240 hours of community is so much.

It is not as cut and dry as that. The only thing that is cut and dry is if an officer asks questions, the only response should be "Am I free to leave?" If they say anything other than "Yes" Then "I plead the 5th" is the only appropriate response. If they insist on identification hand over a drivers license. And continue to state, "I plead the fifth."

This issue has not been decided by the Indiana Courts. But I would argue you do not have to provide any ID as there was no traffic violation or ordinance violation committed (Indiana’s Refusal to Identify requires ID if there is an infraction or ordinance violation)

The mandatory jail days are tied into federal highway funds so almost all states have these minimum punishments.

I hope a drunk driver never crashes into anyone. I also hope that no one is falsely convicted of a crime they did not commit b/c they had a bad attorney. Those two statements are not mutually exclusive.

Hi Marc. So, let’s say someone’s getting beaten up outside and they were not the aggressor, but someone came up to them randomly and punched them in the head. Then, continued swinging at them. Does the person being assaulted at this time, have the right to use a firearm and shoot their attacker? Even though their attacker is only using their fists? Because, eventually you can get knocked out from being punched repeatedly.

In Indiana that is all you have to do when pulled over. You have no duty, obligation or reason to assist in the officer’s investigation.

Brother. It is. An ordinance is a law or decree by a municipality, a local law.

Really need to look up what a law is and what a ordinance is, A law is state wide. Like bank robbery. An ordinance can be a rule enacted by a city or county, such as not being allowed in the public park after sunset, no exessive noise in your neighborhood between certain hours, loose dogs must be on a leash, etc. Yes, ordinances are enforceable. Your local police did not tell you that ordinances are suggestions.

But you also have to have done an infraction to get pulled over. I got pulled over one time I said to the cop, what are you pulling me over for? I know I didn't break any traffic laws I use my blinker I didn't make any illegal turns I didn't speed I didn't run any stop signs or traffic signals. He said you're right you didn't break any traffic laws I just need to see your ID I refuse to give him my ID. I said you just verified you illegally pulled me over so you have no reason for me to give my ID since I didn't break any traffic laws

Please send me the US Supreme Court case, with citation, that holds States have no right to regulate traffic within their borders.

@@AttorneyMarcLopez they do just under Commerce. That means if you are driving for commerce you must pay. If you are a traveler in a conveyance of your own, traveling from point A to point B. You do not need a driver license, insurance or registration. This has been ruled over 200 times at the Supreme Court level. Please take the time to look up, research and investigate for yourself. Yep. This is applicable to Indiana. I tried to make that apparent with the title but I know YT might not make that prominent.

A few things: 1) You can call the police station and ask for the report or CAD (computer aided dispatch) or body / dash cams to try to figure out why they stopped you. 2) If no reason for stopping you can sue them civilly for false arrest

@@AttorneyMarcLopez well if they have a body can and even if they do a lot of times the video on it gets deleted altered or you're not able to get it at all etc that's why I have a dash cam on my car and that records my speed GPS and other information it's helped me avoid five tickets so far when I tell them that my dashcam records my speed they've done 1 of 2 things tell me I have they have the wrong car indoor mistaken or tell me that I'm lucky because they have to go to another call. Coincidence that it has happened 5 times I don't think so it's a pattern.

@@AttorneyMarcLopez why would they let me go five times when I tell him that my dash cam records my speed when they told me that I was pulled over for speeding why would they make up excuses to leave the situation as fast as possible

@@AttorneyMarcLopez police can make as many mistakes as they want and we suffer the consequences luckily nothing happened to me those five times and I was able to leave the situation without a ticket but why was I stopped if I was not breaking the law because the officers assumed I was breaking the law you see the gray area that I'm speaking about
