Mom of Baby Who Fell From Ship Blames Cruise Line

  • The family of an Indiana toddler who died earlier this month after falling 11 stories from a docked cruise ship are desperate to stop what happened to their daughter from happening to another family. Chloe Wiegand died July 7 when she fell 150 feet from the Royal Caribbean ship Freedom of the Seas. Initial reports had claimed the grandfather dangled the child out the window but the family’s lawyer is placing the blame on the cruise line for having an open window in a children's play area. #InsideEdition

      Same here Jackie here is my opinion I feel awful for them. The child did not fall out of an open window on her own. She couldnt reach it on her own. Therefore, the fault is with the person who put her up there. I cant imagine the pain he is dealing with. Its a sad situation but not the cruise lines fault.

      He didn't know there wasn't a window there? All glass on every cruise ship i've been on is tinted green and covered with salt sea spray. If you can see through it.. there probably isn't a window there

    I was quite literally there, on the ship the day this happened. This did not occur in a “kids area.” It was on deck 11 near the outer edge of the cruise ship. It was actually near the smoking area, which is why the windows can be opened. It’s the ONLY part of the ship like this. The only way for a child to fall is by an adult lifting them up to the railing.

      "Accidents" happen because of negligence or oversight. It's where precautions come from (ie: don't text and drive, wear a seatbelt). There shouldn't be an open window in a children's area. Children fall from windows all the time because people can't be bothered to take precautions.

      T H A T G O O D J U J U anyone with half a brain can tell whether or not a window is open on a cruise ship, the windows tend to be a bit darker so the heat won’t go all the way through, plus the wind and smell of the sea had to have been going through. Also, he sat her on the ledge so at that point you have to know that there was no window there

      Magnolia … makes perfectly good sense to most people. The window is not at "kid level" and the railing that he plunked her down on is there as a safety railing to keep people -- including 18 month olds with a window-banging fetish -- from dropping cameras, cellphones, eyeglasses, etc., and to maintain a safe distance from the windows, should they be opened. The railing is not to facilitate window-banging against the pane by toddlers who would be put at risk of injury by doing so.

I was on that boat in April and honestly it’s almost impossible for even a tall DRUNK adult to fall out of the window because they’re so high.     This is just an accident. This wasn't ANYBODY'S fault.
    Edit: I say this because the grandfather was colorblind and the windows of the cruise were tinted. Him being severely colorblind made it difficult for him to see the window was open. I agree I still wouldn't have put a baby up to the window, but he has visual impairments that made it difficult for him to see a danger that would be obvious in a typical situation
    Edit 2: Yeah now that I’ve seen the security camera footage it was the grandfather’s fault. It was an accident, but it was reckless negligence

      If no one were ever at fault for accidents, people wouldn’t be getting fired, and past mistakes wouldnt be fixed. There has to be accountability for something as tragic as a foolishly negligent death such as dangling a helpless baby outside a window. That baby has trust in the adult holding them. It is the responsibility of the adult to protect the baby, do whatever they can do that is in their capacity. A baby is defensless. They rely on others. There is no excuse for that man dropping a baby outside of a window. That is an extremely stupid way to accidentally kill a freaking defensless human being.

      I would imagine she's also feeling helpless and upset that this happened and wants someone to be responsible but may feel conflicted about blaming the grandpa. The glass is always so clean that when a window is open it creates an optical illusion that the glass is there..same as the other closed windows. On our cruise..the windows all appeared closed..but one was open. My 2 yr old granddaughter stood on a chair to look down at the water..through the glass..as she had done every morning. We were sitting inches away and an open window..alongside a bunch of closed windows looks exactly the same. It is an optical illusion. My granddaughter nearly fell but my daughter grabbed her dress and pulled her back. We reported it to the cruise line (Carnival) and were casually told that one window was opened to prevent the others from fogging. I said.."But we cannot tell when a window is open". The staff member responded.."No..you can't so be careful". So..they know!!

      Budder Kupp the window was open on a cruise ship. Do you know that winds as frequent as can be. Even if the shop is on dock, the wind will definitely get in through an open window. I don’t think the grandfather thought there was glass, he was negligent. And try to pass the blame to others.

      Exactly, one time I went to a pier at one of the beaches here in Cali and you best believe while being up there with my mom and my two little sisters we held onto them tightly and wouldn’t even go near the railing. A kid could easily fall off or slip through the opened railing.

      Thank you Tyler. I don't think that there should be this huge financial gain, but something and change this fleet wide. The cruise lines send out a survey after each trip, and I always fill them out. Do they read them? I have pointed out safety stuff, ways to save money and keep some of the savings and pass some on to guests, ways to make money as well. When I heard of this accident, I knew it was that type of window I seen on a RC cruise, because I don't recall them on carnival. About 3yrs ago, and this feeling of that looks dangerous and deceiving.

    I feel really bad for the family, especially the grandfather. Still, it is his fault. the window wasn't on the ground. If the person was tall enough to reach the window normally, they wouldn't be able to accidentally fall out. People shouldn't be leaning on glass anyways, especially 11 stories above the ground. This is a terribly unfortunate situation but I don't see how the cruise line is at fault.

      K. voo cruise ships have lots of lights inside and out so it makes no sense that he didn’t notice there was no window, because the lights of the ship would have reflected off of each window and there was most likely a breeze of some sort, or a smell or noise. Also, where did the glass part go? Because it has to be closed at some point.

    I feel like every time we have very sensitive situations people need to blame something to pacify their hurt. Like the time the child fell into the zoo enclosure then they kill the animals and the parents want to sue the zoo. It’s that same bizarre mindset of emotional responses rather then acting on rational ones.
    If the grandfather dropped the child out of a balcony deck room would they then say it’s the ships fault Becuase the balcony’s aren’t enclosed in glass ? Or off the side of the boat
    I’m not trying to be hurtful here just doesn’t seem cool to blame the ship to me.
    If it was me i would except that my father made a horrible mistake and try to move on with my life.
    Blaming the grandfather is morally wrong i would say but so is blaming the ship.

    Its heartbreaking to loose a child this way. My heart breaks for this family. With that said...this child would never have fallen out the window had the grandfather not picked her up and out her on railing against where he thought glass was!!!! He used poor judgement. Even if glass was there she could have fallen through glass. Kids don't belong banging in glad anywhere. You can try to blame the cruise ship but fault lies 100% with gramps. Not cruise ship. I know you feel like you have to place blame.....
    Even if you sue....a jury will never award damages...its not fault of cruise company.
    Hopefully in time you will come to understand this fact.

      it was childproof. it wasn't adult proof, which would've been the only way a child could've reached that height. They keep on saying there weren't enough safety measures in place. A railing is there to stop people from leaning on the floor to ceiling glass, which obviously means that you shouldn't be by said glass. If you bypass that safety measure, which the family did, then its no longer safe. I feel for the family, but they really need to take some blame, cause the cruise line DID NOT put their child in danger, they did by bypassing a safety measure. If there were a railing, would you stand on it? 90 percent of adults would say no, so why put a child on a railing if you wouldn't.       Look at @JoshuaDanger ‘s comment above. The little girl didn’t fall from the children’s play area, she fell from Deck 11 which is the smoking area. That’s why the window was open.

    Never put your children at risk specially in a places like a cruise ship ,there windows, stairs, glasses , pools everywhere and I’ve seen signs about accidents prevention in different decks and doors. It is not Royal Caribbean fault al all!

    I think Grandad knew the window was open that's why he was drawn to it in the first place, to get some fresh air maybe??? San Juan is very hot this time of year. He propped her up on the rail & she slipped from his butter fingers. I think that's more likely what happened, it's not the Cruise lines fault. Oh that poor baby girl.. so sad :'(

    I feel awful for them. The child did not fall out of an open window on her own. She couldnt reach it on her own. Therefore, the fault is with the person who put her up there. I cant imagine the pain he is dealing with. Its a sad situation but not the cruise lines fault.
