    Hi. Can you all do a segment on Retroactive Backpay for MST Survivors which was just signed in HR 9164. Go to Gov Track. Type in your area and find your district representative and ask them to sponsor the bill H.R. 9164

    I filed before I even got out but come to find out my unit never put it in and had others who destroyed my claim with out even putting it in because he claimed I would never get it anyways

    Your firm filed for me under several disabilities related to agent Orange in camp lejeune water you were very successful in all those areas except hypertension high blood pressure I had had chronic for years and my doctors did not know why as my diet and physical was very good,
    I now have increasing problems with cancer of the bladder and hypertension continues to be a daily battle to control
    How do I refile for hypertension is that was denied in 2015?
    I called your office and got a run around

    Q: Is the date of entry or the date of active service the date that should be used? If the date of entry was into the guard with continuing service into active duty?

    hello Hill & Ponton, good info but I was wanting to know if a claim got denied and after a few years can a supplemental claim be filed if the vet found a huge piece of evidence? Being denied for tdiu with 80% overall and having been denied vr&e benefits twice, one time stating that is not feasible due to service connected disabilities. The VA said that non service connected disabilities make me unemployable.

    I received a Higher Level review in early Oct upping my rating from 80 to 100. My effective date went to Mar 9. Since pay between 80 and 100 is significant, does VA owe me the difference from Mar to Oct?

    I was 30% migrane i filed for increase they denied me and drop me to 10% smh. June 2019.
    Did intent to file within that year And increased to 50% May 2022 withno back pay.
    VA STATES MY NEW EFFECTIVE DATE IS WHEN I GOT MY NEW VA INCREASE ÀND GAVE ME 1 MONTG BACKPAY LOL. SMH

    What if you have 100% P&T after a few years, and then are granted SMC-S, with a service connection that was recently filed and granted as a primary condition dating back to discharge? Are we to receive the difference of back pay between the 100% P&T and the SMC-S payment? I can't see, to find that answer anywhere. Please advise.

    I was denied a claim for sleep apnea around 2012 or thereabouts. I have tried several times since then, though never continuously within the twelve month window, to show additional evidence including Buddy Statements and medical records to no avail. I even received this message in one of the denied claims: "Your service treatment records do not contain complaints, treatment, or diagnosis for this condition." In October 2022, during a higher level review, my claim for sleep apnea was approved and was back dated to March of 2022 when the higher level review was initiated. The reason the higher level review was approved? Failure to assist. What the higher level review found was a statement I made to the Army Dr. during my exit physical in June-July of 2000 wherein I stated that I had difficulty sleeping. So If this was the evidence used to overturn the earlier rulings, is it possible to get back pay to the very first time I was denied for sleep apnea since the evidence to rule in my favor was there the whole time...but the VA had overlooked it? This would be approximately 10 years worth of a 50% rating for back pay if so. Please help.

    I am service connected hypertension 0%. 5 years later. I file a increase. And if approved, 10-50% i get 5 years of backpay?

      You must appeal your decision of the 0% within 1 year of the decision every time until approval to get that

    Stop playing music on any updates. It serves no purpose...also with hearing aides...it's really frustrating.
