      Both comments are correct but proton byte is spot on as if they knew why or had a genuine reason they would say and would just arrest him as if not why detain him on the road?...... They try intimidation tactics because they want his details and can't handle the fact he dared to refuse and uphold his rights as the law directs!.... If he had committed a crime they would just arrest him instead of talk for 20 mins!

      @@daveyber3564 I think the threat of detaining someone if they leave is worse than just detaining because that will give other officers the idea to also do that setting a bad example, and it makes the police less liable because they haven’t actually detained you, not to mention it worked and kolee gave his details in the end, I’d def at least put in a complaint about that officer

      They already unlawfully detained him by saying words to the effect he couldn't leave. Unlawful detention can be verbal.
      Then they make it physical detention using force. The detention began from when they didn't say he could leave when he asked.

      Have you seen the time "Man in the High Castle" is having trying to sue Police Scotland for wrongful arrest while auditing? Check his YT channel out, he has a white Rook from a chess set as his avatar. He got arrested at RM Condor Arbroath, he got arrested at Aberdeen, he got arrested at Dundee, he got arrested at Glenrothes and he Got arrested at Kirkcaldy and I don't think he has managed to even get his kit back from any of them let alone a penny of compo. It would seem in attempting to sue them you are taking on the whole of the Scottish Government and legal system and they simply refuse to let it happen. Corrupt to the core.

    DO NOT GIVE YOUR DETAILS!!! Just leave .. you are not detained! Make your phone call .. do not ask! Repeat, you are not detained. Ignore the threats of arrest! OR -- let them unlawfully arrest you. You'll be out within the hour and you can sue them! They are bluffing! At no point did the police commit to saying that they have detained you! Just ask if you are detained again -- then GO!
    Then --- FFS!! Illegal detention ... and you let them win! You shoulda stood your ground and they'd have been f*****!

      If only it were so. This is not England. Scottish Police are more corrupt and have deeper layers of corrupt supervisors to fall back on. Koleeberks would not have been "out within the hour" (probably held for 24 hours after some dodgy Inspector called "terrorism") and then only released once ID is established or else it is off to clink on remand. Once ID given, fake charges would be laid and draconian Police bail conditions set enabling them to arrest if any future Auditing takes place. Trial in 2 years, with Scottish Police failing to turn up again and again, forcing a rain-check of proceedings, greater stress, greater costs. And all the while the PF threatens pulling the bail if any of this is challenged in court. THAT is how corrupt it is in Scotland and why we are so desperate for change. THAT is what happened to Man In The High Castle. BUT, it doesn't mean that this is the only way to skin that particular cat.

This place was staffed by professionals in the past. Their limited intellect renders them capable of nothing more than four repetitive statement/questions. These dopes can’t put the law before their fragile emotions. Very disappointing, Fettes, you ought to ashamed of the performance of these incompetent’s because this is simple intimidation with demands, which, when rejected, become “oh I’m only asking”.
    It is horrifying to see this sort of police state behaviour in our local police force and it is easy to see why so many decent members of society hate the police now. This is narcissistic thuggery and it worries me that these emotionally unstable pricks are in our communities with guns.

    That was the biggest load of bull I have ever seen!
    They had NO grounds to detain you and yet you weren’t allowed to leave??? So, you were detained then?? And, if you were detained, what section were you detained under?
    It’s another case of; “detain/arrest first, find an excuse later.” It’s disgusting 🤮

      He wasn't detained under any section of any law, hence it was an unlawful detention at the point the belief was created in his mind by the actions and words of the PC - that's what a judge will say and the police's solicitor knows it and will settle out of court

    By talking about having a genuine motive you up the level of suspicion in there eyes and potentially in a judges eyes, so watch your language that you use with them. Also buy telling them that they can detain you and search you its almost like you are giving them permission.
    You need to tell them what you are doing ie photographing and videoing and then walk away from them. If they try to stop you or give you any hassle then you have a clear claim against them and it will increase the number of things you can claim for.
    If they are going to detain you as they can't decide on an offence then its not a detainment and you can walk off. They have to give you the actual offence you are suspected of.
    The office saying he is not doing his duty if he lets you go so will arrest you is not doing his duty in detaining you a member of public obeying the law. Needs firing and made an example to the other officers that stood buy like idiots, but we all know he'll get a pat on the back and a promotion, so the only option is a civil claim against him.
    Big fail handing over your details, turning off the recording and not defending yourself against the officers.

    The officer with all the dirty gang tattoos clearly didnt know the law and was out of order. Why did he keep saluting ? , hope you are ok , usually when they get the camera off your in real danger of a beating, those are usually the most corrupt ones that tell you to turn off the phone. Ignorance of the law was well demonstrated by these police officers hopefully they get sacked for this. (Tattoos should be covered by long sleeved uniforms as these people scare the public)

    This HAS to be pursued legally, they totally violated your rights and not once did they state any laws or legislation that they were detaining you under. They kept saying “you will be detained” but legally you were detained for the entire length of this video because they would not let you leave. Absolutely disgusting abuse of their position.

      This is not England, where Police can be and are, sued for unlawful arrest. Police on the streets of Scotland are a law unto themselves and together with the PF office, they treat filming cops as terrorism. So they will detain for 24hours or longer if no ID is given and will push for years in jail from the court. There is also very little chance of a cop being held accountable and any civil case will takes years because they have been allowed to become experts at abusing the legal process and stretching out court cases. This is how wide the corruption has spread and how deeply ingrained it has become in Scotland. Do not expect justice here.

      @@alma4071 My point was quite simple, But I will explain, If he was about to do something that could possibly get him into a cell of some kind, albeit through no fault of his own, it is probably not a good idea to take, or have a member of his family along for the ride.
      That is why I said, "if you are not prepared to go the distance, do not start the journey"
      I believe Kolee understood what I was saying, Maybe I should have put more emphasis on the word PREPARED.

    Did you give details? How did it go down in the end?
    Sometimes you may have to concead dependant on circumstance but you would still have a civil case as it was under threat of arrest which is unlawful.

      They put hands on him when he tried to leave, yes they acted unlawfully by not quoting legislation but this is not surprising, if he continued to try and leave they definitely would have arrested him using force. You're correct though as an auditor he should have held ground, but on this particular occasion he had other obligations that would be inconvenienced. Ordinarily he does hold ground, has done so on many occasions.
