Jessica draws on a decade’s experience of working for judges, with judges and as a judge herself to challenge our assumptions about where judges come from and how they prepare for the job. She invites us to look past the mystique of our inherited traditions and to recognise judging as a unique, and uniquely important, profession deserving greater scrutiny and support.
Jessica is currently a PhD researcher and teacher in the University of Western Australia Law School, having made the move to Perth, Australia with her young family after a strange and wonderful stint as a criminal magistrate in the Seychelles. She trained as a lawyer in New Zealand and then at Yale Law School in the United States, and has always been fascinated by how little we know about how our judicial systems really work. This talk was inspired by an award-winning 3MT (Three Minute Thesis) competition presentation in 2019.
From working behind the scenes alongside top judges and arguing cases before them in New Zealand, to sitting on the bench as a criminal magistrate in the Seychelles, to teaching young lawyers about courtroom ethics, Jessica has been fascinated by the role of judges in society for over a decade.
She’s now a PhD candidate at the UWA Law School, researching the gaps in our current writing and thinking about judges and why we (should) trust them.
In her TEDxUWA Choice Award-winning Three Minute Thesis (3MT) talk in 2019, Jessica asked how much we really know about what qualifies people to sit in judgment on us, and why we have to get past the taboo on talking about ‘judge school’.
Research aside, Jessica is loving settling into Perth with her growing family and supporting the next generation of lawyers through her tutoring work at UWA. Really enjoyed her presentation. I can see why Jessica was selected as a judge in the first instance. And I really honour her integrity to keep working on improving the system, even when she "really didn't have to" once she was made a judge. It shows that her values are aligned with justice and fairness. Pointing out 'weak points' and identifying gaps is all part of making the judicial system fairer for everyone.

I havent watched the video yet but you are so right. Currently have my childs life in the hands of a judge. Its so stressful. Especially when they can just decide whatever they want even in cases where all the evidence and testimony from professionals proves that its the wrong decision. Ive seen it happen in other cases anyway and its totally stressful knowing your childs life is in the hands of a complete stranger. In other situations the judge gets to decide whatever they want and its totally unfair too. They should have set laws to follow. Not give one person 1 year in prison because they have money and the next person 5 years for the same crime just because they feel like it that day. I should probably watch this video now to see what your talking about tho. Lol

My comment isn't aimed at this judge. I read the Australian papers and have seen egregious liberal verdicts handed out on a regular basis for serious crimes. My opinion is every country in the world should have elected judges on 4 year cycles, especially Supreme Court Justices.

You should use the UK system. Judges are selected very carefully and only after an excellent track record as barristers. Diversity isn't an issue. You select on merit and track record, not race or skin colour. Judges attain the honour - that is why the are called "your honour".
You evaluate an active judge by the judgments they make; it is very rare for any judgement to be questioned and found unjust; the rules are defined by previous cases and sentencing guidelines. That is how Common Law works.
As a UK ethnic minority judge, I disagree with this comment.

@@AlphaGeekgirl Everything has flaws. The magnitude of those flaws are what becomes the problem. Obviously judges have a very difficult job, so maturity and experience are paramount.

I believe all Judges also should go through something like 15 days in a local jail and 15 days in the prison they will most frequently be sending their convicts to when they sentence those found guilty. And while they are put into those trial experiences they should be booked such that the guards and inmate population will not be aware that its a mock holding: i feel like judges never are in tune with how much mental and emotional damage comes along with the subtraction of years of freedom. And deeper into their careers they have sentenced so many people to doing time that they even lose sense of the fact that they are basically punishing those convicted by taking away some portion of their lifetime. The time spent incarcerated ages you just as quickly but with very little experiencing of anything of substance.

@@Lulu-mj2fi theres many situations where people didnt do crimes but still have there lives in the hands of a judge. (Kids are a major one) But even in cases for crime, they shouldnt be allowed to give someone probation just because they have money while giving someone else 5 years in jail for the same crime just because they felt like it that day. It should be the same for each crime.

All judges need to be accountable to someone. It makes no sense to give these people god like power over people’s lives when they suffer the same prejudice as everyone else.
The judgements they make are open to scrutiny and must be based on previous case law and sentencing parameters set by government. They are not gods, they simply do an important job. There are always two sides in a courtroom who ensure that the judge is operating fairly and there is always a right of appeal if the judgement is refutable.
This woman is too young and inexperienced to be a judge in my opinion (my judgement), yes, she needs to go to "judge school" before she claims prejudice.
@O k Prove it. Perhaps in Australia where judges are so young they are still getting pregnant. Not in the UK. The outcomes of court cases are scrutinised by the commission of justice, complaints from both sides of the courtroom are investigated and where any impropriety is highlighted it is declared a mis-trial.
The appeals process is supported by different judges to ensure impartiality.
Judges are protected from fallout so that they CAN make judgement without repercussions.
