The DC Comics character Shazam was originally called Captain Marvel and was created by a company called Fawcett Comics . Marvel also has a few characters by the name Captain Marvel as well, most notably being Carol Danvers. So who actually owns the name "Captain Marvel"? More specifically, how did the trademark slip through DC's grasp and end up in the hands of the folks over at Marvel? Today, we're learning about the interesting history and legal issues surrounding the Captain Marvel copyright and trademark in comics to see what really happened!
For the record, I know that Shazam is an acronym. I had written that in the original script but cut it out because it didn't flow well in the final draft. My point is that it's weird to me that "Shazam" originated in this comic and wasn't taken from somewhere else. It's too perfect of a word!!!

Captain Marvel (Shazam) has always been one of my favorites. Being a bullied kid, and seeing a character who could say one magic word and turn into a strong super hero... I was totally on board with that!

Turned away from his religion, spent lavishly on temples and palaces, had more wives than Don Juan and Cassanova combined could handle! These scandals and others weakened Israel after he was gone. So the old wizard probably should have used Socrates maybe? Also would have been more in line with the Greco-Roman mythology of the others. And there were even Brand X Captain Marvels. I used to have 6 issues? (I think) of a weird android one in red with a bizarre split power. Less said about that one the better.

Skye Dragon6 DC has Greek and Roman Gods in their comic books just like Marvel, but they don’t have Norse Gods like Thor in their comics, so of course SHAZAM is an acronym for the many many various Greek Gods in the Greek pantheon of Greek mythology.

I said it wasn't that great, not that it's bad. Honestly after the New 52 to me he became one of many (as TV Tropes says) Jeak with a Heart of Gold, which I'm not particularly found of.
It's not bad, but one of the thing I loved about the original interpretation is no matter what happened in his life he was fairly optimistic and even if it was difficult believed in being good because it was the right thing to do.
While in the New 52 (while maybe more realistic) has a cynical look on the world, is arrogant, and when dropped off at his new foster family's home in a backup issue he make one of his new foster siblings Darla cry. (Also in the JL: War movie he's also a pitpocket who steal Victor Stone's jersey for the lol's)
Again I don't find it bad, but one of the thing I feel in love with the character (namely his optimist and kind heart) wasn't in the foreground as much anymore

Billy will always be Captain Marvel for me, mainly due to the popular superhero parody here in the Philippines called Captain Barbell. He's this frail teenager who turns into a super-buff hero whenever he lifts his magical barbell and yells "CAPTAIN BARBELL!" It's beautiful.

Captain Marvel: A human 10 year old boy who found a wizard who gave him the abilities of six gods when he shouted the word Shazam which was the first letter of each of the gods names put together.
Superman: An alien sent from a dying planet who was found by humans and raised as one who is powered by the sun.
Totally the same, I can't believe Fawcett thought they could get away with that, just like Marvel thinking no one would notice that Iron Man is clearly Batman. I: *hopes people understand what I meant with this comment*
MysteriousTomJenkins I pointed out in other comments that it was a lot of little things that added up. But the biggest one probably being how Roscoe Kent Fawcett told his team to specifically create a Superman character, only make him a boy. That definitely hurt their case.

I did hear that and figured that would hurt it but it's still not really much of a rip off. A similar costume and similar powers but their origin, powers, alias, and stories are different. Sounds to me like they were simply mad Captain Marvel was a bigger hit. I noticed that when ever him and Superman are in any sort of conflict Superman wins easily or Cap is taken out easily, at least from instances I have seen.
It's funny because it's actually the costume, powers, alias, and stories that were the biggest factors in showing that Captain Marvel was a ripoff. The costume is the weakest to me, it's just a hero that wears red. Big deal. But the powers were pretty similar. You have to remember at this time Superman only had the power of super speed, super strength, and invulnerability. Captain Marvel basically mimicked those powers with the added bonus of him flying as well. The aliases was similar too. Both Clark Kent and Billy Batson worked in the newspaper industry. And the deciding factor in the trial made by the judge was that the stories told in Captain Marvel and Superman were too similar. In this case, it was simply a lot of little things that added up looking bad for Fawcett.

Just to get back at Marvel DC should create characters called: Private Marvel, Sergeant Marvel, Colonel Marvel, Admiral Marvel, Commander Marvel, General Marvel, President Marvel, Prince Marvel, Princess Marvel, King Marvel and Queen Marvel.
And they should make a team of those characters named F.U. Marvel, obviously standing for First Unit Marvel, What else would FU Marvel stand for?

You left out (assuming you're sticking with Marine Corps/Army/Air Force ranks) Airman Marvel, Corporal Marvel, Lieutenant Marvel, and Major Marvel. But since you tossed in Commander, that also leaves Seaman Marvel, Chief Marvel, Ensign Marvel, Lieutenant Commander Marvel, Commodore Marvel (or Rear-Admiral Lower Half if you want the up to date rank) and Admiral Marvel.

Erik Larsen created a Batman ripoff character called Sgt Marvel for his creator owned Image comic Savage Dragon. Mary might be TV's Sgt. Marvel but they'd have to fight Larsen for the comics rights lol.

I was looking up my Grandfather Robert Hebberd who was an illustrator for Fawcett in the 1940's. He was an illustrator for Captain Marvel #37. Now I have to look up the Ms. Marvel to see if I remember the comic from the 70s, 80s. Thanks for the update.

Billy Batson is now and will always be the one and only "Captain Marvel", his new 52 title is simply a formality. Carol Danvers is now and will always be "Ms.Marvel". I personally don't choose to recognize any other iteration of these names as being anything different.

As I knew the DC version first as I recall, SHAZAM was an anagram for Solomon (Wisdom) Hercules(Strength), Achilles (Courage), Zeus (Dominion or power), Atlas (Stamina), and Mercury (Speed). we learned this in the old 80s cartoon intro.

i always enjoyed the first Captain Marvel for Marvel-- The Kree, Mar-vel (wow, that was confusing). I liked the wider cosmic tone to the series and the connection to Rick, Hulk's friend. Jim Starlin's "Death of Captain Marvel" graphic novel remains a classic to this day. I remember that is was a sad but satisfying story which includes none other than Thanos himself. Great memories... I'm pretty sure the next Guardians of the Galaxy movie will have Mar-vel as Star Lord's father even though Gunn denies it.
Personally I hate that the Marvel movie is being titled Captain Marvel. Mostly because (like im sure plently of people), I always knew her as *Ms* Marvel. And I was one of those who actually know "Shazam" WAS Captain Marvel. So in my opinion the new movie should REALLY be called Ms Marvel, not CAPTAIN Marvel.
It seems the cost of mainstreaming or the movie format is that anything from small details to large chunks are changed or completely left out. It's irksome but I understand things need to be made marketable. - Nali

Mar-vell was my favourite incarnation of Captain Marvel by a long chalk. Jim Starlin's run on the title is well remembered but It's Steve Englehart's time writing it that I love best. He wrote intelligent but accessible sci-fi that, if it had appeared in today's comic book world, would have had every chance of being a great success. Personally I think Marvel are crazy to have just let the Mar-vell character slip away. The Englehart and Starlin stories, plus his appearances in The Avengers such as the Kree/Skrull War and the tying up of the Warlock stories show just how much potential the character had.
Gotta be the Captain Marvel who has the wisdom of Solomon, strength of Hercules, the stamina of Atlas, the power of Zeus, the courage of Achilles and the swiftness of Mercury! Though I won't say no if Ms Marvel is in her trademark black leotard :p

Captain Mar-vell had alot of edge as a character, earned rank & knew martial arts, but was just erased and replaced - sad. Danvers was was best in the black outfit in the late 70's, especially with Korvak in the Avengers.

A new Amalgam universe would be fantastic ! The Amalgam books showed that DC and Marvel didn't take their characters too seriously and that each company could respect many aspects of their rival's heroes. I've got all the original series of books from when they were first published. I think it's the first time a "fifth week" event was so popular that it was repeated the following year -- maybe because of the crossover novelty ... or maybe because they were awesome !

I got to say that I am a fan of "Shazam!" and I enjoyed the comic book series and also the original 1970's TV series as well. I feel that the name "Captain Marvel" belongs in the "Shazam!" franchise. Period.

I'm still just trying to understand how DC even had a case against Captain Marvel, didn't seem at all like Superman to me. Was it a context thing? Like dudes with super powers in general was kind of their turf at the time?
MonarchsFactory Kind of. It was a lot of little things. From a black-haired white guy superhero who wears the color red and is super strong, fast, and durable (at this point in time, Superman only had those three powers. No heat vision or super breath or anything like that), plus mix that with the fact that Billy Batson worked selling newspapers kind of like Clark Kent working in the newspaper industry as well. It was a bunch of tiny things that just added up.

Horror/fantasy writer Manly Wade Wellman who wrote for Fawcett at the time testified in court he was instructed to copy the Superman formula for Captain Marvel. Wellman who also wrote for Wil Esiner's The Spirit, always had disdain for his comic work & considered it an easy paycheck in-between his "real" writing, which at the time was stories in the pulps.

Black Silver Other companies can use it, but they can't advertise or promote anything using that word. That's the nature of a trademark. We can all write our own comics that contain the word "superhero" inside the story, but we can't use it as the title of the story or for any other promotional purposes.

Genis-vell was the greatest Captain Marvel. He may have started out looking incredibly 90's, but he had a large amount of growth as a character where he went from loser to big hero to delusional guy. He is also probably the most powerful of all of them.

I remember years worth of Calling Billy Shazam anyway & having people gleefully correct with "Well actually The Wizard is named Shazam". So all & all I'm actually more OK with the name being the way it is now.

For me the original Captain Marvel (Shazam) is my favorite. I was first introduced to the character back in the early 80's and just fell in luv with the concept. The marvel version just never caught on with me. He or should I say they are ok. But never had as big of a impact on me as Dc's Captain Marvel. I'm kind of still bummed by the name change to Shazam. But he is still one of my favorite comic book characters

I'm gonna go with Billy Batson, though Monica Rambeau is a good second, being respectful of the legacy and very determined to keep up with the heavy hitters.
I think two of Marvel's other CM's were Mar-vell's own children.
Since you covered so much without going overboard, I'll just add something I'm not sure of, but would be cool if it were true. In 1981-ish, NBC Saturday Morning put out the Shazam! Power Hour, with the Marvel Family (including all the classic supporting characters) and with a second feature called Hero High, a light heroes in High School piece, both made by Filmation. Filmation had planned to use its long-time animated Archie franchise for this piece, but the rights expired. Now, the Marvels and the Hero High bunch sometimes met up, which means CM's bunch and the Archie gang could have crossed over on-screen (presuming that CM/Shazam! wasn't a way to salvage the lost Archie rights). Besides the nerd-gasm that would entail, IMO the meeting of the eternally retro-present Archie and Billy would send both shows straight back to the 20's!
I forgot this one : The Post-Crisis 'Shazam : The New Beginning' which you mentioned, and written by Roy Thomas (who knows the Golden Age the way most people know their birthdays) was not the main Post-Crisis version of CM. It had that miniseries and a run in Action Comics Weekly, and featured retcons like Sivana being Billy's inheritance-stealing Uncle and Captain Nazi being an amped-up Neo-Nazi from the present. But it never took, and years later, they launched 'The Power Of Shazam!' which kept a lot more stuff from the classic series while not launching full into goofy fun. All the 'New Beginning' stuff was outright ignored in favor of the new series' continuity, without a cosmic event erasing the 'New Beginning'.
I also realized you mentioned Fawcett had a Supes-expy called Master Man, who DC hit them on successfully. The name Master Man was used in the 70's book 'The Invaders', written by Roy Thomas and featuring the WW2 Power Trio of Captain America, Namor The Sub-Mariner, and the original Android Human Torch,along with their sidekicks and any obscure guests Roy could pull up ( I know you did the piece on Thor guesting with them, but I thought I'd remind ). So Master Man here is not a hero, but a Nazi German Super-Soldier effort, whose origin and look seems very similar to the classic version of CM's foe, Captain Nazi. If it were anyone but Thomas, I'd call it coincidence.

If its a casual way of saying "Shazam" it wont activate the spell turning him into billy and vice versa, but if he said it in a loud more serious tone like "SHAZAM!!"
then the magic would turn him back and forth.

Tarzan, Buck Rogers, Flash Gordon, The Spider, Chandu the Magician, Mandrake the Magician all appeared before Captain Marvel in serial or other films. They also appeared before him in stories in print.
It should be noted that DC published reprints of old Fawcett Captain Marvel stories in the early 70's (I was a fairly avid reader) under the title "SHAZAM!" (technically, "With One Magic Word, SHAZAM! The Original Captain Marvel"). It's probably the source of much of the confusion of those who kept calling the Big Red Cheese "Shazam" instead of "Captain Marvel" until DC decided to punt and just change the name of the character.

Shazam/Captain Marvel is an awesome character IMO and I will never see or be able to take any other character of that name seriously. But to be quite honest the name Shazam is growing on me, and I've always thought Marvel was a lame name anyway.

If I'm not mistaken, Carol Danvers also took up the title at the end of Giant-Size Ms. Marvel #1 from 2005(?).
Genis Vell is my fav Cap. Marvel by far, and I still think of Danvers as Warbird from the Busiek Heroes return era.
While the Marvel Captain Marvel had some nice cosmic moments at times, especially when Jim Starlin handled the character, and I rather liked the Ms. Marvel series of the 70s, I'm still going to have to go with original Fawcett character being my favorite. He had a certain whimsy and charm at Fawcett that DC has never managed to capture since they've been doing him, although the 1970s series wasn't too bad. And the E. Nelson Bridwell/Don Newton version was amazing!
Another interesting fact to me is that, while DC got the rights to use the character, they didn't bother to protect the copyrights on the original Fawcett stories of Captain Marvel and the rest of the Marvel Family. So all those Fawcett stories are public domain and I suspect that they could be reprinted by anybody, although I guess because of the trademark issue, they couldn't put "Captain Marvel" on the cover any more than DC can. Still, anyone can go to one of the public domain comic sites like Comic Book Plus or the Digital Comic Book Museum and freely download and read the original Fawcett stories.

My favorite Captain Marvel is Billy Batson, he was the first one I saw on Saturday morning television and I wore as my Halloween costume. Didn't know know about Mar-Vell until much later.
I dont care if Marvel has their Captain Marvel, I just want DC to change the characters name back from Shazam! He is not a Pokemon, and he is not the wizard who gave him his powers. And as the video says, they can publish the character with that name, just titled Captain Marvel or advertise it. So the fact that they changed his name to Shazam! is just lazy and stupid

Actually it is you should probably pay attention.
DC can refer to the character as Captain Marvel. They changed the characters name to Shazam with the debut of the 'New 52' in 2011. In the almost four decades prior to the debut of the 'New 52' the character was called 'Captain Marvel'.
They just can't use the name on the cover or in advertising material. Within the stories themselves they can still use the name.
In fact even after the debut of the 'New 52' and the official name change to Shazam DC continued to use the Captain Marvel name. In the 'Multiversity' mini-series from 2015 Captain Marvel, and the entire Marvel family, were referred to by their traditional names.
I invite you to locate a copy of 'Multiversity: Thunderworld Adventures' #1 from February 2015. In that comic you will see the title of the story is 'Captain Marvel and the Day That Never Was'. In the story itself the character is named and called 'Captain Marvel'.
So, again, you might want to go back and actually pay attention to what was said in the video before you tell others to do the same.

When he talks about kid sidekicks like Robin and Bucky he gives the impression that they existed first and that Billy Batson/Captain Marvel was an improvement on them. The first Captain Marvel story came out about 3 months before Robin was introduced; Bucky appeared about 9 months after that.
Shazam obviously go DC! And Fawcett. I wish he were still Captain Marvel though. Funny story when I first heard of the character (Dc's one) I thought his name was Shazam, but 3 years later I found out his name was Captain Marvel. I finally got used to calling him that when Dc changed his name back to Shazam.

Mar-Vel would have been better as he was traditionally the hero who fought Thanos. but most people have forgotten that. Plus The Death of Captain Marvel was one of the best written graphic novels ever.
I acquired a copy of the limb-splitting guy. To be fair, his backstory isn't too bad. A sentient alien robot, posing as a college professor (remember James Marsters in Smallville?) here to observe humanity, and he is committed to helping out where he can. There was a disturbing aspect to a story in that issue: there were 6 booby trapped pens out there and he had to retrieve all 6 before it was too late. The hands had an easy time of grabbing pens, and his head grabbed one in his teeth. I don't know his legs grabbed pens since he wore boots, but I have to keep pushing out from my mind the image of how his torso must have grabbed one.
***** DC gained the rights to the Fawcett characters outright far earlier than the 80s. DCs multiverse stories had become very popular, especially when the JLA and JSA teamed up. A turning point happened when they teamed up with Uncle Sam and the Freedom Fighters over on Earth X. They were from Quality Comics originally and were also one of DCs big competitors. Sorry Timely, you weren't even on National Publications radar. DC had snatched up the rights to these characters after the company folded, that's why the Golden Age stories are public domain and not the characters. Same thing happened with Fawcett. Marvel had actually copyrighted the word marvel, preventing anyone from using it. This enabled them to create their own Captain Marvel. DC did sue at the point, already owning Captain Marvel, but they didn't own the name, just the character.I read that in an old issue of Alter Ego I cannot find at the moment. There is some suggestion that Marvel did it deliberately, taunting DC and preventing DC from reviving a character that once outsold Superman, In Captain Marvel #17, Marvel gave DC the proverbial raspberry when Rick Jones found Mar-Vel's Kree Nega Bands and by clanging them together and Shouting Mar-Vel, he switched places with Captain Marvel, who was trapped in the Negative Zone for some reason. It took some time, but in 1973 DC Published "SHAZAM! Featuring the Original Captain Marvel #1" It was written and drawn by the original creators. The stories took place on Earth S, a much kindlier and kid friendly Universe that featured all of Fawcetts heroes. Then in 1976 in Justice League of America # 136, The JLA and the JSA teamed up with SHAZAMS Squadron of Justice, a team of the Old Fawcett heroes to save Earth S from a Caveman enemy of the big red cheese. The Fawcett characters would be a staple of the DC Multiverse, even playing a part in Crisis on Infinite Earths. Let's not forget The World's Mightiest Mortal getting his own DC backed live action tv show in the 70s. I love your videos btw.

***** Yes I do, it was a comics encyclopedia from the Smithsonian from the 90s. It had all the first appearances of many major characters as well. I could tell you what it was called, but my brother swiped it. I'll see him soon and look for it, but it was a hardback book from the Smithsonian.

When Fawcett shut down their line of comics in 1953 after the settlement with DC, they still owned the copyright to the character, but allowed the trademark to lapse, as there was no reason to expect anyone else would use it. In the very early 1960's the company that had just started publishing "Fantastic Four" amd "Spider-Man" decided to change their name from "Atlas " to "Marvel" for reasons that included that their very first comic published was called "Marvel Comics" and the word "Marvel" sounded cool. As the video then describes, MF Enterprises came out with their CM in 1966 to catch the superhero pop culture explosion and Marvel took notice, creating their own. IT was not until either Jack Kirby or Carmine Infantino over at DC got the idea to acquire the original hero that DC had any access to it or interest in it. They then leased the rights, but, wary of infringing on MArvel's trademark, titled the book "With One Magic Word...SHAZAM! The Original Captain Marvel!" This was an attempt to "pull a fast one" by getting the hero's name on the cover. Marvel got in tough with DC and told them to stop, so the title was changed to "...The World's Mightiest Mortal!"
those original "Shazam" Comics from the 1970's were drawn by CC Beck and Kurt Schaffenberger, artists from the Fawcett days, but were written by contemporary DC writers. Bill Parker (the creator) and Otto binder) the most prolific of Fawcett's CM writers) were no longer writing comics at the time.
All this info is in Alter Ego, Marvel's Masterworks Editions reprints of their Captain Marvel comics, Steranko's history of comics, and was told to me in person by folks like Roy Thomas and Carmine Infantino.
