  • Interstate 70 traffic is back to three lanes east and west, flowing over an area in Genesee where the Colorado Department of Transportation has been constructing a wildlife underpass.

      Definitely, that's what they meant by usually we buy the land first... but when they dont want to pay full price for the land (because its not owned by one of their buddies) they can always fall back on eminent domain.

      The CDOT lawyers will make as much as if Colorado just gave her the assessed value rather then trying to steal it from her. The only people making money here are the lawyers for the government.

    In the long run, the government will spend less if they just give her close to her asking price. It will cost so much more and take way more time to fight for imminent domain in court. Tax payers don't want to pay for government pettiness.

    Emanant domain for environmental reclamation, if that is what this is, is not entirely new, but newer than say for classic road widening. Her lawyer should question if there were other options they did or did not consider before choosing this project, along with the basis and background for choosing this option. Was a feasibility study done? How did this project become reasonable? To answer this, prolly cause the cost of purchasing her property was not included in the calculation. Was this an accident, on purpose...why?
    To conclude, this is how a less reasonable and not so feasible project option gets selected, that is, by skewing the study and/ or the results.

    100% BS......CDOT knew from the BEGINNING the property was worth $2.5M+ !!!!!!!! They intended to TAKE it via eminent domain before they ever designed the underpass or put one shovel in the dirt !!!!!!!!!!!!!

    This does not pass the smell test for me...I don't know who is trying to take who.
    It sounds like she got wind of something in 2000 and she bought the land. She's a realtor and bought 17 acres on a highway, on a highway, far outside the city? It's not worth the 2 million, no way. But the state should have bought it before it started construction. $800,000 was more than generous, she should have taken it with a smile. The state should look for a connection between her and who was in charge to get this project submitted and/or approved. I'm just saying...

      Acreages next to highways are a very common thing in my state. It doesn't matter if it's outside the city because the highway provides quick access.
      2.5 million for 17 acres with a house built in 2000 and highway access sounds exactly in the ballpark to me.
      This is just the state being evil.

    This is a good example of someone in government just doing what they want without knowing what they’re doing. That project should have never happened until ALL the land was procured. Not to mention whoever heard of putting an elk sanctuary in the middle of busy traffic. First person to hit an animal should sue the but off this government agency.

    so a little context from public records. The 17 acres is its own deed, it does not include her residence which is a separate deed valued on its own. The 17 acres is also zoned as agricultural. The total property tax on it in 2023 was just shy of 30$. In 2000 it was bought for 163k. It sounds like to me that the roughly 1.2 million (half of requested) offered after arbitration is quite a lot. There is no way someone would buy an agriculture zoned land next to a busy interstate for 2.4 million. Certainly the state is not valuing the property at 2.4 million for taxes which makes the news points about rising tax rates irrelevant. She could also sell the 1 acre property with the house for more money. To me its unclear if that's the price she wants for both properties or just the land CDOT wants to buy. I am suspecting the realtor valuation includes the additional 1.2 acres and house. In any case, after CDOT acquires the 17 acres, the house will be wedged in-between highway 40, and I70 state property and will probably become worthless as any buyer should be very aware of high probability of future eminent domain not to mention a horrible place to live.

    Property next to a highway has little value. Good for a gas station or a McDonalds. I'm sure she would like that near her house. Looks like an spot that might have flooding. Not a good place to invest your nest egg unless you knew the state had plans for it. How much did she pay in 2000? Her house is currently listed for only $560,000.

      Lets break it down: Its her property, regardless of what someone could or would build there.
      What she PAID in 2000 is irrelevant, only what its worth now.
      IF someone wants to buy your house and tells you they will ONLY pay you what it was worth in 2000?
      Its a GREAT property! All mountain property is good, even non conforming land.
      In 2000 how would SHE know CDOT was going to put in an underpass for wildlife?
      The price of her house is irrelevant.
