  • What is going on everybody, this is TGA, and in today's video, we're at Porton Down, one of the most secretive sites in the country, MOD police were fairly reasonable, although they were nitpicking the byelaws at the end.
    Big up to ‪@koleeberks‬, who visited this site a couple of days after me.

    Another good interaction by MOD .
    I don't think he was 'knit-picking' at the end, he was just clarifying the rules and openly said he should have told you earlier. Apart from having to correct his initial mistake (and credit to him for that) he came across as professional. What more can we ask.

    Ironic though that two auditors can stand outside a chemical and biological weapons establishment within the space of a few days and neither are detained or searched - and yet dozens being detained, searched and arrested outside city police stations due to "the terrorist threat". - couldnt make this shit up if you tried !

      I eagerly anticipated watching this video because it's Porton Down but, it might just as well have been any other "so called auditing video" taken outside the gates of a Mr Kipling's cake factory maybe or any other such mundane place. I've watched a number of these "so called auditing videos" now, in a genuine, but so far futile attempt to understand the point of these cinematic masterpieces but, other than being the most laziest, unimaginative and utterly banal CZcams "content" currently created simply in order to generate some form of income to the self appointed (and extremely self deluded), arrogant and egotistical "citizen journalists" that "create" this stuff, I see no point to these videos whatsoever. Getting back to the topic of Porton Down, whilst not in danger of winning any BAFTA's, IF YOU WANT TO SEE A PROPER "AUDIT" the videos created for YT by @TheSecretVault when he visited the area are in contrast to the trash produced by self important people calling themselves "auditors", a lesson in how to create content that's more than just remotely interesting.     if only the MET and other police forces took a leaf out of the MOD police way of doing their job with respect and educating and not slapping people in cuffs and misusing section 43 /50 and other sections for no crimes being committed

      Interesting bit of history there, I'm certain it's still used for chemical weapons, from what I'm aware they examined the Novichok used just down the road on Sergei and Yulia Skripal there

    I don't understand why people still think that public access/public right of way means they think its public land, all MOD land is private as its Crown property, and whilst there is at times, public access, the same rules apply as when on private land.
    You may also find the tresspass laws are a little more stringent.
    Then there is Section 33 of the 1972 CJA, it really has nothing to do with your rights on public land, anything to do with land comes under the lands act, the CJA is for criminal offences, and if people actually look up what it actually refers to, may well see its a part of a different act (read the small print).

      There is no public land in the UK. There is land that you can't be trespassed from, such as pavements and public rights of way. But these are on private land, with pavements owned by the local council. So, no the rules are different to being on private land. And there are many types of private land, from homes to parks. Each has different levels of access to the public. Section 33 is an example of the use of the common legal term "public place". It's also gaslighting as anyone who doesn't state that it's only to do with political uniforms proves that they know nothing about the law so any statements they make are just their opinions. Finally, there is no such thing as crown property - it's just a different term for government owned property, it doesn't have any other special meaning.

      @@TheSadButMadLad Section 33 of the 1972 CJA is totally used incorrectly, I wish people would look it up to see what it actually means.
      Crown property is exactly that, the head of state is the Queen, its her Government, she may not have as many powers as they had pre Cromwell, but she still has a fair few.
      And whilst council land is private, it is deemed public with some exceptions (carparks, sone parks etc), rather than having public access or public right of way.

      @@tonyb1223 Well if you have a problem with s33 not being used correctly, get the police to use all the other laws properly too.
      Nope, the only real "Crown Property" is the Queen's household properties. Not the government. The Queen head of state but it is a constitutional monarchy so she has no real powers. All government is run by the PM. The Queen is involved via the Privy Council, but not in any control manner.
      Public rights of way can exist on council owned land. Any land designed for the public and is publicly accessible is "public land" and that includes shopping centers as well as parks etc. But they can still be closed to the public at certain times of the day.

      @@TheSadButMadLad The Queen has more powers than you think, she can dismiss a PM, she has that power, she can declare war, if the government wants to go to war they have to ask the Queen to use her armed forces.
      As for section 33, its only viable when used with the 1936 POA, which its an amendment to, can't be used or misrepresented for anything else, only that act.
      Publically accessible land, it can be private land, it does not mean its public, same with MOD land, its actually not public and can be closed off when used for training.
      The likes of many car parks, pubs, shopping centers, supermarkets etc are public access but still private, if people keep ignoring the rules on these then all that will happen is a more specifc law will come out defining acts that contravene it, its pretty much shooting yourself in the foot for not engaging the brain, we have already seen such actions in photography and filming where specific laws regarding photography/filming have been introduced over the last couple of years, considering that in the near 200 years that photography has been around, why have 2 laws now come into effect within a very short period of time? Pushed those boundries too far maybe?....

      @@tonyb1223 Sad but mad Lad, has been told many times that "sect 33" does not give grant or imply ANY rights or permission of access to private land.
      It all started because Marti Blagbourough, thought he would play barrister one day, And googled "define public place". He then added sect 33 to the Trotter ACPO letter, and concluded that he then had a "right" to wander around any unsecured private property he chose, with immunity from conditions of entry or removal.
      Sect 33 exists....but it does not "do" what auditors think it does.

    An "open gate" does NOT give an implied right of access.
    And don't use "sect 33". If you read it CAREFULLY..you'll see it's a public place "IF" the public have access. It doesn't GIVE you access.

      @@TheGwentAuditorTGA Yes it does sound unusual. Although the MOD do own rather a lot of land around the country, so its probably not unique. But the signs are clear. Its MOD (private) property, and public access is by "permission", not by "right". So, yes the sign informs the public they can enter.

      @@TheGwentAuditorTGA There quite a few road that pass through land owned by the MOD, they typically close the gates one day a year (at least) to prevent it becoming a public right of way, but other than that they leave it open, but it still forms part of the Crown Estate

    So why haven't they gone after Google to blur all street view images taken from that road? Or blur any aerial photography? (which Google do for sensitive sites when they are compelled to).

    By laws have to be posted PRIOR to where one can progress to.

      Exactly and it says Military bye laws apply on the fence, which I did not pass, it also says Trespass is a Criminal offence under SOCAP on that fence, which means that would be Porton Down’s boundary

      One thing about signing that I understand is a simple notion that the sign effects everything after it.
      In otherwords, a 30mph sign on the side of the road ONLY pertains to the road BEYOND that sign, right?
      So technically, where there is a sign saying "No Ball Games" on the side of a house, then SURELY it means not to play with your balls INSIDE the house!
      Just wondering.

    I'm sure he said "Without prejudice" just before he read from his book. That means whatever is in that book cannot be used in evidence. In effect, he was waffling shite and it only applies if you agree to it.

      No, it means that they will take no action this time, its a bylaw so its still law and you can still be done under it.

      @@tonyb1223 Perhaps, one day you'll understand using it means the statement cannot be used against you in court. He's virtually stating "this is a by law but my using it cannot be used in court against me. Nor can it be used against the other party in the negotiation or settlement.

      @@thefoxhat6163 it basically means without detriment to any other right or claim.
      The bylaw is still an offence and will come with whatever punishment is associated with it, in this case he's let it drop and instead educated rather than punish, which is probably the better option.
      Looking it up, for that area its a fine of £500 (max) as of 01/09/2008.

    Crown Property doesn't allow photography on any of its property, including Royal Parks and Gardens. I've been asking auditors to challenge this bye-law for years. It is I believe unlawful and I also don't believe Crown Estates would ever prosecute for breaking this byelaw. Crown Property is in a limbo status - it is held by the Queen but not owned by her. Is it ultimately owned by the government? Or by the people? Nobody wants to try and sort it out so they avoid raking up legal challenges. If you can get fined and then appeal up to judicial review it would force a definitive legal decision with huge ramifications and the Establishment doesn't want that.

    Would have been interesting to see what he was covering up with his thumb when showing the by-laws. Something tells me he was covering a part which gives you the right to film! He was trying so hard to keep it covered!

    If its a crown road or not if you auditors looked up upu postal machincs and used that ruling you'l find all roads are postal roads and as being a post master your federal backed by the federal union
    Legal loop hole may be worth looking into

      Yeah they do a lot of fishing they tried to follow me to the car after this, however I didn’t go straight to the car I’ve learned better than that now lol, went in the pub for 15 - 20 minutes to get some food and a coke, then walked to the bus stop, circled round and went back to the car and drove off
