A very simple word of warning on using PPE ( letters of invitation ) coming into the UK ... yet again another band refused entry , even though they had used exactly the same method before .. ... reminiscent of last years problems evidenced through a couple of different German bands at different ports of entry .. few links below on the stories at that time...

A very quick refresher here .. if coming in and doing a permit free event in the UK you cannot do other paid shows whilst in the UK using that as an entry point. Hi all NB: The EXTENDED portables exemption I refer to covers EU and UK only .. remember all other territories may have different rules and this rule does not depend ever to anyone on their citizenship ( I really do get asked this occasionally ) and when I say musical instruments are exempt this only applies in the circumstances outlined in the other video linked at the end of this video.     Does it make any difference if you hire the splitter van as opposed to owning it - the hire company is claiming we need to have a carnet solely because the van is hired.

      You did. I've since been in touch with the Chamber of Commerce and it comes down to whether or not you come across an awkward border officer. Technically if the instruments are in your vehicle and accompanied you don't need a carnet, however the officer could decide that "portable" means only what you can carry in one go and would then insist on a carnet for the rest. The advice was to allow the rules to bed in for a while and see what happens 😅😅 how insane.

It caused a long delay last night but eventually got through and onto the train. Their advice was to let the new rules bed in and see how they're interpreted...you couldn't make it up.

    Sorry for asking another stupid question 😂 My band and I have a van, converted to a minibus, we have been asked to play in Holland (5 band members) the vehicle is carrying 3 guitars, full drum kit, keyboards, guitar and bass cabs and heads, do we need a carnet? Or is it luck of the drawer on whoever is facing us at the Green nothing to declare entrance? I’m so confused 😵‍💫😵‍💫😵‍💫

      Hi .. you "should" be covered by the exemption where to be exact this is what it says about instruments AND amplification "Musical instruments carried by travellers: Musical instruments carried by travellers, whether for professional or personal use, can be declared for temporary admission by simply going through the green or ‘nothing to declare’ channel once they arrive in the customs territory of the Union from a third country/territory. In the case of accessories such as an amplifier or a microphone, as these items would be required to make the instrument produce a sound, they would be eligible for temporary admission as ‘musical instruments’, provided such accessories are carried by the traveller together with the musical instrument. There is no definition in the UCC of what ‘professional purposes’ or ‘professional equipment’ is. In any case, musicians can declare the musical instruments, either considered as professional equipment or not, carried in their luggage for temporary admission by going through the green or ‘nothing to declare’ channel once they arrive in the EU" this is from page 54 of the guidance : Ian

      Personally I’d not list them as officially ( really ) the stands would require a carnet under these regs … simply and truthfully say you are using the exemption if stopped and show them the EU Reg’s document

      @@UkEuropeartsworkINFO I just have this nasty feeling that either going from UK through customs and then arriving in France and then doing the same on the way back from the gig, which is 4 x times of entry and exit, someone at some customs point (French or English) is gonna try and stitch us up and ignore the things I print off on a “technicality” as we are carrying small stands and full Backline… I guess I’ll take the risk in our minibus with the 5 of us 😒

    Hello, i hold british passport but have portguese article 50 resident card under the brexit withdrawal and spouse holds non eu passport but hold the same RESIDENT CARD we want to visit ireland does he need a visa what i looked online it lookes to me he does not require a visa this what i found can you confirm please The legislation that allows this is the Free Movement Directive 2004/38/EC, which grants the right of free movement and residence to EU citizens and their family members, regardless of their nationality. This directive also applies to the European Economic Area (EEA) countries and Switzerland. The UK's withdrawal from the EU does not affect the rights of EU citizens and their family members who are covered by the Withdrawal Agreement, which includes those who have a residence permit under article article 50 brexit

      Hi the answer is a little complicated and depends on your husbands citizenship not residency status. The island of Ireland is part of the CTA common travel area for the UK and Ireland. However the RoI is of course EU. Can you drop me a reply with his citizenship and I’m happy to check his status as a citizen of whichever country he is of! ;-)

      Okay but i was told with irish embasy also if he holds residency article 50 brexit withdrawal it is fine without a visa this is what i found on the immigration.ie According to the information I found, a third country national who is not from the European Union states, but holds a residence permit under article 50 Brexit as a spouse in Portugal, should be able to travel to Ireland from Portugal without a visa. However, they must carry a valid passport and a valid residence card, including a permanent residence card, and present them at the border?. They may also need to comply with the current rules for travelling to Ireland, such as filling out a Passenger Locator Form and having a negative COVID-19 test result.

      Hiya thats the essence of the problem that there is inconsistency in the advice on official govt sites .. I cannot give official immigration advice but The problem is that once he enters Ireland he could potentially enter the UK mainland from Ireland but as a visa national he would require a visa to enter. He would have no right under immigration rules to enter the UK mainland as a third country national with EU residency. I would if I were you ask the embassy to reply to you in writing confirming what you have been told and have that with you when entering Ireland. @@jasminbegum9422

    Hello, I am a Portuguese with a Portuguese passport. I entered the UK in August, because now the UK has left the EU🇪🇺, the theory is that the British authorities will stamp our passports when we enter the UK with EU passports. And indicate the period of stay, but after I entered the country, I found that my Portuguese passport was the same as before when the UK had not left the EU🇪🇺. My Portuguese passport did not have a stamp and period of stay, but the problem came again, my A British friend traveled to Greece last month, and his British passport had been stamped by the Greek Immigration Bureau, indicating that he could only stay for ninety days. People with British passports had to queue up to go through customs through another channel, and I had a Portuguese passport in August. When I went to the UK, I went through the same channel as the British.

    Will Spain change the 90 day rule for Brits? Spain currently does not have any plans of changing the 90-day rule. Technically, this rule is not under Spanish jurisdiction, as it is a rule that applies to the whole Schengen Area. So even if Spain wanted to change this rule, the change can only be initiated by authorities of the European Union.28 Aug 2023

      Your visa will allow you to work within the category it was first listed as and in line with your original CoS … you must on re-entry get another stamp in your passport and of course inform your sponsor of any work planned. Was the new work you have planned already known by the sponsor?

    We are traveling into UK with minimal equipment from Sweden, and we have a certificate of sponsorship. The festival we are playing says that the have had bands come into the UK with minimal equipment without a carnet. What would be the consequence if we get challenged for one, without having it?

    Thanks for all the info, very very useful. I don't know if it has been mentioned but it is a very good idea to carry proof of ownership documentation. A sales receipt with the relevant serial numbers etc, this is just so that the border control can verify that you aren't trafficking stolen goods or someone else's instruments.

    Whats the maximum stay in the uk with just a passport... I looked that i can still up to six months but im still confused cuz the. I also see that i need a standard visa.. is my passport a standard visa this is my first time traveling to the uk ive been her for about 3 months now staying with my bf and have income coming in every week.. i just really need someone to clear this up for me so i dont get in trouble im trying to expand my stay for a year and idk what to do should just call the uk embassy or the us embassy..

      If a third county non visa national then its a maximum of 180 in 360 .. but your passport must be valid for the entrie period you ar in the UK ( Sorry been away on medical adventure thus just back )

      The problem is that as in all things governmental especially when official advice changes is that it takes a while to filter through … which is why I always advise having proof with you. I know for an absolute fact one band used this and the download to get through customs in Dieppe this weekend by showing the relevant page as noted … it’s the world we work in unfortunately;-)

      @@UkEuropeartsworkINFO for my sins, I did once work for Customs and Excise (as was). Information gets to the coal face pretty slowly. That's by no means exclusive to the civil service.

    If a five piece band are travelling in a splitter van and they travel back and forth over the border with all their own portable musical instruments and associated equipment in the back...do they need an ATA Carnet?

      Hi at the moment I know that EU were asked to include transported by vehicle but was not included in the advice ... so at the moment that would be in the discretion of the customs officer on duty .. sorry cant be clearer we have this and would hope we can move further along the line .. Ian

      @@UkEuropeartsworkINFO so....is it fair to suggest you are saying that.... if you fly in or out of the EU or UK with portable musical instruments and equipment or travel on Eurostar or a bus you’re in the clear and don’t need a carnet …but if you travel in your own private vehicle such as a car or tour bus or splitter van up to 3.5 tons with windows down the side it’s "at the discretion of the customs officer?" So travelling in your own vehicle means ATA Carnet unless you risk “discretion of customs officer” but planes, or bus or Eurostar or on foot no ATA Carnet? Just want to be clear about what you are saying. I think the clarification is great news, some progress...with thanks to Dave and yourself...but we still have a major issue with ATA Carnet requirements as far as crossing the border in your own vehicle or a private hire vehicle up to 3.5 tons or via Tourbus.

    Point of clarification. A truck is not allowed but what about a personal car? The statutory instrument implies that accees through the green channel must be pedestrian.

      Hi Dai .. correct and also true of EU side .. carrying within a vehicle ( of any sort ) isn't currently in the advice though I know it was requested .. we would hope to get this along the way .. we have progress but oh so much more to do ..

    This video needs to be shared widely because a lot of people (especially non-pro / touring bands) will be caught out by this. The CoS route is a joke too, As a British citizen I immensely dislike having to spend hours of my days filling in forms and US embassy visits to enter the USA, but CoS allows anyone to enter the UK easily, it’s not reciprocal and it’s NOT fair!
