CJI Chandrachud recalls Delhi vs Centre verdict: 'Applied concept of Constitutional morality…'

  • Addressing a conference on Contemporary Judicial Developments in Kolkata, Chief Justice of India DY Chandrachud on June 29 explained the concept of “constitutional morality”. “The thing we are going to discuss is constitutional morality… Constitutional morality is not found anywhere in the Constitution…The Constitution uses the expression ‘morality’ but does not use ‘Constitutional morality’… Morality in article 19 (II) and article 19 (IV) is a restraint on the rights of the citizens…At one level, constitutional morality is found in the preamble values… I was one of those who applied this concept of Constitutional morality when I wrote the judgement in the first round of the battle between NCT of Delhi and Union of India about six or seven years ago,” said CJI.

    Where is morality In case of poor people there is no morality. Injustice always given to politicians and rich peoples.Mr.CJI can you tell the people why D.A. case is delayed day after day ? Why political criminals are getting stay order day by day. Why they are spared day by day in your court. You are not strict to corruption.Your judgment sometimes go in favor of political criminals.

    To be just is to ask for fair play. Fair play has to be understood in a wider context. It is not limited to family but includes being just with the environment, being just with money, and the distribution of wealth. Also, how prisoners and other minorities are treated? The implementation is not limited to one's communities and one's family. but extends to the outer society, for example, injustice is knowingly polluting the environment.

    Hemant Suren, CM of Jarkhand after 5 months got the bail on ground that there are no evidences of his involvement... How can we interpret this one..?
    At CM level this happened but what about common people... Where is justice, where is transparency..?

      High profile, cases like CM agency's don't arrest with out one percentage proof.... Kourt just.... Like Delhi high Kourt said no time to read whole documents and given bail to muffler 👨

    Morality is this word has any positive meaning in our society also also in our law system as defined in the constitution. The best example for negative lady morality is sitting in the dias as in the history of Indian democratic politics , a governor of a state has filed a defamation case against a CM as per media reports , on reasons that cannot be disclosed in public because of it's nasty nature.

      Framing of laws is the responsibility of the parliament. Court has the responsibility of ensuring that the rules framed by the parliament are followed in totality. Now the courts have started framing rules and in the guise of Judge's discretion, different justices are giving different decisions on similar issues. This is totally unfair.
