  • The plaintiffs hired the defendant to build a treehouse for their kids. They say the defendant never built it and ruined their kids’ summer. They’re suing for a refund. The defendant argues the plaintiffs threatened them for not getting the work done fast enough.

      I don't know. My treehouse was a playhouse when I was little and a private refuge when I was a young teenager. Kids need a safe space to call their own.

      the defendant probably assured her that he would be done within a couple weeks but instead he disappeared for weeks with thousands of their dollars . i dont know how this judge thought this was just .

      the kids learned that the justice system can be unfair and unjust . all they know is some guy got away with taking thousands of dollars from their parents and did not build the tree house . cmon , the defendant knew what he was doing , its the oldest dishonest contractor trick in the book . get thousands up front and then go missing until the customer breaches the contract by backing out .

    5-weeks for a custom built tree house, including permits and having special materials and parts shipped in doesnt really seem like that long at all. This isnt some Costco shed you buy had it comes preassembled 1 week later. Defendant seemed very level headed and has clearly done these builds before. The Plaintiffs really just come off as very entitled affluent people.

      I agree but it sounds like he provided too much information about his personal issues. That only comes off as "not my problem" which probably infuriated her. When asked, he should have simply provided excuses only related to the parts being order or similar.

      True or not, it just sounds like a bunch of excuses for delaying work, and I think the excuses were what made the plaintiffs angry. Especially the last one.

      @@JamieM470 Yeah I'm with you on that - Although I think the Plaintiffs may have been slightly unreasonable I ultimately think Judge Milian minimized their mostly valid skepticism of the treehouse builder after so many excuses given - Many people would lose faith in him under the same circumstances, especially after agreeing to pay 15 thousand dollars which I think entitled them to better/quicker service than they received.

      5 weeks isn’t. But the problem was that it wasn’t even finished at the 5 week mark. Who knows how much longer it would have taken him to finish.

      well if my neighbor got 7500 dollars up front from me and then went missing for weeks when he was supposed to start doing a job for me then i would get nervous too , and start trying to contact him in any way i think would work . i dont know why the judge was being so easy on the defendant because i have seen her go off on other contractors for far less .

    Build it yourself, That’s the fun in it, my roommate built a triple decker treehouse for my kid, it wasn’t perfect but it was for him, he loved it! $15,000 , so dumb!

      Yeah no. For the sake of my child's safety I prefer to hire a professional or someone I know is good at it. Building a treehouse isn't the same as a renter friendly diy project

      i have zero. he was too skittish at the end with doug. doug cast no shade upon them because shade can only assail, it cannot protect you. and it is completely ineffective against vinnie and rocco.

      I’m a general contractor and my jobs are always done earlier than I tell customers and in budget. They are done earlier as I know in my time doing this things happen. So I tend to quote the job time longer then I know it will take to give myself a window in case something comes up.

    I don't think the plaintiffs were that unreasonable because $7500 is a lot of money to fork up. I believe that the defendant was probably giving them a bunch of excuses and they panicked thinking that he was a flake. It's unprofessional and there are far too many scammers these days.

      If 7500 is a lot of money, then why are they using it to build a useless tree house?
      Now, if they were in need of a rush, they should have stated so. I dont know what planet you live on but building anything in your yard takes time . If they thought they were being scammed, then , why would they expect the money back since scammers dont normally return money or care about a lawsuit.
      It is simple common knowledge that they should have agreed on a start date and an estimated completion date which didnt happen . The judge mentioned a time line in her question because that would have led to a breach if things were not done in time but since there wasnt a timeline included, he could not have been in breach of contract

      Regardless of the cost they think their kids deserved it so spend the money. The defendant on the other hand kept giving excuses and if after 2 or 3 weeks the job was not started then yes parents are gonna go in panicking mode. He totaling his car has nothing to do with the plaintiffs rent a vehicle start the job

    My dad built me a treehouse when I was a kid. It was 2 stories with a slide exit and I’m pretty sure he spent about $10 to build it 😂

      I think you're comparing apples and oranges.
      I bet you that $10 dollars the treehouse your dad built wasn't in great shape a decade later and if a building inspector went over it he'd find something structurally unsound or even unsafe,
      The structure the case is over would be a permanent fixture to the property and be standing as long as the tree does.
      I'm pretty sure your dad didn't get a permit or have it certified as a safe structure.

    I think that the plaintiffs should have let the tree house company know that they needed this project done asap and the company might not have taken the job to begin with. I think the judgment was fair since it was not much time and the defendant was actively replying but a clearer date or an estimation of time on the project both parties should have agreed on a time line of how long the project would take up front would have been much better for everyone.

    For anyone saying, the plaintiff waited weeks, as a defense, obviously doesn't understand the process of custom fabrication. It takes time. Should he have gone on vacation? IMO, NO! At the end of the day they sacrificed a few extra weeks of waiting for years of fun the kids could've had

    The plaintive of got screwed… They lost $5500. now they were a little impatient, but they shouldn’t have lost that much money because this thing fell through. They got worried because this guy kept making excuses. It’s a lot of money that have hanging out there.

    The kids probably wanted a treehouse so they could away from their overbearing father. Right through the trial he was trying to look intimidating and I believe he did threaten the defendant. Wonder if he greased a few palms at city hall.

    Plaintiffs were impatient and unreasonable. If they wanted the treehouse done before summer ended, then they should’ve planned construction during the springtime. He had custom parts already built. These jobs take time. Always expect them to take longer than they say.

    Never pay a contractor 1/2 the cost upfront. Pay a small deposit, set milestones with dates and consequences for missed target dates, and pay the contractor as the milestones are completed.

    That's definitely a Karen and Daren if I ever saw one. Stuff happens in life. The poor defendant had an accident, a funeral and shipping problems. It was only 5 weeks and he had a lot of it built just not installed in the tree. I truly believe that Vinnie and Rocco were coming over.     I would've been a little concerned also, if I was getting the flurry of extraordinary excuses that the Defendant was giving.
    But in the end the Plaintiff's were escalating the situation way beyond what was called for, considering that it was only a few weeks delay and it was August, not October or November.
    And I kind of believe that the Plaintiff did make a threat to send someone over to the Defendant's house.

      My theory was, they were planning a big BBQ with family and friends and wanted to showcase the treehouse. It didn't get done, now they are embarrassed with no treehouse...you know the type...gotta keep up the neighbors.

    Can you imagine if I tell my my clients is going to take me an hour to do a full set of nails and then it will take me 3 hours oh hell NO, he should not say or promise how long is going to take him to build that stupid tree house

    I worked for contractors and permit take time, anything customized like materials take time, weather permitting conditions plus making sure foundation is strong. Truth is we dont know the full story but i have seen jobs take months

    While I do think the plaintiffs were probably behaving entitled and impatient, the defendant did use about six different excuses. A car accident. He's sick. The materials are in the mail. He's on vacation. His schedule is packed. I think someone is allowed to assume at some point that you're just making excuses to delay the job. Had the plaintiffs reached that point in just five weeks? No. I'm not sure how quickly they expected a treehouse to go up, and if you wanted it there for summer, start in April or May, not the beginning of July when summer is half over, but I don't like that the defendant got to skate for using a million excuses and not performing the work.

    The plaintiff probably threatened him, but him not agreeing to build the treehouse is a jerk move. He knew the judge was sympathetic and he was gonna pocket the money. But then again, he was dragged into court and had his good name dragged as well, so nah, I've convinced myself he's okay.

    The judge was way off on that one. The builder weren’t keeping his end of the deal, and with all the excuses and lack of communication from his part, anyone would want to get out of that deal and get their money back. The good couple were absolutely right for being anxious about their kids not being able to use the treehouse in that summer, all because of the negligence of the builder. The good couple lost $6000 to a scammer. Shame on the judge!!!
