  • A lesson from history if youre planning on buying land or a house in Portugal, things can go horribly wrong and you wont know ubtil its too late.
    Just hope this helps other people to avoid the mistake we have made.

    I've started watching your most recent videos and working backwards, only today did I see this one. I'm a bit late, but just want to say so, so sorry this happened to you, the nicest amongst nice people. We haven't met, but I can tell already...
    Unfortunately there are scammers & stinkers everywhere... Portugal is no different even when everyone seem to be so friendly and neighbourly... and offer you wine & chorizo... a few are just scum! I know what I'm talking about, I'm portuguese.
    Most CZcamsrs just post about how everything is hanky-dory in Portugal... and how they are living the perfect life...and I cringe!
    Good thing you are posting it like it is, making people aware of the pitfalls. Thank you for this video.
    For those that would like to come to Portugal but worry about the process, I say this:
    don't give up on your dream, but plan everything super well and in advance. Make a long list of all the things you, as a buyer need to check before buying and familiarize yourself with the whole process as much as possible.
    Ideally get in touch with a few portuguese people that know how to go about buying arural property. Not everyone does know, but all will tell you they do...!
    And NEVER believe the "sales spiel" of estate agents (aka realtors). They may well say they are looking after you and will (pretend) to go out of their way to accommodate & please you, but in the end they want to close the sale as fast as possible and get their commission... and move on to the next. They'll NEVER tell you about any problems. Why would they?! You might decide not to buy and that would mean their commission gone.
    Any problems later... "we didn't know" of course...
    The advice given here is good: ask the sellers for a copy of the "caderneta predial". The owners can print as many copies as they like online, but only they have access to their online account, so you can't get it yourself. Check who owns the boundaries all around your plot, it's in there. Go to the local Camara Municipal and check that the "numeros de matriz" (registry numbers) correspond to what the owners say they are selling. Likewise check the numbers of the plots around the one you are buying.
    And as Nick has said: ask the seller to provide you with a topographical survey of the plot, at their own expense. Costs around 300 Euros more or less, but money well spent, as any irregularities will come up.
    Last... but not least: buyers be aware!... In Portugal there is still a lot of rural land that is not properly registered and confusion with boundaries arises quite often, but with the digital systems and GPS now being used by the Conservatoria (Land Registry ) it is getting better.

    this is a big bummer. it's swindling. you should confront the agency and the lawyer. ultimately file a complaint, they have licenses, they have to comply with rules. if you present proof they will pay for it. you look like good people, working class. I'm sure you guys will go over that.

Got hooked by the fact Sarah has the same profession as I have had for 30+ years - and your bravery in this whole project. Absolutely love your sense of humor and the variety of content.     I am Portuguese, now living in the USA. Real Estate agents in Portugal have always had a bad reputation, but it is improving. The industry is becoming more professional. Today there are younger, more educated and knowledgeable people becoming agents. That being said, there are still some bad apples out there. My dad used to say, "when you lose, don't lose the lesson". I'm happy to hear that you're not giving up. And it's great that you're helping others avoid what happened to you. ❤🇵🇹

    Overselling probably...and disputes over lands it's a big problem here there is chance that the person's that sold you that land actually believe it's theirs, don't ever buy anything without all the correct paperwork, and the accompany drawing certifying what you are buying...
    Now relax and go to a lawyer, state your case and get your money back... It's not like the people that sold you the house could have disappeared...
    The entire rural areas in Portugal are a mess form an article perspective. the sate of abandonment the land arrived at created many of this problems... but with patience you will get there.. AKA it might not be malice juts overselling based on doubt..
    Frist step go to the city conservatory and figure out the articles around your house... Good luck...

    When you buy always check the plans (caderneta) of the property and if it agrees with what people say. There are dishonest people everywhere and do not think this is happening because you are not Portuguese. I am Portuguese and my own brother and sisters did something similar to me.

    I'm Portuguese, in 2011 I bought a piece of land. A year later the former owner filed a lawsuit against me claiming that I had cheated him and wanted the land back. We went to court, he lost the case. To this day he has never paid me court fees. He seemed to be the most honest and humble person on the face of the earth.

      I went to Montenegro looking for property in 2006, about three years after the property market started to move. I was warned early on by a lawyer that many foreign buyers were being scammed by the sellers.
      They all saw how seafront land went from €25,000 per 500sqm to €500,000 in the space of three years that they all went crazy trying to sell even junk at ridiculous prices. By the time I got there all the good stuff had been sold to the Russians and a lot of Russian builds were on the land registry's website to be demolished at owners cost. The Russians went too far with destroy Montenegro's seafront land.
      Many, who were selling their property, were only part owners of it, still others were being sold non zoned land as zoned for residential property this lot lost a lot of money. With me, every time I went to see a property and they saw I was a foreign buyer they would close to double the price. I found them very friendly but shady people. In the end I didn't dare buy anything.

      @@aeseven594 I think that before writing the deed you should confirm that the square meters that are on the paper are the same as what you were told verbally.
      I also think that It is good to have a solicitor or a lawyer help and clarify all questions you may have.

If you decided to leave Cornwall or GB than why go back if you said you consider to buy off your neighbors in earlier video than use that money to startover at Portugal or use it to get back your rights, dont let those scamer go scot free and they will just do the same to another poor soul.. Get your estate agent and lawyer to be responsible for this mistake as you paid good hard earn money to them.

      I'm so sorry you have been duped. I thought the lawyer representing you would investigate to ensure the tittle to the property was clear. It is a good lesson for me because I've been looking to buy a house so I'll check with the registry of deeds... not long ago I contacted the owner who had listed his house in Algarve. The announcement showed a pool and a little garden. I went to see the house and there was no pool. The owner used pictures of the neighbors' pool. He was British and really turned me off when he pointed to the houses around and with disdain said they were all Portuguese. I replied "of course, this is Portugal." His arrogance was insulting. There was nothing wrong with the house, it was a village house with small rooms but the wife said it was too big for them. They had bought the house 2 years earlier. The market was going down as due to Brexit too many British were going back home and selling.. On another instance I made all the arrangements to see a house but the agent, an English woman, refused to provide the address. She was ready to take my money to secure the sale, I couldn't see it because I was in Boston, but I wanted my brother and sister in law to see it for me. She refused to provide the address so I told her she could meet with my brother and sister in law. My brother called her and the number had been disconnected. A Portuguese agent quoted a price of 900 thousand euros for a house worth no more than 300 .. scum artists all around.

    I'm so sorry to hear what happened to you. I literally just put up a video about how my family were deceived too 😔 and tbh if it wasn't for the fine locals and Portugese friends I've made, I would have been back in the UK now. I'm off to see my attorney tomorrow. Things will work out in the end for you I really believe that. My family have been in Portugal a year today and it does get easier I promise.

    Hi Nick! I am sorry to hear about what happened to you regarding the land sale. As a Portuguese lad living in the UK I am ashamed of the people that weren't honest with you when they've sold the land. Unfortunately this kind of things do not happen only with foreigners living in Portugal, sometimes this kind of situation happen with Portuguese people as well. Portugal is a beautiful place to live, with a lot of decent and good people always available to help the next door neighbor, etc. But I can say that at the same time can be very difficult to deal with some bullshit (sorry for my expression) that we are never expecting to happen. If your heart tells you to give up on Portugal I can't blame you, but I hope you can find some strength inside of you to go over this situation and give Portugal a second chance! All the best!

      I'm intrigued... Did the lawyer not provide you with a copy of the land registry declaration on your property? If they have not done their job correctly then you may have a claim against their Professional indemnity insurance. Just a thought and sorry to hear your story.

      Yes I have dealt with 3 realtors so far in Portugal and I have been disappointed with all of them. They didn't disclose the proper information that I should have been aware off. The first one rented me a sh--ty apartment with the fuse going off each time I turned the heater on. The landlord didn't want to return the deposit after 6 months when I was fully entitled to leave that bad property. The second one didn't speak one word of foreign language and didn't disclose that there was no heater. Anyway, they didn't even care or know the apartments they were renting They just wanted to make the deal and earn their commission. After that, they didn't know me anymore. Not professional at all. I would even say 'crooks'...

    I love Portugal, I was born there, but it is incredibly corrupt and every time I have gone back to try to establish myself I was sabotaged, whether by lawyers, people with no vested interest gatekeeping me from legitimate information, or even family. Perhaps it was because I am half American and have struggled with the language but whatever. Portugal is very bucolic but people will see you as a target unless you show them you have the money to defend yourself in a very litigious and archaic legal system

    My heart is hurting with yours, truly. That "lawyer" must really explain what he has done on your behalf. Please have some very deep breaths and take care of yourself and Sarah, you are going to need strength, whatever you decide to do. I would not like to see you leaving this country and I believe those "people" would do that to anyone, british or portuguese or whatever.

    When you a property in Portugal you see a copy of the predial before you sign anything this document shows the boundaries and the buildings and wells etc so you can see exactly what you are buying, you then sign a promissory document and give 10 percent up front before finalising the deal, if you have an agent and solicitor they will ensure that the title is clear of any debts, otherwise you will inherit them, the final document is read to you in English by the notary before payment is made by law.

    Hi Nick. We've been watching you from the beginning. Don't give up - the house and view from your house will be amazing. We've lived in four European countries and had really bad experiences in Italy and Spain with our employers when we were younger. We came back and wish we hadn't. When these things happen it is always tempting to go back immediately, instead of sorting them out. Now it's harder for us to get out without Freedom of Movement and we would have had other options to stay in both countries if we'd been calmer. Remember what it's like here and how you felt before.

Its in the Register what you bought , things aren't that simple to cheat .If you payed for a piece of land that after all doesn't belong to you ,then someone is gonna pay for , we have laws to protect people , your lawyer needs to do his job , and check what is in the Register !!!!!       You have to be very careful publicly naming and shaming in Portugal. They have pretty harsh laws to 'protect' against defamation.

    I hope some of the people below don't add more to your heartbreak. Some comments are super ill advised. I can't imagine how it is to save and get a treasure only to be told the treasure is not wholly yours. Just know, there are people who stand with you and also that the person that mentioned a legal fund has a great idea.
    Also stuff happens in crazy ways, that you only happened to talk to a neighbor who all along knew you were strimming another's land and she finally brought that up. That in turn led you to find this out. Providence, serendipity, whatever it was, I am glad it happened sooner rather than later. Later when you would have had even more invested in every which way.

    Heartbroken for you guys over the dupe!! When we bought our place here in SW France, we were given a copy of the official boundary plot. It has a number on it. Please, please do not give up your dream, I am sure that it has all left a bitter taste, but you and Sarah have come this far and are clearly a strong couple. Keep moving forward and doing up the house regardless, while you wait to find out exactly what has happened here. Never, ever let the bad people of this world steal your joy or dreams.....

When you’re given lemons just make lemonade. It’s a beautiful area and you can do wonders with your home and the area you do own. Getting away from England was your wish. I’m from Northern California and would love to live where you live now. Please think really hard about it. I love your sense of humor and watching you restore your home. The outside shower is great. We love following your videos, the good, the bad, and the ugly. Great advice and so sorry you had to learn this the hard way.
    We’re in the same boat. 🐭 🏡 We certainly can’t afford to buy a house in Canada and even buying something in Portugal we’re looking for something we can fix ourselves.

    My heart goes out to you both, sickening that this has hurt you so badly and crushed your spirit. At the minute you can’t see a way out, I’d be the same. Time may tell you to alter the dream, work with your land and view at the back. Build your workshop on the piddly 300 feet strip. It still has everything you both want, it’s got a black cloud over it just now but you can’t buy what you have there over here, it’s out of reach. Sarah and you are resilient, strong together, let’s hope you can salvage sanity and dream and come out the other end.     Hey Nick, don't give up. You are one of the good guys who are an inspiration to us all. You have lots of subscribers who, I am sure feel the same. Find out what can be done to go after them, to at least attempt to get the money for the 'missing land' back from them. I for one would chip in to help with your costs. We purchased ours having completed all of the checks with the Camara. Not everyone is out to get you, but you still have to keep your wits about you.

    We love watching your videos and we sat down to watch another not expecting this horrendous news that you and Sarah are going through at this moment, I believe there has to be an explanation and definitely has to be corrected by your lawyer after all that’s exactly why he/she was hired to do, I truly believe it’s all going to work out and even better situation in the end, I must say I think Teresa the neighbour, was a god sent because I could imagine this being a lot worse believe it or not because you could of found out only when the neighbours lands were sold, they would of asked you if you were interested to buy their land you would of declined thinking you had enough land already and then it would of been more complicated (I think) and the million dollar (euro) question where is the rest of the land you bought !!!!!!!!

    I'm so sorry this happened to you! We are going to be purchasing in the near future, and this was very educational.
    My brother also had loads of issues, being massively overcharged by multiple people in his journey to buy a home. The attitude that everyone is rich and can afford being overcharged, or that it's ok to dupe people is gross. It's not everyone, but it's too often an occurrence. Sadly, just because people are nice to you, doesn't mean that they won't rip you off.

    This type of skulduggery is also prevalent in Greece. I visited Greece a few years ago and I bumped into a retired English couple in Greece who had been completely shafted, long story short, the Seller pocketed all the money and with the lawyers they denied that there was a sale, The elderly couple were devastated because they had lost a large portion of their savings with no recourse to getting it back. Sad Tale indeed.

    The real estate person and lawyer sold you something that they shouldn't sell you. It's their job to make sure what's is the legal papers is legal to sell you.
    This is the reason why you hired a lawyer and Realtor... Someone mess up big time .

    Is it possible to get a guaranteed survey done before the purchase? I am assuming you paid cash; would have getting a mortgage been possible, and would that have given you some protect (again assuming the lender would protect their interests)? I am actually thinking about buying some property in either Portugal or Italy, and never thought there could be a swindle of buying property - because there are several safeguards that we are accustomed to in the US. We have guaranteed surveys, title insurance that not only protects you from scenarios like you are experiencing, but also of prior encumbrances. I feel for you, and good luck!

      Thanks Bill, youre kind to say these things. Id suggest finding a decent lawyer and an honest agent, ask for a full topographical survey before you sign and youll be absolutely fine.

    Please stay! Your lawyer obviously didn't do her homework because she should have got the drawings from the camera for you to look at before you signed. I think your neighbour Theresa is worth her weight in gold and your plan to buy plots from your other neighbours is a good one. Yes, I read all of these stories and mistakes, and yet, it seems that even if i want to make sure all of this, there are so many expats simply snatching properties - they honestly don't care and say: "it will be ok" so one like me simply don't have the time to check everything in 1-2 days and also, find out everything about everything. once again, thank you on one side, but feel sorry for your story and hope i'm not the next one in line to be ripped off.

    OMG I can't believe this happened! You absolutely have to fight it or else others will get shafted as well. How about a crowd fund campaign to pay for legal fees? If 2.8k subscribers gave £10 or 10 euros each you'd have about 30k which is more than enough to pay for legal fees. Depending on how much those two houses cost behind you that own the land, you will probably be able to get enough money to buy them too! Hope you can get through this.     Have seen this video from a year ago only today, sounds very grim and upsetting the way you were tricked, I really hope you were able to get compensation and have been able to put this behind you. I know similar if not worse stuff can happen in Spain, moving out of one's own country into an unknown environment is always going to be more challenging I think that applies to anywhere in the world.
    For the locals we have "mug " written in large letters on our foreheads, but hey you have proved to be resilient ! Good luck for the future,

    Just wow. We're in the US (for now) and this is why we're forced into title insurance with a bank loan. I feel terrible for you. Surely there has to be some sort of remediation available? One thing to note, seems like you're starting to get a pretty good viewership going. I can definitely tell you I'm watching every YT Portugal "we bought in Portugal" video I can before we make the leap. 5,000 people watching YOU may be doing the same. Use that as leverage, when you determine precisely who let you down. The Attorneys? The RE Agency? I guarantee if (and I hope you do) you continue the channel, and communicate to your viewership who did the stinker on you, we will definitely avoid these stinkees when and if we move to join you there! USE your base of 5,000 interested viewers! That is a lot of people who might say "nope, we'll avoid that agency like the plague". You might be very surprised to see what sort of results might suddenly open up for you when you mention this. The Portuguese government is actively seeking investment and is trying like hell to offset their population decline (and tax base) with immigration. The last thing they want is fat Canadians like me to hear about your type of nightmare when I'm deciding what country to retire in. I sincerely hope you get to an amicable resolution! If you have to buy back property, there's always GoFundMe! I'm sure the Portuguese govt would hate to see the headline " Ripped off Brits forced to GoFundMe campaign due to "...

As with Rui bellow, you should get the agent and lawyer and file a formal commplain with the national estate agency. try not to let them get away with it. wish I could be there to try help you to sort it out.       @Conceição Reis I think that this is the most likely explanation so far. Up to now we have the word of a neighbour who only knows what she thinks that she knows, in other words there is nothing to back up what she has said without making the proper checks. And it wouldn't be the first time that others have laid claim to what is not there's because nobody was there to question their actions. This would be the best case scenario.
      On the other hand, there is the word of an advogado, and a real estate agent, none of whom could really believe that if this was indeed a scam it wouldn't come to light at some stage, and very likely, very quickly. Which leads me to believe that the lawyer was not complicit.
      That leaves the estate agent...not known as one of the dodgiest professions on earth for nothing. The sheer volume of people selling land in Portugal speaks volumes, there are few watchdogs and much money to be made. A few good ones amongst them, but the only person who can vouch for what the agent told you is you.
      If that crucial moment when the agent told you where your boundaries lay was only between the two of you, and you didn't follow up on it, then everybody else involved simply carried out the transaction outlining the true boundaries.
      This sounds judgemental...it certainly isn't, I'm just trying to break it down to it's bare bones without clouding things with anger etc, so that you can maybe see where you need to focus your attention regarding your retort.
      Your channel my friend is a joy to follow and I feel genuinely hurt by what has happened to two people that I have come to sort of know (as much as one can come to know somebody on here) I hope that you can put this episode behind you and hope that the open wound that it is right now eases with the passage of time. Being trusting and a "good person" who doesn't see bad in everybody is not a fault. Making YOUR world a darker place by looking upon everybody with suspicion would be a travesty for two such life grabbing, fun loving "doers", because you are most definitely doing it! You have identified your dream and made it happen...and with lovely warm humour too, that you have brought into the lives of almost 3k people.
      Although this is definitely a setback, I believe that you and Sarah will sort this out and go forward with the dream that has taken you this far. A scumbag estate agent can mess with your dream, but he can't take it away unless you let him. (Easy to say I know) but I don't want you to go.

      I advise you to bring with you a J.Wayne's Winchester to deal with any office and lawyers in any bantustan (like Portugal and any East: postCommunist, Asia, Africa, S.America state); only a little better in US or Canada (my above experience; I know other "stories" and Lawyers Mafia-like likes such govs laws; in my other case I had to hire FBI/RCMP as Police refused to help me when post_Communits gangster in govs was disrupting my phone conversations as I had some legal issues with devils there (in Warsaw).

      It took our savings but was worth it in the end as we are clawing it back and didn't take up any energy and time in a horrible leagal battle where the only winners are lawyers.

    Learn all you can!
    Use this experience to learn this field and become an expert to start a business.
    Learn who the good ,bad, and ugly are and warn others about them.
    I believe things like this happen for a reason to be put to good.

    OMG... what a horrible situation to find yourself in. I bought in Italy back in 2008, never got it, years of court stress to get, so far 40 % of my deposit back. Don't give up yet but l guess, when 'the true owners' hear you MAY buy you can be sure the price will change!! What came of the meeting over the other piece of land you were telling us about? I feel sorry for both you and Sara and pray something good comes out of this. Be strong 🙏

    Ohhhhhhh, so sorry for this trouble! Please don't pack up and go back to the UK. You still have a wonderful plot of land with a house and a gorgeous view!!!!! And you already have said how you like it there. Please follow the tips others have left. I am sure not all is lost. There will be something good to come of this I am sure! We are all rooting for you ! Please keep posting! We are tied to your journey whatever it is.

    Small town are prone to this kind of errors, because the notary hasn't even been there, you just need to check with the land registry. i hope you didn't pay more than 50k for that and if you paid more that it is urban land. because most of the time this houses are in rural land and can't be legally built upon. you can fix it but the land is agricultural and due to some legacy they are legal now. just remember agricultural land has almost no value. so that plot of land you should have not worth more than 10k if agricultural.
