Is there a specific time frame from time of arrest to time on the machine in the police station, I was arrested then put on the machine over an hour later also was put on the machine 2mins after being sick ?
The breath test gives a result straight away. If it shows you’re not over the drink drive limit, you may be allowed to go.

Exactly. A lot of it comes down to who you are. The hard working family guy gets the full whack, where these so-called 'celebrity' a**holes get away lightly. repeatedly.
They kept getting my name and date of birth wrong on quite a few of the letters and documents i had sent to me. Even until the day of the case...in court they read out my date of birth which was wrong... I said no thats not me....
Its a good help on understanding but what if the info once large sheet and the breath slip is wrong?
ken john Every case is different. Some errors can damage the police case but minor mistakes don’t usually make a difference.
@@ThedrivingsolicitorCoUk I blew 38 on the machine in the police station but due to me arguing the whole time I was there, he grabbed the sheet out the machine didn’t show me or tell me the results then come back 5mins later and said I blew 61

I got charged with failing to provide, idk how anyone can blow in that thing at the police station, 1st time they gave me more chances to blow and it was under so I went home, second and last time they only gave me 2 chances to blow, so I was charged for failing to provide, I managed to get a free solicitor, he got me a free psychologist, the cps never sent us the video footage that we requested, on the morning of my court case my solicitor got an email from the cps saying there not pursuing the case, my solicitor said its likely because it would cost for them to get there own psychologist to fight my psychologist so all charges got dropped.
The cps didn't even attend court, the court was puzzled too, they knew I was in there but wasn't sure why, my solicitor had to explain to them. I don't drink any alcohol now. I won't even get in a vehicle with anyone who's had any alcohol now.

I don’t understand why it’s a minimum ban of 12 months yet on the Government website it says a “possible driving ban”
Because there are circumstances so they say where a ban will not be imposed

Yeah like if you went to church and drank too much holy wine. Then get stopped by police on the way to the charity shop.

Hd40 they won't accept drinking wine at a church as an excuse, there's no excuse for being over the limit. I knew someone who got drunk, he hung his car keys up in the back of the car and went to sleep, a police officer woke him, breathalysed him, he got charged, but because of the circumstances and that he'd lose his driving job, they banned him from driving for only a month and he kept his driving job. Idk how he kept it though as the company don't accept anyone with a DD on there licence and it stays on it for about 10 years, I guess they must of kept it from going on his licence somehow.
Sir good evening, I'm a filipino new comer here in karratha I was been caught by the cops driving with .08 range of alcohol in a breath test. My licensed ban for 2 months. These March 11 I go to court. My question is there is a fine for it or what should I do.? Thank you so much sir for your time.
Is this a procedural error on MGDDA form,
1. Question A8 = Officer: any alcohol drink consumed since the time of the alleged offence'? Me: yes, Officer: let me ask you again have you consumed any alcohol drink since you were stopped? Me: No, 2nd Officer: So since you were detained? Me: no.
2. Question A11 Officer asks same question but in the last 20 minutes. I gave no response but only shook my head however officer specifically writes No and not no reply and doesn't make a note of a nod.
3. Question A17 providing the copy of print outs and reading out the statement in ittalic. Officer do not read the ittalic statement and just hand me over a copy to sign.
4. No MGDD D form was filled out due to question A8 although stating during the interview no alcohol was consumed prior to driving and only moments before arrest.
All this is backed up by CCTV evidence which I have confirmed.
Is this the same procedure at DUI?
DUI is what drink driving is called in USA. I don't know much about Amercian laws but I guess that some of the principles are the same.
