    JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
    Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
    Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
    Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

    I have seen a number of people spouting some misinformation, and I would like to clear this up. The AR-15 is a semi-automatic rifle, just like 95% of all firearms today. It is not and has never been a military weapon. There was M16A1 and M16A2 and now there is M-4, unless it has been updated again. The AR in AR-15 stands for ArmourLite, the manufacturing. All military rifles have a multi-selector switch that goes from single shot, 3 round burst, and fully automatic. AR-15's do NOT have the 3 level selector switch that military grade rifles have. AGAIN< AR_15 HAS NEVER BEEN AND IS NOT A MILITARY GRADE RIFLE. It is basically a .22 on steroids. When hunting, you can only use it for small to medium game, and it is argued that it is not ethical for deer hunting. So anything smaller than a deer is prime for the AR-15. Please, educate yourselves on firearms before spreading misinformation and feeding the rumor mill. My wife was against guns until I took her to a handgun safety course. Now she loves it and has her own Glock that she calls "Heather Glocklear". Education is key to eroding fear.

      I think the judge had already tried to explain this to the jury during the jury selection, but I think he should have mentioned that semi-auto is the same mode of fire as most pistols have. This type of AR-15 style rifle is just a long pistol that is a bit more handy for distance shooting, and much less handy if you defend against melee attackers for a simple reason of how unwieldy it is. A rifle is useless in close-quarters, if you miss a skateboard to your head, or even just a good punch, you may just as well count yourself unarmed.

      @@laylarosexxx7467 no problem. Sorry I'm late to respond. A semi automatic is essentially all firearms. Revolvers, technically are not semi automatic, but they function the same as a semi automatic: one trigger pull, one round fired. Even the military rifles can function as a semi automatic. I served in the Army, the M16A2 that I was issued (like all military general issue rifles) has a 3-level selector switch. The AR-15 does not. The selector switch on the military rifle allows for semi automatic, 3 round burst, and fully automatic. Semi automatic is one pull, one fire. Three round burst is one pull, three rounds are fired. And automatic is one pull and it fires rounds until you release the trigger. Plus, in the USA, everyone that buys a firearm from ANY business (including ALL gunshows) has to go through a background check. It's a basic background check that makes sure you aren't a felon or are on any list that restricts your right to own a firearm. It covers federal and state criminal records. The ONLY time a person can buy a firearm without a background check is in private sales or gifting. So if I wanted to give my dad one of my handguns, as long as I know he is not a felon, I can give it to him or sell it to him without having to get a background check. People that are anti gun in the USA seem to think that you can walk into any store, at any age, and just walk out with as many guns as you can carry. That is just not the truth.     Wow. The prosecution is doing such a terrible job. I don’t understand anything they are doing or why they are doing it. Where is all the evidence that will go to the fact that Kyle was negligent or reckless? They have shown absolutely NOTHING of substance and there have been absolutely NO good arguments. All they are doing is trying to prove emotion for people that already have a bias. Except it’s not going the way they planned.
    The only thing they have proven is that the aggressors were not Kyle, the police are INCOMPETENT, and the witnesses are either liars or proving the defenses’ points.

      One small issue - no evidence Rosenbaum touched his gun as he lunged for it (the Daily Caller guy said he might have grazed it)- a jury might conclude Kyle could have run off b/c Rosenbaum would have landed on the ground. I know it happened so fast etc but I worry for Kyle

    Those two brothers who owned the car lots are lying and denying through their teeth. You can read it all over them, even in their body language, something even a small child could pick up on.
    That testimony was painful for everyone in the room to endure, worse than pulling teeth without any Novocain. The older brother started to slip up more toward the end from his "I don't know and can't remember anything" story. I hope those two brothers get what's coming to them for throwing Kyle (and the rest of the group that night) under the bus after protecting their property/assets for them. If they have struggles with a lawsuit already due to the insurance companies not paying out for their damaged cars and property, just wait and see what happens for lying under oath - for starters.

      If the jury would have seen how that played out they would have interpreted that information so different from how it was ultimately represented to them. The state did damage control once the jury heard about this info it sounded like a nothing burger " so this was normal medication that he took for a long time period of time" ( nothing to see here folks just a regular normal event the defense is trying to lead you to read into) it is frustrating that our system and laws are so based on a lawyers ability as how information flows to the people who are tasked with serving justice based on that information. As it was important what medication he was on and why he was on it as it shows and supports that rosebonem was unstable like the witnesses stated and medically that to was true. So much so he was being treated with medication because of his mental issues and was just put back on that medication that his lived ones felt helped in the past however him being treated again with this medication was a recent thing and not a long term solution as it was presented by the state.

      Gabapentin is a pretty interesting medication to be on alone, sorta what I refer to as a "Jack of all Trades" as it's prescribed for many different things, including Bi-Polar disorder.... but did the GF indicate RoseyBum was also on Effexor?       Actually, I'll be interested in the coroner. I think Rittenhouse may be guilty of second degree intentional homicide against Rosenbaum on the grounds of imperfect self-defense: he used unreasonably excessive force against Rosenbaum.

If you use force under self-conditions that is unreasonably excessive, you will not be guilty of first degree intentional homicide, but second degree intentional homicide. In most states -- including the one where I practiced -- it's called imperfect self-defense and it reduces murder to manslaughter; Wisconsin is different. You cannot match a threat with the same force; it's what is reasonably believed necessary to stop the threat; and a jury could go two ways here. One is that it's unreasonable to have fired more than one shot at Rosenbaum without a significant pause, if you see him falling away from you after the first shot. On the other hand, you might fire multiple shots to "make sure" without parsing it that finely. There are likewise different interpretations of what Huber and Grosskruetz intended -- disarming and apprehending, or lynching; and there are different interpretations of whether 815 comes into play. Rittenhouse definitely has the inside track on this -- it's a mess, and all he has to do is raise a reasonable doubt, and he does look a bit like a cherub. But I agree that the prosecution's case seems weaker than advertised.

    I’m anti gun... but I have to say that Kyle should be found not guilty. The people that provided the gun should be charged with providing this weapon (which I believe they will) but anyone else in his position would have done the same thing. Definitely self defence.

      If the prosecution were really on his side they wouldn't have charged him with a serious crime. The case is extremely difficult for the prosecution. It's one thing to not bring charges in a high profile case everyone is paying attention to. It's another thing to win a case that everyone is paying attention to that never should have been brought because it's a losing case. They brought the charges because they were afraid of political fallout and civil unrest if they did not. Now these prosecutors are left holding the bag. And Mr. Huber is their hero.

      I definitely think it’s liability issues, and it’s sad that they are more concerned with being sued than answering questions honestly under oath when a young man’s life is on the line- especially a young man who was only trying to help the owners of the dealership.

      @@jd4000 I don't exactly know the facts of the law on that, but someone did mention something that makes sense to me: if Kyle is found to have acted in self defense, then there are no grounds for them to get sued, because the people who died were the aggressors.
      On the other hand, if they are proven to have committed perjury, and it appears of their testimony contradicts interviews they gave at the time, and if they succeed (let's hope not) in throwing Kyle under the bus, then it opens the doors for civil suits.

    The only testimony about anyone grabbing the gun was that they grabbed the barrel. Isn't it interesting Prosecution didn't provided the DNA examiner any swabs of the barrel.

The law you're trying to use is, Must be 18 to 'buy' a long gun'. But Kyle did not buy the gun, his older sister's boyfriend did.
      If the law was minors can not handle or operate a long gun that would mean every father that took his minor child hunting (Which is VERY common) they'd all be breaking the law.

The one with the missing bicep will remember to never wave a gun around and threaten an armed man every time he is getting dressed and looks at his mangled arm. The other man who was intending to kill Kyle with an object made of wood and metal before reaching for his gun was appropriately taken out like yesterday’s trash. The third man who stopped short of attacking Kyle and raised his arms in a non threatening posture was not killed and is likely enjoying a cold beer and a delicious pizza right at this moment. As for your proportional defense argument? Imagine you’re at home bringing groceries through your open door and my friend and I walk in and confront you. It’s a bad neighborhood so you’re armed while carrying groceries. My friend starts swinging at your head with a skateboard then goes for your gun. Meanwhile I am getting my semiautomatic pistol out to threaten or kill you. Since we’d agree that deadly force is perfectly reasonable in this situation the question becomes does Kyle have the same right of defense away from home. I would argue that he does.

    I keep hearing the prosecution and defense refer to what Rittenhouse did as "wrong," but that is what this whole trial is about. There's a very good chance the killings will be found as lawful. Aside from taking the gun from his friend's house without permission and breaking curfew, I don't know of anything he did wrong.

    I’m really liking the two defense attorneys. They definitely go after the state’s witnesses but not in a rude or aggressive manner. In contrast, the lead prosecutor is much more snarky with his own witnesses.

      That's not what the legal right to self defense is. In this case, self defense is a justification for lethal force if a reasonable person would believe that one is at imminent risk of death or serious bodily harm, if a reasonable person would believe that lethal force is necessary to prevent that death or serious bodily harm, and if the person was acting otherwise lawfully at the time that the lethal force was effectuated (the exact wording of that differs place to place). The reasons for each of those criteria should be pretty clear from the following example:
      1. Just because you say you feel threatened doesn't mean you actually were. If you shoot someone for looking at you in the grocery store, even if you personally felt that the way they were looking at you was mean, no reasonable person would believe that a shared glance is threatening of death or serious bodily harm.
      2. Let's say hypothetically that a dog is charging at you to bite you. You are clearly at imminent risk. But if you shoot the dog's owner who is 50-60 feet away in addition to the dog, the lethal force used to kill the owner was unjustified because it was unnecessary to stop the harm. (This is a more clear example, but sometimes it can get complicated by "well, could a reasonable person have deduced that harm could have been avoided without lethal force, perhaps just physical force?").

      Agreed I know they are just scared of being sued or even the mob attacking their businesses again if they admit to wanting the armed men to help. However they should be scared of perjury charges as they are lying under oath. Already a witness testified in this case that while protecting the business some of Kyle's possessions where locked inside of one of the buildings when they returned after patrolling and checking on the other location. The person who locked Kyle's stuff inside was Sam when he said he locked up the building while stating he was unaware of any armed men protecting the business...that he did not see any men on his propertys at that time, yet somehow Kyle's things are locked inside by him. He gave Kyle a ride but says he had never seen Kyle cone on. I would not wish more harm to this family given they have already are victims of vandalism and arsonist but them not being accountable for supporting and even asking for these citizens to help them makes me want to see them with purgey charges. The armed citizens put themselves in life treating situations to help them and knowingly could have died to help protect this family's property and livelihood and they where thankful and blessed to receive such help. The family is not willing to risk or support those men in anyway even being inconvenienced by a possible civil case that they would most likely be found not at fault in to tell the truth about how the armed men ended up on their property. If they would tell the truth it would help Kyle's case that he was trying to help the community and was not acting on his own will but by request of this family that he ended up there. They should be ashamed so many wanted to help them but that they care nothing for anyone else or what results the lack of them telling the truth might have.

    I feel like the defense should be doing more. Why aren't they emphasizing that Rosenbaum was more of a danger to Kyle than to the two soldiers. Especially when Kyle is alone. And they should assert that if Rosenbaum had gotten into a grapple with Kyle other people could have attacked as well. The marine says he would never perceive Rosenbaum as a threat. But then goes on to say if he tried to take his gun he'd consider that a threat to his life. Could he be any more obtuse?

      The defense is emphasizing those things... That's why the attorney asked the questions he did "if he had threatened your life" "if he had been chasing after you" This isn't a time in the trial for arguments, this is a time for questioning. Later the defense will be using these admissions by witnesses to present their arguments.

      Just remember the defense still has their witnesses to call as well. The prosecutor is making the case for the defense at every turn. They are so bad at this that they are calling in character witnesses for the dead which would only be relevant at sentencing. His aunt was not there so her testimony is useless. Rosenbaums fiancé incriminated herself and not Rittenhouse, she testified that she was with Rosenbaum before the events of the evening which would violate the restraining order she had against him.

    It's weird that Balch had a Glock at the beginning of the night, but didn't have it after all of this. And the guy shot in the arm had a Glock at the time of the shooting.

      Shot in arm guy’s Glock was his own. He admitted to having an expired ccw permit at the time and that he had carried it that night

    Huber was just a thrill-seeker and what's more thrilling than trying to -kill- play with someone that -can fight back- seems dangerous? C'mon, he's basically a hero! - The prosecution probably
    I love that the prosecution thinks they're allowed to present Huber as peaceful in nature, and despite the precedent not being on their side, the judge says he'll allow it, and then the prosecution gives up on presenting the "peaceful Huber" lie when the defense pulls up Huber's actual history. It's just all lies with these guys.
