In most school districts, a teacher can take the phone away from the child in class. They have a choice to give the phone back at the end of class or send it down to the office and have the principal have a meeting with the parent about the phone use that is against the rules.
If the parent doesn't make sure the child doesn't follows the rules, the principal or teacher can confiscate the phone for the rest of the year.BUT, it is kept at the school in the principal office. At no time is any staff allowed to take the phone home. It does become theft at that point.
