    Hey, Tom. I have a question about the gift transfer form. The video shows Rev. 2-17/7, but the one I downloaded is Rev. 4-24/8. Rev.4-24/8 has a different layout. Qualified Revocable Trust and Qualified non-profit IRC are in an area below the other options above. If I check child, do I still have to check one of the other 2 boxes? I assume that I can leave those two unchecked. Thanks!

      Yeah I had a friend tell me the form is updated I just haven’t gotten time to make the video. The county will most likely accept the old form and the new form will work as well. You can just take it in there and they’ll tell you what to do.

    What if I don't have a copy of the seller's ID? What if the bill of sale is a different name than the name on the title? The person who sold the vehicle never registered it into their name, but the title was signed over to them from the previous owner.

      I’m assuming you are in possession of that title. That will work fine. The bill of sale is fine. And you don’t have to have their ID I just do it in the event they turn out to be stolen. Your bill of sale and that title will be more than adequate.

      You should also have your brother go with you to the tax office and sign the gift tax form, where you’ll only have to pay a $10 gift tax on the car. If he can’t go with you he can have the form notarized and you can take it in.

      You can get insurance. Maybe your insurance company won’t do it but just about all of them will give you liability which is all that required.

    If I live in California (as the owner of the car) and want to gift the vehicle to someone who lives in Texas (where the car is registered and currently located), do both of us need to get the document notarized?

      No, you will need your signature notarized as the gift giver. The recipient will sign when they get to the tax office so no notarizing is needed on their part. You will also need to sign form 130-U as seller but it does not need to be notarized.

      I beg to differ. You say we know that people need a car so we screw you over. Do we not also know then that the franchise dealer won’t finance you? That your momma won’t co-sign? Why is that? Could it be a history of not paying bills on time? And I have yet to see a lot sell an $8000 car for $25k. And aside from that, if you’re being “screwed over” why buy the car? Maybe save your money and pay cash for one from an individual? The reality is when you have poor credit things cost more.

      No, titles are printed in Austin and usually show up about three weeks after you went to the county.

      It used to be they would accept your current insurance. You can call your county tax office and confirm.

    Ive got an odd one. I have an 07 4runner that belongs to one of my tenants, that is behind on rent, and the vehicle needs tires, cv joint, battery, one brake repaired and hasnt run for years. She gave me the kentucky title where her mom transferred it over to her in 2017 BUT she never finalized the transfer for lack of funds. She basically said i could use it to catch rent up BUT she left her common law husband and has hinted to him she wants her truck back. I went to dmv and they said "bonded title" but if i do that....i know they will contact the girls mom and they will probably retrieve the truck before i get a title. Any thoughts? Can i have her common law husband put it in a shop and let it go into a mechanics lien situation or file for abandonment or anything?

      You can’t file a mechanic lien if you’re not a shop with a signed work order. You also can’t use that title with her name written in as a buyer she would need to transfer into her name and then sell it to you.

      You’ll probably want to get a bonded title unless you can locate all the heirs and have them sign off on the form.

      Well, I think most likely you’re safe forming the corporation with and paying that fee with a personal credit card. Since it’s the inception of the LLC. I think that more applies to commingling the funds once it’s up and running. But sending a money order and mailing it in probably gets you the same protection. Until the corporation is formed and the members seed the initial investment it doesn’t really have money to file forms and such.

    My daughter bought a car and the seller signed the back of the title. However he didn’t sign it exactly as it appears on the front. As an example on the front it is printed- JOHN DOE SMITH on the back he signed like this J SMITH and printed out the full correct name Ex. JOHN DOE SMITH from watching your video, it appears she may have problems. What can she do to avoid a potential problem? I know you mentioned there is another form that the seller can sign.

      So there may be tax offices that will accept that since he printed his name correctly. I’d probably try to use that first. If they won’t accept it they will most likely give you a statement of fact to fill out and the seller can sign that.

      I will be looking into that shortly. I’ll be talking to my guy at the county. I would imagine there has to be some type of inspection but I can’t say for sure yet.

    So I went to a place to do all this for me, the gave me my plates, the stickers and told me the rebuilt title was going to be mailed to my address. However the did not ask me to pay any taxes, and the “Title Application Receipt” has all the fees paid, but in the “Sale tax fee” has a 0 on it. I am wondering if I am going to receive the title or I’m going to receive a letter telling me to pay taxes? Pd. I bought the car from Copart, the charged a bunch of fees and sales tax on it. Bought it in Texas, registered in Texas again. Idk if that sales tax count.

      So when you buy from copart they generally collect the tax and pay it to the county for you so you should be fine.

      The vin was checked by the DMV when the bond letter was written. And then it cleared the DPS hold before the title was released. It wasn’t until after all that had happened that a family member had come to check the owners property and realized the Jeep had been stolen it and reported it.

    I have the title but the guy signed it but they couldn't read the date on it so they gave me a form to have him fill out to get the title in my name so I'ma have to find him or do I file for a lost one bond title ??

      I assume they gave you a Statement of Fact or Statement of Correction. Ideally you find him and have him sign that so you don’t have to go through the bonded process. If you can’t find him then yes, a bonded title will be your only option.

    Let’s say you fill out all your info on the back of the title as the buyer and the seller signs incorrectly, what should the next steps be as the buyer? Can you just not move forward with the purchase? And for section 38 of the app for Texas title, who should fill that out and how?

      If the seller signed the title wrong you can fill out a statement of fact which there are several available from different counties and y’all would write in seller signed incorrectly or sellers legal name on the title and seller’s name as they signed are one in the same person and you’ll be good. All the seller really needs to sign on the application is the seller sig store line buyer can do the rest.

Im not planning on replacing that any time soon. Would I still be able to go through this rebuilt process ?? I’m not really gonna do any work to it besides the title ?? How does that work ?

      I believe if it passes the safety inspection you are good but if there are lights mounted on the bumper that’s damaged they all must work properly.

    Hello, I have some questions regarding the odometer part of the title. Im in the process of selling my vehicle and it currently has over 200,000 miles. Which option would be best to mark off? And for that section would the current owner--me--have to fill that out OR would that be for the new owner to fill out? Thank you so much for this video. You definitely explained it in detail!

      On the back of the title either of you can write in the mikes at the time of sale. Unless your odometer doesn’t go to 200k. (It does) or if it’s broken (it isn’t) you don’t check either box you only write in the miles.

      It has to have its Texas safety inspection. And a bill of sale isn’t required but it’s not a bad idea.

    Great information! Question... I bought an RV early this month (Aug). Tag is good until Dec 2024 (also double checked at the 'mytxcar' site). As the buyer do I still need to get an inspection? If I decide to sell the RV tomorrow will I need to get another inspection? Thanks!

      The law is that for a person to person sale the vehicle needs an inspection no more than 90 days before the registration is renewed. As for selling it, if you did not first title it in your name and you’re hoping to just hand a signed title to the next guy that’s title jumping which is actually a felony.
