  • In today's video, we're diving into two groundbreaking privacy laws in Maryland (Learn more: www.centraleyes.com/maryland-... the Maryland Online Data Privacy Act (MODPA) and the Maryland Age-Appropriate Design Code Act (MD AADC). These laws are set to significantly reshape the privacy landscape, each introducing unique provisions and challenges.
The Maryland Online Data Privacy Act focuses on data minimization, restricting personal data collection to what's reasonably necessary for requested services. It also limits the processing of sensitive data and bans the sale of such data with specific exceptions. However, terms like "reasonably necessary" and "strictly necessary" are left open to interpretation, potentially affecting the law's effectiveness.
On the other hand, the Maryland Age-Appropriate Design Code Act prioritizes children's privacy, differing from California's approach by not mandating age estimation or restricting potentially harmful content. This could reduce constitutional issues but presents challenges like data deletion when a child disengages from an online service.
