  • The plaintiff used to be married to the defendant’s sister, and he sees him as a younger brother. He claims the defendant stole his tax refund, so he’s suing. The defendant denies taking the money. He thinks his sister took the money and is lying to him. He’s countersuing for emotional distress and slander.

    What's so hard to understand. She transferred the money to a capital 1 account. Her brother said it was fraud and they reversed the money back to chase. After that he cancelled the account and took the money. What's so hard to understand

      i think it was not proven. and the burden of proof is placed solely on the plaintiff. instead of accusing him they should have gotten together and got to the bottom of where the funds went. if it was reversed back to the chase acct. then start there.

      When Judge Mathis took a recess I knew he couldn’t figure it out. That’s why I like judge Judy you gotta come court with clean hands. They had account in the defendant’s name to avoid paying something, she would’ve dismissed case off that alone. 😂

    I think judge Mathis had a bad day on this case. I thought it was pretty cut and dry. When the deposit was reversed it went back to the original place it had been deposited to.. And then the brother-in-law closed the account.

    JM's confusion comes from a lack of understanding on how some things work!!! The plaintiffs misspoke by saying the reversal would show Chase however a reversal means it went BACK to where it came from!! A statment likely doesn't have enough room on the line to show all the details!! The defendant ALSO said he disputed the transfer he also said he closed the account and the lady defendant no longer had access!! Whether her name was on it or not at some point she had access with a card or online and he stopped that! If JM would stop getting hung up on one word and not flip out, they could explain themselves. Plaintiffs also should've gotten a statement from the IRS showing where the money ended up before someone was able to spend it.

    The plaintiffs did not prepare well at all for this case. The problem was that both of them were talking at the same time and that was even more confusing. I think the defendant probably did take the money, but they couldn't prove it because they kept over talking one another and instead of listening to the questions they were so quick to respond with what they wanted to say. Judge Mathis got tired and agitated and we all know once that happens, case dismissed!😂😂😂😂😂😂

    The plaintiff was doing a great job UNTIL his witness (now I see why she is the x-wife) kept talking loud and over him, and answering JM's questions wrong. She would say "yes" and he would say "no" BUT she's ao loud, JM only heard her. He should have made her sat back down

    What they don’t realize is once a IRS deposit was reversed to your bank after that you had to go through the IRS then it goes into a investigation and you won’t get your money maybe to a year after that it’s not coming back to your bank

    If they had evidence that the money was transferred into one account then reversed back into the account idk why he wouldn’t believe them. He should’ve asked the defendant what or where the money was originally from and if it was his to begin with or asked why it was reversed back into his account. I feel like this case was pretty straightforward, but they kept over talking each other so it made it harder to understand.

    The plaintiff contradicted themselves AND lied about the defendant pulling a gun on him. Plus the defendant said that the plaintiff's witness was fired for stealing on the job lmao so her credibility is zero. It's one thing about a thief they know how to lie and that plaintiff female was lying her as$ off. The plaintiff's witness and baby moma stole his half of the tax return.🤣

    I worked for a bank. With ach, when they are reversed it doesn't go back to the bank automatic, if he closed it the next day, before it the funds came back to the account the funds more than likely went back to the IRS, because they have no acct to go to. Now what they should've done was went to the irs, and filed fraud against him .

    So why the judge didn’t ask where the documents showing he has proof she took the money out

      Because he don’t need to prove he is innocent when he didn’t file the case.
      The only time he would want to prove his innocence is if the evidence against him is strong yet he can prove he is innocent with his own receipts. Hope this makes sense. It’s similar with murder case. As a defendant you don’t need to prove you’re innocent. It’s the plaintiff that needs to prove you are guilty.

      Did they not prove the money was taken back out of the account? He looking the word chase but I’ve been banking with USAA since I was 15 and never when something was reversed would it say flat out this or that bank. So why wasn’t he made to provide proof that she took the money and the account was closed. They misspoke and then on he was just listening to respond. He took the defendant word for everything he said without proving what he said was true. I’m not understanding how the defendant didn’t have to counter their proof because like they said that money didn’t reverse to no where. It didn’t reverse on its own without somebody doing it and their statement shows it was sent back to the account the defendant admitted she no longer had access to because it was allegedly closed but not without changing the address where any information being sent about the account to where he would only be able to see it.

      @@MommyKi there was confusion in the plaintiff statement. Not that the Judge believed the defendant he wasn’t sure based of what the plaintiffs said and the evidence at hand. That’s why he didn’t give them ruling they became untrustworthy.
      But I was answering your question as to why he didn’t ask for proof from the defendant. But lesson learned. Have your own account in your own name. The whole of them come across dodgy. If you have an account to transfer money why would you put in your brother’s account?
      The whole tax returns when the child don’t live with you. Check bouncing back. Nothing of this makes sense.

    They definitely stole that money. Every time the judge asked him what happened to the money he start talking about how she took his money first. lol so they even now.
    Sounds like she was trying to say she had the log in information not that she was on the actual account. & when he got mad he changed the password & the address for the statement.
    Serves the plaintiffs right tho cus they can’t even get bank accounts in their own name cus of all the money they owe. Prolly ducking child support

    She should have been quiet and let him speak! She kept not answer the direct question saying yes when the answer was no. And he clearly was able to articulate the details better and explain the transactions but she kept yapping 😭

    1. Why the defendant saying they told him his money was gone when he went to the bank when he says the money was his sisters? It was just in his name but the money was his?
    2. Why he calling to reverse money or do anything on the account if it isn’t his money unless they ask him?
    3. Who can you trust? None of these 😂😂

    Judge mathis should have asked why the money reversed in the first place . the transaction was reversed by the brother when he reported the transfer as fraud thats why it went back. he got the money back and closed the account.

    A lot of fraudulent activities. Even down to dividing up the tax return. The kids didn’t live with him full time but he claimed them anyway because she was jobless.
    Which is why he can’t even report the defendant to the IRS. I mean he could but he’ll probably get in trouble too.
