of American Foreign Policy Basic Documents 1977-1980 is a 1979 letter to then-Philippine Minister of Foreign Affairs Carlos Romulo, in which Vance further clarified the U.S. legal interpretation of the MDT. He declared that armed attack under the MDT refers to external armed aggression against any part of Philippine metropolitan territory as defined by the 1898 Treaty of Paris between Spain and the U.S. and the 1900 Treaty of Washington between Great Britain and the U.S. (amended in 1930), as well as island territories in the Pacific that are under Philippine jurisdiction. Moreover, “armed attack on any Philippine armed forces, public vessels or aircraft in the Pacific would not have to occur within the Philippine metropolitan territory or island territory under its jurisdiction in the Pacific in order to come within the definition of Pacific Area in Article V.” Thus, armed attack on said forces or vessels taking place in undisputed maritime areas in the South China Sea would fall within the scope of the MDT.

The Hague is not like a global supreme court but simply an independent adjudication venue for dispute between nations. There is no global police to execute the court's decision and persecute the violators. The Hague simply established an academic facts and shed correct interpretations of international laws on each issues. Although every nation in the world are not legally obliged to accept the decisions, the court rulings stands as factual basis as per international law. Since the world is still populated with sovereign nation, its up to each of every nations to decide whether to accept or reject the 'The Hague' rulings and act independently how to rebuke, persecute and force a certain nation who acted unlawfully as per international law. In the case of the Philippines arbitral award as far as public perception is concern it all looks nothing was accomplished against China but if we observe the diplomatic developments in these past years and at the present the Philippines is actually winning against China. The recent signing of RAA with Japan is just one of them. Meanwhile China's friends can go as long as the cash out flow keeps flowing. After China has fatten enough these nations using Chinese people's pocket money, the CCP then will whip out the belt to whack these nations into the road where China's CCP wants them to travel. That is why it's called "The Belt and Road Initiative". The road ultimately leads to "Make the World Safe For China's CCP".
