    I've been the only recognized 'father' figure and Dadda to a child for five years. Bio-mom still has custody but now we're in court due to her potent mental health crisis to determine my defacto parentage rights or a 'third-party' caregiver. After five years as a diligent father, mentor, friend, in ALL ways of stepping up as the dad/father with 'Overt consent' (never implied or tacit) but with ALL permission by the bio-mom, I've been banished by her. Emotional bonding, money, investments, living space, holidays, daycare transport, medical appts, on and on etc, etc. Haven't seen my child for three and a half months since raising him from 3-mos to five years old. Tragic. Agonizing. But myself and another co-parent meet EVERY element of the defacto parentage statute. I'll end with this - like family or divorce court, defacto rulings should only be based on 'win win' scenarios for all parties, blood or not. Not a 'win/lose' as criminal or tort civil court. And ofc, what is always in the best interest of the child. I wish anyone about to fight for their rights to be recognized as a valuable human being in a child's life, success and peace of mind. What an awful road this can truly be. Love to all. A'ho.

      I wanted to say ALL GRATITUDEA TO BOTH OF THESE JUDGES/lawyers for such potent info. To hear the judge speak to HER role and how hard it is and to hear cases with grace and a smile and levity but always with respect to good ppl trying to show the court how much love and devotion they have for the child in question - her words gave me solace. Peace to everyone and if we all focus on the children's needs and not solely the adults, I believe the best decisions will be be made. Love.

    I'm Pro Se. My judge in NY, my ex's lawyer in NY, and her lawyer in Florida all don't understand how the UCCJEA works. It's incredibly frustrating. Ex is literally trying use the UCCJEA to support her unlawful relocation.

    Her answer is wrong. The UCCJEA specify states that the original state sies maintain continuing, exclusive jurisdiction. That's the main purpose of the UCCJEA, to stop one parent from taking the child to another state for favorable jurisdiction or a new forum.

Zero investigation, zero evidence, all rights were violated and stalder is sanctioned in my case by the state commission. Now she is managing attorney of avda to f everyone’s rights over again for people who had stalder and lets say their ex’s goes to avda for false accusations again. Stalder deserves jail and lifetime ban of practicing law.

    I was in an emotional relationship for 14 years, with the spouses cycles every 18-21 months, had a stroke in Jan 21, left me by myself for 2 1/2 years to recover. Then claims she's lonely. Divorce in the making.

    Has anyone ever wondered why child support is demanded even with two parents who have no problem taking care of the child in a 50/50 parenting plan. Single fathers simply have to not consent. Take care of your kids in private. The child support agency is a collection company. Collecting a debt that you never signed up for. Keep it simple take care of your kids in private.

      That would mean the non custodial parent is responsible, mature and takes accountability for their children. Unfortunately, the Child Support office is needed for the immature parents who lpve to show boat physically in front of their kids but not pay a dime for their basic needs. 😕

    Nobody has the right to calculate this the iceberg goes deeper than a simplified explanation I’m a parent that pays child support but yet I’m responsible to get my children and the 50/50 percent but when I have my children I still pay child support while the custodial parent don’t how is that right I get so much taken out of each check which makes it a challenge to meet my needs to honor this 50/50 why isn’t it calculated to see how much I’m still buying my kids things they need while the other party just receives payment there has to be a reform

    Thank you for this!! We’re in NY state and have been trying for years to get my fiancées ex wife evaluated, she has an extensive medical history and has gotten more volatile over the years. She is a covert narcissist based on a 1000 hours of my own research so she plays the victim and super mom roll in public so well we have a real challenge ahead of us! I hope our and her history speaks for itself but since we can’t afford a lawyer we are doing most of the work for our public defender so this was very helpful. It’s terrible even though she cheated on Stefan (my fiancée) NY is a no fault state so not only did he leave the house in a trust for the kids she was able to stay in the house and he also has to pay $540/week in alimony and child support! It doesn’t leave much even though we both work good jobs full time. I’m really wondering the approx cost of this evaluation even though it’s absolutely necessary I’m afraid we won’t be able to swing it. Is there any instances where the court can order it and they help cover the cost? Or is it all out of pocket? Thanks! -Brianna

    Unfortunately my wife has had to deal with court every year her ex husband tries a new narrative. There is an amicus that only seems to meet with her ex and it’s all the same tricks. The is an abundance of evidence in many forms but it’s so rhetorical that no one looks at it. Tons of examples of hypocrisy. Impossible to co parent. I see my kids let down by their biological father and his physical abuse as well as emotional and mental abuse. However I have seem this person kick his 10 year old in the hip and leave a softball shaped bruise. When confronted he said yes he did “put a foot in his ass” and would do that whenever he felt like it. When she showed the amicus she actually made excuses for him when he clearly admitted to it. She also mentioned “she had to report any abuse” so she had the hip x rayed and Dr made a call to CPS and it’s determined to be “isolated incident” how ever now there about 10 or 12 more things from the past that he denied that dont seem isolated. We truly want to co parent and move forward but it’s not us constantly creating new reasons to go to court. I feel for the kids the most. Child want people to listen to them but no one has so far so they now seem to be shut off from themselves.

    Greetings.. how do I stop Child support from garnishing my paycheck when I already prepaid all of it and court order has been fully satisfied?

      You'll need to submit a copy of the Income Withholding Order (IWO) to your pay section. It has to spell out a date or month and year. If you don't have a copy you can get it from the court. I wouldn't trust the court to send it, get it yourself and maintain a copy and submit a copy. They can only stop it with that order and they probably have already in the one submitted, but don't expect them to automatically implement the action without your request.

    I’m in appeal now waiting for a response from DFPS on the 27th asked for a 20 day ext waiting still can you help my case is complex My husband shot me and I lost my leg found out I was pregnant and when I got out the hospital I left with our first child to Texas called the detective in Alabama and he called both PDs and was successful in Bell County DFPS took my child and called me a flight risk bc I was leaving Texas then took my 2nd without a court order based off lies and false documents I have evidence of everything they never returned my two children we both were clean at birth DFPS instead gave my children to the man that shot me sister

    Is VA disability counted towards your income?

      VA pension cannot be counted as income but VA Disability can. VA disability cannot be garnished but someone can apply for an “Apportionment” if the veteran is not paying on time and in full. Ofcourse the VA will not approve it if it causes the Vet undue financial hardship.
